With the shift towards investment chapters in free trade agreements and the introduction of the European Union’s provocative proposed approach to a clear break from the old Investor State Dispute Settlement approach, as seen in the latest developments with the EU-Vietnam Free Trade Agreement and the EU-Canada Comprehensive Economic and Trade Agreement, the investment treaty world is faced with big questions as to what lies ahead.
