Research Associate Chan Sze-Wei judged the inaugural Malaysia Model ASEAN Meeting (MYMAM).

On Human Rights Day, Thursday 10 December 2020, Dr Tan Hsien-Li and Professor Alison Duxbury (University of Melbourne) discussed their co-authored book ‘Can ASEAN Take Human Rights Seriously’.

Dr Tan Hsien-Li spoke at the “Asian Legislative Experts Symposium (ALES) – Legislations on Infectious Diseases and cooperative measures of Asia countries in the post COVID-19 era”.

Co-Director (Teaching) ASEAN Law and Policy Dr Tan Hsien-Li, Research Associate Chan Sze-Wei and Research Assistant Yvette Foo attended the 35th ASEAN Roundtable ‘The COVID-19 Crisis: Impact on ASEAN and the Way Forward’, an online event organised by the Yusof-Ishak Institute for Southeast Asian Studies ASEAN Studies Centre. The programme included sessions on ASEAN’s management of the pandemic and health emergencies in general, and the economic and geopolitical impact on ASEAN.

Assistant Professor Tan Hsien-Li spoke at an international conference organised by Renmin University’s Human Rights Center on ‘Human Rights Protection under Law-based Pandemic Prevention and Control: The Role of Proportionality Principles’ on 20 June.

Assistant Professor Tan spoke on ‘From SARs to COVID-19: Reflections on ASEAN’s Collective Response to Public Health Crises’. Given that proportionality is a firm legal principle that has substantively different meanings in public law and public international law, and that the COVID-19 pandemic is still propelling different facets of governance, political, public health and legal strategies of containment, she discussed whether proportionality was a good tool with which to examine the ongoing phenomenon. Apart from the fact that proportionality has been rejected as a tool of judicial reasoning by some jurisdictions, socio-cultural contexts on law, politics and governance also differ widely on how proportionality might (or might not) be used.

Assistant Professor Tan Hsien-Li represented the CIL at the webinar—‘The Importance of Regional (Legal) Cooperation during Time of Pandemic Covid-19’—organised by the Faculty of Law, Universitas Indonesia on 11 June. She spoke on ‘ASEAN Cooperation in COVID-19’, shedding light on the quick collective regional action that complemented the ongoing national efforts. The long-term support by ASEAN dialogue partners, particularly China, Korea, Japan, the United States and Canada, in regional emergency relief and public health programmes have helped ASEAN react faster to the pandemic. She concluded by outlining ASEAN members’ longer-term plans of building more robust public health programmes, a regional fund and stockpiles, and strategies on economic recovery.

Research Fellow Arron N Honniball gave a presentation on the progress of and challenges to ASEAN’s regional cooperation in maritime safety and security at the Third ASEAN-India Workshop on Blue Economy, held in Bangkok on 12 September 2019. In his presentation, Dr Honniball focussed on the jurisdictional rights and responsibilities of states concerning maritime safety and security as well as the opportunities and necessity of deeper cooperation to help maintain the blue economy.

CIL researchers participated in the Asian Society of International Law conference in Manila on 21–23 August 2019.

At the Junior Scholars’ Conference, Dita Liliansa presented on ‘Protection of Sea Turtles in the Seas of Southeast Asia: An ASEAN Way?’, offering an ongoing investigation on the relationship between ASEAN law, policy and guidelines, and the development of international instruments in the context of the protection of sea turtles in Southeast Asia. Dr Arron Honniball presented on ‘The Role of Nationality Jurisdiction in Combating IUU Fishing: Recent Developments for the Asian Region’, addressing the evolution of the state of nationality in international fisheries law.

The panel on ASEAN Integration and International Law was filled by the CIL’s ASEAN team and chaired by Professor Damian Chalmers, Co-Director (Research) of CIL’s ASEAN Law and Policy Programme. The panellists presented the papers below.

In addition, Professor Antony Anghie, Head of CIL’s Teaching and Researching International Law in Asia, convened a popular workshop on teaching and researching in international law. He also spoke on a book panel by the Oxford University Press and a forum on ‘Junior Scholars’ Guide to the Nuts and Bolts of How to Make It Past Rejection Slips’.

Senior Research Fellow Youna Lyons was invited as a speaker and moderator to the ASEAN Regional Forum Workshop: Implementing UNCLOS and Other International Instruments to Address Emerging Maritime Issues. The workshop included three main themes: traditional security; issues relating to the sustainable management of natural living resources and conservation of the marine environment; and climate change impacts.

Ms Youna Lyons was a moderator on the second theme and presented on the third theme on the topic of international and regional legal and institutional framework applicable to environmental threats in the Asia Pacific, including from climate change and greenhouse gas emissions from shipping. She distinguished legal instruments and regulations applicable to mitigation of greenhouse gas concentration in the atmosphere and in the ocean from those applicable to adaptation from climate change. She also argued that climate change affects all maritime activities. Finally, the presentation of the regional bodies that form the regional institutional framework highlighted the number of bodies concerned with climate change impact and the need for robust cooperation to ensure adequate mitigation and adaptation. CIL Research Assistant JR Robert Real presented his paper entitled ‘Public Welfare and Human Dignity in the Philippines’ at the ALSA 2018 Conference: Law in the Asian Century. Held from 29 November to 1 December 2018 in Gold Coast, Australia, the conference was organised by the Asian Law and Society Association, the Australian Network for Japanese Law (ANJeL), the Asia Pacific Legal Institute of Australia (APLIA), and Bond University. His paper discusses how the Philippine Supreme Court has been using the concept of human dignity to both justify and limit the exercise of the state’s regulatory power, as well as a tool to discover new rights that advance human dignity.

