Article 21: Entry into Force “1. This Agreement shall enter into force on 1 July 2006, provided that at least one ASEAN Member Country and Korea are among the Signatory Countries that have by then notified all the other Parties in writing of the completion of their internal procedures. In the event this Agreement does not enter into force on 1 July 2006, it shall enter into force on the first day of the second month following the latter date on which at least one ASEAN Member Country and Korea have notified all the other Parties in writing of the completion of their internal procedures. 2. A Party shall, upon the completion of its internal procedures for the entry into force of this Agreement, notify all the other Parties in writing. 3. Where a Party is unable to complete its internal procedures for the entry into force of this Agreement by the date as set out in paragraph 1, this Agreement shall come into force for that Party upon the date of notification of the completion of its internal procedures. The Party concerned, however, shall be bound by the same terms and conditions of this Agreement, including any further commitments that may have been undertaken by the other Parties under this Agreement by the time of such notification, as if it had notified all the other Parties in writing of the completion of its internal procedures before the date of entry into force of this Agreement.” |

The instrument was adopted following negotiations based on Articles 1.3 and 2.1 of the 2005 Framework Agreement on Comprehensive Economic Cooperation among the Governments of the Member Countries of the Association of Southeast Asian Nations and the Republic of Korea. The date of entry into force listed above is taken from the Treaty Room of the Ministry of Foreign Affairs of Indonesia. The ASEAN-Korea Free Trade Area website also states that this Trade in Goods Agreement entered into force in June 2007 (exact day unspecified). Ratificaton/notification dates were not available from the ASEAN Secretariat website or ASEAN-Korea FTA website as of the date of update. The ratification/notification dates provided above for the Republic of Korea and Thailand were last accessed on the ASEAN-Korea FTA website maintained by the ASEAN Secretariat on the date indicated. The remaining dates were obtained from the Treaty Room of the Ministry of Foreign Affairs of Indonesia; however the dates of receipt by the depository are not available in this collection and the dates of transmission or adoption of the instruments have been provided instead. Thailand acceded to the 2006 Agreement on Trade in Goods and its letters of understanding via the 2009 Protocol on the Accession of the Kingdom of Thailand to the Agreement on Trade in Goods under the Framework Agreement on Comprehensive Economic Cooperation among the Governments of the Member Countries of the Association of Southeast Asian Nations and the Republic of Korea. |
