Strengthening the Area-Based Management Tools on the High Seas through Shipping-Related Measures

CIL Senior Research Fellow Dr. Trung Nguyen (co-authored with Dr. Dawoon Jung) published a journal article entitled “Strengthening the Area-Based Management Tools on the High Seas through Shipping-Related Measures” at the Ocean Development & International Law Journal. The article examines how shipping-related measures adopted through the International Maritime Organization can support the establishment and implementation of area-based management tools, including marine protected areas, in areas beyond national jurisdiction under the BBNJ Agreement. It argues that while flag States play a primary regulatory role, effective conservation outcomes depend on coordinated action by flag, port, and coastal States in implemeting and monitoring shipping-related measures.
