Dispute settlement provisions

Article 5: Dispute Settlement Mechanism

“Paragraph 1 of Article 11 of the Framework Agreement shall be amended as follows:

“(1) The Parties shall, by 2009 or such other dates as may be mutually agreed upon by the Parties, conclude negotiations for the establishment of the dispute settlement procedures and mechanism for the purposes of this Agreement.””

Note: This instrument is a covered agreement under the 2009 Agreement on Dispute Settlement Mechanism Under the Framework Agreement on Comprehensive Economic Cooperation between the Association of Southeast Asian Nations and the Republic of India, which states that the latter applies to all disputes arising under this instrument (Article 2 and 1(d)).

Entry into Force / Termination Provisions

Article 7: Entry into Force

“1. Each Party shall notify all the other Parties in writing upon completion of its internal requirements necessary for the entry into force of this Protocol. This Protocol shall enter into force on 1 January 2010 or the date by which such notifications have been made by the Governments of India and at least one (1) ASEAN Member State.

(2) When a Party is unable to complete its internal requirements for the entry into force of this Protocol by 1 January 2010, this Protocol shall enter into force for that Party on 1 June 2010 or upon the date by which that Party notifies the completion of its internal requirements.”
