CIL Research Fellow Trung Nguyen presented his paper at the Conference titled “The Scope of Litigation under the UNCLOS – Where are we now and where may we be going?” at Utrecht on 21 November 2024

Trung’s paper titled “The Interpretation of Jurisdiction by UNCLOS Tribunals: Navigating a Path between Judicial Activism and Judicial Self-restraint” focusing on analysing how the judicial function narrative can help explain the approach of UNCLOS tribunals in interpreting the scope of their juridical jurisdiction. He argues that the seemingly inconsistent tendencies of the UNCLOS tribunals could be a way for them to navigate between their public function role and the limitations to their compulsory jurisdiction under the Convention.
