Dispute settlement provisions |
“Article 12: Any dispute between the CONTRACTING PARTIES arising out of the interpretation or implementation of this Agreement shall be settled amicably through consultation or negotiation.” In accordance with Article 25 of the 2007 Charter of the Association of Southeast Asian Nations which provides that “Where not otherwise specifically provided, appropriate dispute settlement mechanisms, including arbitration, shall be established for disputes which concern the interpretation or application of this Charter and other ASEAN instruments”, and Article 2.1(b) of the 2010 Protocol to the ASEAN Charter on Dispute Settlement Mechanisms, which provides that “This Protocol shall apply to disputes which concern the interpretation or application of other ASEAN instruments unless specific means of settling such disputes have already been provided for.” |

“Article 10: The CONTRACTING PARTIES shall deposit their Instruments of Ratification with the Secretary-General of the ASEAN Secretariat who shall promptly inform each CONTRACTING PARTIES of such deposit. This Agreement shall enter into force on the thirtieth day after the sixth Instrument of Ratification has been deposited.” “Article 11: This Agreement may be terminated as between any two of the CONTRACTING PARTIES by either of the parties giving to the other six months prior written notice of the intended termination.” |

Lao PDR acceded to this Agreement via the 1997 Second Protocol for the Accession of the Lao People’s Democratic Republic to ASEAN Agreements. Myanmar acceded to this Agreement via the 1997 Second Protocol for the Accession of the Union of Myanmar to ASEAN Agreements. Cambodia acceded to this Agreement via the 1999 Protocol for the Accession of the Kingdom of Cambodia to ASEAN Agreements. Viet Nam acceded to this agreement via the 1997 Instrument of Accession. Dates of ratification and accession given above were obtained from the ASEAN Secretariat’s Legal Instruments website and its electronic collection of instruments of ratification and accession.
