Dispute settlement provisions

Part VIII ‘Final Clauses’, Article 30 ‘Dispute Settlement’:

“The provisions of the [1996] ASEAN Protocol on Dispute Settlement Mechanism, done at Manila on 20th day of November 1996, shall apply to consultation and the settlement of disputes under this Agreement.”

This Agreement is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. This instrument was previously one of the “Covered Agreements” pursuant to Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix I.

The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes.

This instrument establishes the ASEAN Customs Transit System (ACTS). Under the purview of the ASEAN Transport Ministers, the key Protocols of the AFAFGIT are Protocols 1, 3, 4 and 5, while Protocols 2 and 7 are under the purview of Customs. Singapore, Malaysia and Thailand have agreed to conduct a pilot in order to test the AFAFGIT Protocols in action with industry. For the purpose of the pilot, Protocols 6, 8 and 9 are excluded from operationalization. For more information please see the ASEAN Customs Transit System website.

Cambodia acceded to this Agreement pursuant to the 1999 Protocol for the Accession of the Kingdom of Cambodia to ASEAN Agreements.
