The 2026 CIL – SCW seminar - “Making the Case for Mediation in ISDS: Internal Advocacy for Government Lawyers and Law Practitioners” - explored how government lawyers, in-house counsel and private practitioners can effectively advocate for the use of mediation in Investor-State disputes within their own organisations. It focused on identifying and addressing common misconceptions - such as concerns over enforceability, loss of control, or perceived weakness - and reframing mediation as a strategic, credible, and outcome-oriented tool. The objective was to provide practitioners with data and practical tools they can use to effectively advocate for the use of mediation in Investor-State disputes internally.
