Dispute settlement provisions

In accordance with Article 25 of the 2007 Charter of the Association of Southeast Asian Nations which provides that “Where not otherwise specifically provided, appropriate dispute settlement mechanisms, including arbitration, shall be established for disputes which concern the interpretation or application of this Charter and other ASEAN instruments”, and Article 2.1(b) of the 2010 Protocol to the ASEAN Charter on Dispute Settlement Mechanisms, which provides that “This Protocol shall apply to disputes which concern the interpretation or application of other ASEAN instruments unless specific means of settling such disputes have already been provided for.”

Entry into Force / Termination Provisions

“Article 6 Entry Into Force And Termination:

This Agreement shall enter into force on the date of Signature by all members of ASEAN and shall remain in force until it is terminated by the decision of all the ASEAN Foreign Ministers. This Agreement shall be deposited with the ASEAN Secretariat.”
