Note Article 21(2) of the 2004 Protocol on the Enhanced Dispute Settlement Mechanism:
“This Protocol shall replace the 1996 Protocol on DSM and shall not apply to any dispute which has arisen before its entry into force. Such dispute shall continue to be governed by the 1996 Protocol on DSM.”
