The 16th session of the CIL Fireside Chat Series, held on 15 January 2016 at the NUS Bukit Timah Campus, examined the Award on Jurisdiction in the Arbitration between the Philippines and China and discussed the implications of the Award on the South China Sea disputes. Hosted by Professor S Jayakumar and Professor Tommy Koh, the Fireside Chat featured two panellists: Mr Rodman Bundy, Director, Eversheds LLP, and Professor Robert Beckman, Director, CIL, who reviewed the recent Award in which it was unanimously decided that the Tribunal had jurisdiction over seven of the Philippines’ submissions while the other submissions will be considered in conjunction with the merits. The panellists discussed the limitations of the Tribunal’s jurisdiction, the implication of China’s non-participation, the rights and participation of third parties, the enforcement of the Award and the differences in procedure between international arbitration and international adjudication in settling disputes.
