5 August 2021: Senior Research Fellow Denise Cheong Presents at the 2021 ILA-ASIL Asia-Pacific Research Forum

Senior Research Fellow Denise Cheong presented on ‘Enhancing Transboundary Consultation in the Context of Nuclear Power Development in Southeast Asia’ as part of the 2021 ILA-ASIL Asia-Pacific Research Forum on ‘International Law and Post-Pandemic Asia: New Economic Challenges and Opportunities.’ She was part of Panel 3 on Environment, Energy and Sustainability that was held on 5 August 2021. This presentation was based on a paper she co-authored with Research Fellow Nivedita S which examines the extent to there is normative support for transboundary consultation in relation to a State’s national decision to embark on a nuclear power programme and the siting of a nuclear power plant. To this end, its analysis at the international level focuses on (i) the conventions, safety standards and guidelines of the International Atomic Energy Agency (IAEA); (ii) the Convention on Environmental Impact Assessment in a Transboundary Context (Espoo Convention) and the Protocol on Strategic Environmental Assessment (Kyiv Protocol) of the United Nations Economic Commission for Europe (UNECE); and (ii) customary international law. At the ASEAN level, it considers the support provided by ASEAN legal and other instruments and proposes ways for ASEAN to further strengthen the collective normative basis for transboundary consultation.
