Dispute settlement provisions

Article 8

“Any difference or dispute among All Participants arising out of the interpretation or implementation or application of any of the provisions of this Memorandum of Understanding will be settled amicably through mutual consultation or negotiation among All Participants through diplomatic channels, without reference to any third party or international tribunal.”

Entry into Force / Termination Provisions

Article 7

“1. All Participants will notify each other Participant in writing upon completion of their internal requirements necessary for the entry into force of this Memorandum of Understanding. This Memorandum of Understanding shall enter into force thirty (30) days after the date of the last notification of completion of the internal requirements by all ASEAN Member States and China.

2. This Memorandum of Understanding will remain in force for a period of five (5) years, and will be automatically extended for a successive period of five (5) years unless one of the Participants notified all the other Participants of its intention to terminate this Memorandum of Understanding by a notice in writing at least six (6) months before the date of expiration.

3. The termination of this Memorandum of Understanding will not affect the implementation of on-going activities and programme which have been agreed upon by All Participants prior to the date of termination of this Memorandum of Understanding.”
