Dispute settlement provisions

“Article XIX Settlement of Disputes:

The Centre shall make provisions for appropriate modes of settlement of:

1) Disputes of a private law character to which the Centre is a party other than those referred to in Article XIII, paragraph 1; and

2) Disputes involving any official of the Secretariat who enjoys immunity under the provisions of this Agreement, if immunity has not been waived in accordance with Article XVI, paragraph 3.”

Governments of Japan and the ASEAN Member Countries (at time of signature: Indonesia, Malaysia, Philippines, Singapore, Thailand). Note that the 2007 Amendments to this agreement specify the depositories to be the ASEAN Secretariat and the Government of Japan.

“Article XXIII Entry Into Force:

This Agreement shall enter into force on the date on which Japan and all the ASEAN member countries have deposited instruments of ratification or acceptance.”

(1) no records of the signatories’ ratifications are available
(2) it is unclear if there were extensions of the five-year duration in accordance with Article XIV
The date of entry into force was listed as 21 May 1981 as of 13/05/2019 on the ASEAN Resource Centre website (https://arc-agreement.asean.org) The information is no longer publicly available.
However, it is clear that the ASEAN Japan Centre continues to operate, with a functioning Council, Executive Board and Secretariat, and that amendments to this agreement were agreed by the AJC Council in 2007.
