Dispute settlement provisions

Refer to Article II, Section 5, subparagraph iv:

“Section 5. Upon completion of such negotiations the Agency shall prepare an agreement which shall inter alia:

  1. Define the parties, the co-operative project and the manner of implementing it. In defining the manner of implementation of the co-operative agreement, provision shall, inter alia, be made for the establishment of a Scientific Co-ordinating Committee;
  2. Provide for the application of the health and safety measures specified in Agency document INFCIRC/18;
  3. Contain an undertaking by the Governments against military use of the assistance provided for the project;
  4. Provide for the settlement of disputes;
  5. Specify the liability of the parties thereto; and
  6. Set forth any other provisions as may be appropriate.”

Entry into Force / Termination Provisions

Article IV Section 10:

“This Agreement shall enter into force upon receipt by the Agency of the second notification of acceptance from a Member State of the Agency within the areas referred to in Section 9. With respect to Governments accepting the Agreement thereafter, it shall enter into force on the date of such acceptance.”

Article IV Section 11:

“This Agreement shall continue in force for a period of five years from the date of the second notification of acceptance.”

Refer to introductory section, paragraph 2 of 1987 Regional Co-operative Agreement for Research, Development and Training Related to Nuclear Science and Technology:

“The 1987 RCA, which entered into force on 12 June 1987, replaces the RCA of 1972[1], as extended in 1977[2] and in 1982[3].”
