Introduction Now more than ever, States are turning to the International Court of Justice and other courts and tribunals to vindicate their rights under international law. But winning a case is not just about having strong legal arguments. It also often calls for a sophisticated litigation strategy involving various procedural and evidentiary tactics, as well as—in some instances—simultaneous or sequential recourse to multiple judicial fora. Drawing on the speaker’s experience representing States before the International Court of Justice and other courts and tribunals, this seminar looks behind the scenes of recent cases in public international law to critically assess the strategies employed by States to achieve their litigation objectives.

About the Speaker Peter Tzeng is a Partner at Foley Hoag LLP, where he exclusively advises and represents sovereign States on matters of international law. He regularly litigates cases before the International Court of Justice, where he clerked for a former President of the Court prior to joining the firm. He also represents States in inter-State and investor-State arbitrations, and advises States in treaty negotiations and on matters before the United Nations and other international organizations.
