“Article 5: Consultations

1. Any differences between the member States concerning the interpretation or application of this Agreement shall, as far as possible, be settled amicably between the parties.

2. Member States shall accord adequate opportunity for consultations regarding any representations made by other Member States in relation to the differences between them. If such differences cannot be settled amicably, they shall be dealt with by the SEOM and finally by the ASEAN Economic Ministers Meeting.”

A covered agreement in Annex I of the 2004 Protocol on Enhanced Dispute Settlement Mechanism.

The ASEAN Working Group on Intellectual Property Cooperation (AWGIPC) was established in 1996 to implement Article 4 of this agreement.

Note that this agreement is not included in Appendix I: Covered Agreements of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism

The 1997 Protocol to Amend ASEAN Agreements opened this instrument for accession by new member states.

Lao PDR acceded to this Agreement via the 1997 Protocol for the Accession of the Lao People’s Democratic Republic to ASEAN Agreements.

Myanmar acceded to this Agreement via the 1997 Protocol for the Accession of the Union of Myanmar to ASEAN Agreements.

Cambodia acceded to this Agreement via the 1999 Protocol for the Accession of the Kingdom of Cambodia to ASEAN Agreements.
