Article IX: General Provisions

“2. The Parties will resolve, in the spirit of cooperation and mutual trust, any and all difficulties which may arise under this MOU. Upon the request of the one of the Parties, mutual consultations on matters of interest in relation to the AADCP may be held between the Parties.”

Article XI: Entry into Effect

“3. Any differences arising in the interpretation of the provisions of this MOU will be settled through consultations among the Parties.”

Entry into Force / Termination Provisions

Article XI: Entry into Effect

“1. This MOU will take effect from the first day of the month following the date on which the Parties have notified each other of the completion of the procedures necessary for entry into force.

2. This MOU will be effective until 30 June 2008.

4. Each Party may terminate this MOU at any time by giving to the other Party six months advance notice in writing through normal diplomatic channels except that any termination or expiration of this MOU will affect neither the financial commitments nor any projects and activities initiated before such termination or expiration.”

The 2002 MOU on the AADCP was signed by the Minister of Foreign Affairs of Brunei Darussalam (as assigned by ASEAN, see preambular paragraph 7), and the Minster for Foreign Affairs of Australia as the authorized representatives of the parties.

The ASEAN-Australia Development Cooperation Programme (AADCP) is the successor plan to the ASEAN-Australia Economic Cooperation Program (AAECP) that was founded in 1974. Following the completion of this initial phase of the AADCP, a 2009 MOU was signed to implement a second phase (AADCP II) from 2009-2015. The AADCP II was extended till 2019 through an exchange of notes.
