ASEAN Economic Community: Investment

Module contributor: Professor Sungjoon Cho and Professor Jürgen Kurtz This course explores the regulation of foreign investment in ASEAN. It is divided into three parts. First, it begins with a contextual historical analysis of the field of international investment law, with a particular focus on entry into bilateral investment treaties (BITs) by individual member states in ASEAN. Second, the course explores the construction of regional investment rules in ASEAN, and identifies the political, legal and economic considerations that have shaped the distinctiveness of ASEAN’s rules when compared to individual BITs. Third, the course evaluates the rationality and impact of the external dimensions of ASEAN’s regulation of foreign investment, including the maintenance of existing BITs and negotiation of new investment instruments with third-party states.
