Dispute settlement provisions

This instrument does not contain provisions for dispute settlement.

In accordance with Article 25 of the 2007 Charter of the Association of Southeast Asian Nations which provides that “Where not otherwise specifically provided, appropriate dispute settlement mechanisms, including arbitration, shall be established for disputes which concern the interpretation or application of this Charter and other ASEAN instruments”, and Article 2.1(b) of the 2010 Protocol to the ASEAN Charter on Dispute Settlement Mechanisms, which provides that “This Protocol shall apply to disputes which concern the interpretation or application of other ASEAN instruments unless specific means of settling such disputes have already been provided for.”

The 2000 Protocol to this instrument (although not this instrument itself)is listed on the ASEAN Legal Instruments page at the time of update. It may therefore be assumed that the modes of dispute settlement provided for the in the 2007 ASEAN Charter would apply to this instrument and its protocol.

This instrument establishes the ASEAN Finance Ministers Meeting and its supporting institutions, its objectives and rules of procedure.

Laos acceded to this instrument via the 1997 Protocol for the Accession of the Lao People’s Democratic Republic to the Ministerial Understanding on ASEAN Cooperation in Finance.

Myanmar acceded to this instrument via the 1997 Protocol for the Accession of the Union of Myanmar to the Ministerial Understanding on ASEAN Cooperation in Finance

Cambodia’s accession to this instrument is mentioned in the 2000 Protocol to Amend the Ministerial Understanding on ASEAN Cooperation in Finance, but a copy of its instrument of accession is not available at the time of update.
