Dispute settlement provisions |
Pursuant to Article 5.2 of this instrument, “[t]his Protocol shall form an integral part of the [1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit].” Article 30 of the 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit refers to the consultation and dispute settlement rules and procedures in the 1996 Protocol on Dispute Settlement Mechanism. The 1998 ASEAN Framework Agreement on the Facilitation of Goods in Transit and this Protocol 1 are ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. They were previously “Covered Agreements” pursuant to Article 1.1 of the 2004 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix I. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 1996 Protocol applies to all other disputes. |

Article 5.4 ‘Final Provisions’: “This Protocol shall enter into force on the sixtieth day after the deposit of the sixth Instrument of Ratification or Acceptance, and shall become effective only among the Contracting Parties that have ratified or accepted it. For each Contracting Party ratifying or accepting to the Protocol after the deposit of the sixth Instrument of Ratification or Acceptance, the Protocol shall enter into force on the sixtieth day after the deposit of such Contracting Party of its Instrument of Ratification or Acceptance.” |

This Protocol adopts the 1999 Ministerial Understanding on the Development of the ASEAN Highway Network Project pursuant to Article 3.2. Dates of ratification given above were obtained from the ASEAN Secretariat’s Legal Instruments website and its electronic collection of instruments of ratification, accession and notification. Some of the dates given appear to be the dates of execution of the instruments of ratification, rather than their date of receipt by the depository. |
