Dispute settlement provisions |
Pursuant to Article 15.2 of this instrument, “[t]his Protocol shall form an integral part of the [1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit].” Article 30 of the 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit refers to the consultation and dispute settlement rules and procedures in the 1996 Protocol on Dispute Settlement Mechanism. The 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit and this Protocol 1 are ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. They were previously “Covered Agreements” pursuant to Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix I. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes. |

Article 15.4 ‘Final Provisions’: “This Protocol shall enter into force upon the deposit of Instruments of Ratification or Acceptance by all Contracting Parties with the Secretary-General of ASEAN. Contracting Parties which are unable to comply with the Protocol shall be granted a grace period of two years from the date of signing of the Protocol to work towards compliance.” |
