Dispute settlement provisions

Article 28 ‘Dispute Settlement’: “The provisions of the ASEAN Protocol on Enhanced Dispute Settlement Mechanism, done at Vientiane, Lao PDR on the 29th day of November 2004 and any amendment thereto, shall apply to disputes arising under this Agreement.”

This Agreement is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022).

Entry into Force / Termination Provisions

Article 31.3 ‘Final Provisions’: “This Agreement shall enter into force upon the thirtieth day after the deposit of the second Instrument of Ratification or Acceptance, and shall be effective only among the Contracting Parties who have ratified or accepted it. For each Contracting Party ratifying or accepting this Agreement after the deposit of the second Instrument of Ratification or Acceptance, this Agreement shall enter into force on the thirtieth day after the deposit of such Contracting Party of its Instrument of Ratification or Acceptance.”

Note Article 4 ‘Scope of Application’:

“The provisions of this Agreement shall apply to inter-state transport. Cabotage is not covered by this Agreement.”

 

Article 30.2: 

“The Protocols under the ASEAN Framework Agreement on Facilitation of Goods in Transit which are referred to under this Agreement, and any amendments to such Protocols, shall apply mutatis mutandis to inter-state transport under this Agreement. Such Protocols, and any amendments thereto, shall be regarded as an integral part of this Agreement.
