Entry into Force / Termination Provisions

Chapter 18, Article 7: Entry into Force

“1. Each Party shall notify each other Party in writing upon completion of its internal requirements necessary for entry into force of this Agreement. This Agreement shall enter into force on 1 July 2009 for any Party that has made such notifications provided that Australia, New Zealand and at least four ASEAN Member States have made such notifications by that date.

2. If this Agreement does not enter into force on 1 July 2009 it shall enter into force, for any Party that has made the notification referred to in Paragraph 1, 60 days after the date by which Australia, New Zealand and at least four ASEAN Member States have made the notifications referred to in Paragraph 1.

3. After the entry into force of this Agreement pursuant to Paragraph 1 or 2, this Agreement shall enter into force for any Party 60 days after the date of its notification referred to in Paragraph 1.”

Chapter 18, Article 8.2: Termination

“This Agreement shall terminate if, pursuant to Paragraph 1:

(a) Australia withdraws;

(b) New Zealand withdraws; or

(c) this Agreement is in force for less than four ASEAN Member States.”

Dates of ratification and accession given above were obtained from the WIPO Lex web pages, with the exception of ratification and entry into force information for Myanmar, Cambodia, Lao PDR and Indonesia, which were obtained from AANZFTA Joint Committee Meeting Reports as follows: the reports list the entry into force dates for Cambodia and Lao as “January 2011”. Indonesia’s date of ratification was indicated as 6 May 2011 and the CIL team has therefore calculated the date of entry into force as 5 July 2011. Myanmar’s date of ratification/deposit of ratification is not indicated. In all cases, it is not clear if the dates of ratification/notification indicated are those of the date of deposit or the date of issuance of the instrument.
