Dispute settlement provisions

In accordance with Article 19 ‘Dispute Settlement’ of the 2006 Agreement on Trade in Goods under the Framework Agreement on Comprehensive Economic Cooperation among the Governments of the Member Countries of the Association of Southeast Asian Nations and the Republic of Korea:

“Article 19: Dispute Settlement

Unless otherwise provided in this Agreement, any dispute concerning the interpretation, implementation or application of this Agreement shall be resolved through the procedures and mechanism as set out in the Agreement on Dispute Settlement Mechanism under the Framework Agreement.”

Entry into Force / Termination Provisions

Article 10: Entry into Force

“1. This Protocol shall form an integral part of the Agreement. It shall enter into force on 1 January 2016, provided that Korea and at least one ASEAN Member Country have by then notified all the other Parties in writing of the completion of their internal procedures necessary for the entry into force of this Protocol. In the event that this Protocol does not enter into force on 1 January 2016, it shall enter into force on the first day of the second month following the latter date on which Korea and at least one ASEAN Member Country have notified all the other Parties in writing of the completion of their internal procedures.

2. Each Party, upon completion of its internal procedures for the entry into force of this Protocol, shall notify all the other Parties in writing.

3. Where a Party is not able to complete its internal procedures for the entry into force of this Protocol by the entry into force date set in paragraph 1, this Protocol shall enter into force in relation to that Party on the date of notification of completion of such internal procedures.”

This instrument amends the 2006 ASEAN-ROK Agreement on Trade in Goods and Annexes 1, 2 and 3 of the Agreement. Annex 2 was also previously amended by the 2010 Protocol to Amend the ASEAN-ROK Agreement on Trade in Goods.

Entry into force dates and ratification/notification information were not available from the ASEAN Secretariat website as of the time of this update. The entry into force date and ratification/notification information was obtained from the website of the Ministry of Trade and Industry of Malaysia, with the exception of the date of transmission of the notification of Indonesia, which was obtained from the Ministry of Foreign Affairs of Indonesia.
