and Responsible AI Use in the Courtroom

BACKGROUND Artificial intelligence is increasingly entering courts and legal systems through legal research platforms, document review tools, evidence analysis, transcription, translation, drafting support and court administration. At the same time, courts are facing new risks from AI-generated and AI-altered material, including synthetic documents, deepfake audio and video, manipulated images, altered metadata, fabricated case law and hallucinated legal citations. These developments raise deeper questions about the independence of courts and the sovereignty of legal systems. When courts, lawyers and public institutions rely on AI systems developed outside their jurisdiction, trained on non-local legal data or controlled through opaque private infrastructures, questions arise about accountability, legal autonomy, data control, institutional trust and the protection of domestic legal values. For many Asian jurisdictions, responsible AI use in the courtroom cannot be limited to technical reliability. It also requires safeguards against over-reliance on AI tools, hidden bias, loss of human judgment, professional negligence and undue dependence on systems that may not reflect local languages, laws, procedures or constitutional traditions. The webinar will therefore move beyond a narrow discussion of AI-generated evidence. It will place courtroom AI use within a wider governance framework that connects algorithmic sovereignty, judicial independence, legal ethics, access to justice and sustainable peace.
PURPOSE The webinar will initiate a BIMSTEC and UNESCO Chair dialogue on responsible AI use in courts and legal practice, with a view to developing practical policy guidelines for Asian jurisdictions. The proposed policy guidelines will focus on how courts and legal practitioners can address AI-generated evidence, deepfakes, hallucinated legal citations, AI-assisted legal research and courtroom use of digital tools, while preserving judicial independence and local legal autonomy. The webinar will also consider algorithmic sovereignty in the justice sector. This includes questions of data governance, dependence on foreign AI tools, transparency of legal AI systems, accountability for errors, localisation of legal datasets and the ability of courts to retain control over judicial processes.

Dr Jon Truby is the UNESCO Chair on AI Law & Sustainability at the Centre for International Law, National University of Singapore. His work focuses on AI law, technology governance, sustainability and responsible legal frameworks for emerging technologies.

Mr Sutpiti Vattanahathai is a Judge in the Office of the President of the Supreme Court of Thailand. He previously served in the Research Division of the Supreme Court, where he prepared, reviewed and drafted Supreme Court judgments in criminal, civil and public office-related cases. He has also served as a judge in Thai courts of first instance, adjudicating civil and criminal matters.

Mr Yoganaadan Kadirkamu Kandasamy is Director of the Science, Technology & Innovation Division at the BIMSTEC Secretariat. He is a Grade One Officer of the Sri Lanka Foreign Service with over two decades of experience in diplomacy, economic affairs and development administration.
Mr Mohammad Aneek Rushd Haque | Additional Attorney General for Bangladesh
Mr Mohammad Aneek Rushd Haque is the Additional Attorney General for Bangladesh and a Senior Advocate of the Supreme Court of Bangladesh. He is a Barrister-at-Law from Gray’s Inn and holds an LL.B. from the University of Wolverhampton. He has extensive experience in constitutional law, judicial review, public interest litigation, civil and commercial disputes, criminal law and arbitration. He has also contributed to legal and regulatory drafting in Bangladesh, including work relating to electronic commerce and telecommunications law.

Mr Tshering Wangda | Senior Attorney, Office of the Attorney General, Thimphu, Bhutan
Mr Tshering Wangda is a Senior Attorney in the Drafting and Review Division, Department of Legal Service, Office of the Attorney General, Royal Government of Bhutan. He is the senior-most Legislative Drafting Attorney in the Office of the Attorney General and brings 16 years of public service experience.His work focuses on drafting legislation and subsidiary legislation to support the implementation of government policies and legal reforms. Before assuming his current role, he served for 12 years as a government prosecutor and litigator, gaining substantial experience in criminal justice, courtroom advocacy and public law practice. Mr Wangda holds a Bachelor of Science, a Post-Graduate Diploma in National Law, a Bachelor of Laws and a Master of Criminology. His combined experience in legislative drafting, litigation and criminology gives him a practical and well-rounded perspective on law, policy and governance.

Dr Al Qahtani provides legal and regulatory advice across commercial, governance, compliance and dispute matters, while supporting Ooredoo Qatar’s digital transformation. He has over 15 years of experience across telecommunications, financial services, cybersecurity and Islamic finance. He holds a PhD in Islamic Finance and Economics, an LLM from the University of California, Berkeley and an LLB from the University of Liverpool.
