Dispute settlement provisions |
Pursuant to Article 4.2 of this instrument, “[t]his Protocol shall form an integral part of the Agreement [1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit]. In the event of any inconsistency or conflict, the Agreement shall prevail over the Protocol.” Article 30 of the 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit refers to the consultation and dispute settlement rules and procedures in the 1996 Protocol on Dispute Settlement Mechanism. The 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. . It was previously one of the “Covered Agreements” pursuant to Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix I. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes. |

Article 4.4, ‘Final Provisions’: “This Protocol shall enter into force on the sixtieth day after the deposit of the sixth Instrument of Ratification or Acceptance, and shall become effective only among the Contracting Parties that have ratified or accepted it. For each Contracting Party ratifying or accepting the Protocol after the deposit of the sixth Instrument of Ratification or Acceptance, the Protocol shall enter into force on the sixtieth day after the deposit of such Contracting Party of its Instrument of Ratification or Acceptance.” |
