Dispute settlement provisions |
Pursuant to Article 12.2 of this instrument, “This Protocol with its Annex and Technical Appendix shall form an integral part of the Agreement [1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit]. In the event of any inconsistency or conflict, the Agreement shall prevail over this Protocol.” Article 30 of the 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit refers to the consultation and dispute settlement rules and procedures in the 1996 Protocol on Dispute Settlement Mechanism. The 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit and Protocol 7 are both “Covered Agreements” pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. Previously, they were “Covered Agreements” under Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix I. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes. |

Article 12: Final Provisions “3. This Protocol shall be subject to ratification or acceptance by the Contracting Parties. The Instrument of Ratification or Acceptance shall be deposited with the Secretary-General of ASEAN who shall promptly inform each Contracting Party of such deposit. 4. The Protocol shall enter into force upon the deposit of Instruments of Ratification or Acceptance by all Contracting Parties with the Secretary-General of ASEAN.” |
