Dispute settlement provisions

In accordance with Article 25 of the 2007 Charter of the Association of Southeast Asian Nations which provides that “Where not otherwise specifically provided, appropriate dispute settlement mechanisms, including arbitration, shall be established for disputes which concern the interpretation or application of this Charter and other ASEAN instruments”, and Article 2.1(b) of the 2010 Protocol to the ASEAN Charter on Dispute Settlement Mechanisms, which provides that “This Protocol shall apply to disputes which concern the interpretation or application of other ASEAN instruments unless specific means of settling such disputes have already been provided for.”

Entry into Force / Termination Provisions

“Article 9

1. This Agreement shall enter into force on the date on which the fifth instrument of ratification is deposited with the Ministry of Foreign Affairs of the Republic of Indonesia.

2. In respect of a State acceding to this Agreement after the deposit of the fifth instrument of ratification, this Agreement shall enter into force on the date of deposit by such State of its instrument of accession. If such an instrument of accession is deposited before the Agreement comes into force, it shall enter into force in relation to that State on the date when the Agreement comes into force in accordance with the preceding paragraph of this Article.”
