Dispute settlement provisions

Article 21 of the 2004 ASEAN Framework Agreement for the Integration of Priority Sectors:

“The ASEAN Sectoral Integration Protocols attached to this Framework Agreement as Annexes (I) to (XI) and the total product list attached as Annex (XII) shall form an integral part of this Framework Agreement.”

Article 23 of the 2004 ASEAN Framework Agreement for the Integration of Priority Sectors:

“The provisions of the ASEAN Protocol on Enhanced Dispute Settlement Mechanism, done at Vientiane, Lao PDR on the 29th day of November 2004, shall apply to disputes arising under this Framework Agreement.”

This Protocol is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 2004 Protocol applies to all other disputes.

Article 4(2):

“This Protocol shall enter into force 180 (one hundred and eighty) days after the date of its signature. Notwithstanding the specified date of entry into force, Member States undertake to carry out the obligations which arise prior to the date of entry into force of this Protocol in accordance with the timelines indicated in the Framework Agreement for the Integration of Priority Sectors and the Roadmap for Integration of the Logistics Services Sector attached to this Protocol.”

Note Article 3 ‘Appendices’:

“1. The Roadmap for Integration of the Logistics Services Sector shall be annexed hereto as Appendix I and shall form an integral part of this Protocol.

2. Additional measures other than those identified in the Appendix I may be introduced, as and when deemed necessary through an amendment pursuant to paragraph 2 of Article 4 of this Protocol.”
