Dispute settlement provisions

Article VI ‘Consultations’:

“15. Consultations may be undertaken by the Contracting Parties in accordance with the provisions of Chapter VII, Article 14 of the ASEAN-PTA.”

This was one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 1996 Protocol on Dispute Settlement Mechanism read together with its Appendix 1.

Subsequently, this is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with Article 24.3 of the 2007 ASEAN Charter which states as follows: “[w]here not otherwise specifically provided, disputes which concern the interpretation or application of ASEAN economic agreements shall be settled in accordance with the ASEAN Protocol on Enhanced Dispute Settlement Mechanism”

The 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes.

Article IX, ‘Entry Into Force’:

“21. This Memorandum of Understanding shall enter into force from the date of its signature and shall initially apply for a period of five (5) years. It may be extended by the consensus of all member states beyond the original five-year period.”
