Dispute settlement provisions |
Article 21 of the 2004 ASEAN Framework Agreement for the Integration of Priority Sectors: “The ASEAN Sectoral Integration Protocols attached to this Framework Agreement as Annexes (I) to (XI) and the total product list attached as Annex (XII) shall form an integral part of this Framework Agreement.” Article 23 of the 2004 ASEAN Framework Agreement for the Integration of Priority Sectors: “The provisions of the ASEAN Protocol on Enhanced Dispute Settlement Mechanism, done at Vientiane, Lao PDR on the 29th day of November 2004, shall apply to disputes arising under this Framework Agreement.” This Protocol is one of the ‘Covered Agreements’ pursuant to Article 1.1 of the 2019 ASEAN Protocol on Enhanced Dispute Settlement Mechanism read together with its Appendix 1. The 2019 Protocol will only apply with respect to new requests for consultations made on or after its entry into force (20 June 2022). Likewise, the 2004 Protocol will only apply with respect to disputes that arose after its entry into force (29 November 2004). The 2004 Protocol applies to all other disputes. |

Article 3.1 “This Protocol shall enter into force 90 (ninety) days after the date of its signature. Notwithstanding the specified date of entry into force, Member States undertake to carry out the obligations which arise prior to the date of entry into force of this Protocol in accordance with the timelines indicated in the Roadmaps attached to the ASEAN Sectoral Protocols as Appendices.” |

Note Article 1: “The ASEAN Sectoral Integration Protocols for the eleven priority sectors concluded on 29 November 2004 shall be amended by replacing the Appendices and Attachments annexed to each of them by the Appendices and Attachments annexed to this Protocol.” Dates of ratification, notification and approval given above were obtained from the ASEAN Secretariat’s Legal Instruments website and its electronic collection of instruments of ratification, notification and approval. Some of the dates given appear to be the dates of execution of the instruments of ratification/notification/approval, rather than their date of receipt by the depository. |