At the 2018 American Society of International Law (ASIL) research forum, Research Associate Melissa Loja presented her paper ‘Recent Engagement with International Human Rights Norms by Courts in Southeast Asia: New Challenges to Human Rights Theories’.

She discussed that in recent cases involving arbitration and judicial immunity, Singapore courts relied on European Convention on Human Rights (ECHR) norms; Malaysia’s Court of Appeal based two decisions on the ASEAN Human Rights Declaration (AHRD), despite lack of legislative incorporation; the Philippine Supreme Court applied the Convention for the Protection of all Persons from Enforced Disappearances (CPPED), which the government had repeatedly refused to ratify; and Indonesia’s Constitutional Court invoked UN human rights instruments to justify the ex post facto prosecution of the past regime for human rights violations.

This engagement with international human rights norms has three distinctive features: 1) preference for ECHR norms over AHRD norms; 2) subversion of the ethos of human rights; and 3) lack of indication that the courts see themselves as agents of an exogenous regional or global normative order.

These distinctive features cannot be adequately explained by the main universalist, pluralist and institutionalist/neo-institutionalist paradigms about international human rights norms and their application by domestic courts. A re-examination of these paradigms is imperative.

Research Assistant JR Robert Real presented his paper entitled ‘National courts collectively creating regional norms in ASEAN’ at the Philippine Society of International Law Inaugural National Conference. Held from 6 to 7 September 2018 in Quezon City, the Philippines, the conference was organised by the Philippine Society of International Law and the University of the Philippines. Mr Real’s paper explored the role of Southeast Asian judiciaries in developing regional environmental norms amid the lack of a regional court.

Senior Research Fellow Denise Cheong and Research Associates Nur Azha Putra and S Nivedita participated in the workshop on ‘Achieving the ASEAN 2025 Vision for Disaster Management: Lessons from a Worthy Journey’ held on 15 and 16 August 2018. The workshop was jointly hosted by S Rajaratnam School of International Studies and the Pacific Disaster Center, in collaboration with the ASEAN Committee on Disaster Management and the ASEAN Coordinating Centre for Humanitarian Assistance on Disaster Management Centre. Discussions centred around the impact, growth and future direction of ASEAN’s regional architecture for humanitarian assistance and disaster relief, and supporting mechanisms.

Research Assistant JR Robert Real presented his paper ‘For the Common Good—The Philippine Supreme Court’s Divergent Approach to Human Dignity’ at the Human Dignity in Asia: Dialogue between Law and Culture Conference. Held from 2 to 3 July 2018 in Taipei, the conference was organised by the Academia Sinica Institutum Iurisprudentiae.

Mr Real’s paper explores the Philippine Supreme Court’s approach to interpreting the concept of human dignity, which seems to vary depending on whether parties invoke individual rights or collective rights.

Research Assistant JR Robert Real presented his paper ‘Judicial Transplantation as a Backdoor to Environmental Normative Integration in ASEAN’ at the 2018 ICON-S Annual Conference on Identity, Security, Democracy: Challenges for Public Law. Held from 25 to 27 June 2018 in Hong Kong, the conference was organised by the International Society of Public Law and the University of Hong Kong.

Mr Real’s paper explored the role of Southeast Asian judiciaries in developing regional environmental norms amid the general sensitivity of the region to international law intruding on domestic sovereignty.

Research Associate Ms Melissa Loja presented her research paper at the New Voices Panel at the 112th Annual Meeting of the American Society of International Law in Washington DC. Ms Loja’s paper was about international agreements between non-state actors. Her paper discussed international agreements that national petroleum corporations such as Petronas, PetroVietnam, PetroleumBrunei and China National Offshore Oil Corporations enter into to manage disputes over petroleum resources that are shared by states across maritime zones and boundaries.

Professor Laurence Helfer, Editor-in-Chief of the American Journal of International Law, remarked that her paper makes a concrete contribution to international law, because it presents primary data that have not been made known before, and it enables a granular examination of actual practices in international law.

CIL Senior Research Fellow Dr Hao Duy Phan was invited to moderate a session in the Consultation on ‘A Rules-Based ASEAN: Legal Instruments and their Implementation’ on 1–2 November 2017 in Singapore. The event was jointly organised by the ASEAN Secretariat and the S Rajaratnam School of International Studies with the support of the ASEAN-US Partnership for Good Governance, Equitable and Sustainable Development, and Gesellschaft für Internationale Zusammenarbeit. CIL Associate Director Ms Sharon Seah Li-Lian, CIL Research Fellow Ms Ranyta Yusran, CIL Research Associate Mr Hadyu Ikrami and CIL Postdoctoral Fellows Dr Heejin Kim and Dr Marija Jovanovic also participated in the consultation.

Assistant Professor Tan Hsien-Li, Co-Director (Teaching) of the ASEAN Law and Policy Programme at CIL, was invited to speak on a panel at the Tembusu Forum ‘ASEAN at 50: Success or a disappointment?’, which was organised by the Tembusu College at NUS on 12 September 2017.

CIL participated in the 6th Biennial Conference of the Asian Society of International Law (AsianSIL) on 25–26 August 2017 in Seoul, Korea. The conference was organised by the AsianSIL, the Korea Chapter of the AsianSIL, and the Ministry of Foreign Affairs of the Republic of Korea. The theme of the conference was ‘Asia and International Law in Times of Uncertainty’. CIL Director Professor Lucy Reed chaired the session on ‘New Proposals for Investment Dispute Resolution Mechanism’. Head of CIL’s Ocean Law and Policy Programme Associate Professor Robert Beckman chaired the session on ‘New Voices in International Law’, which featured presentations from two CIL Research Associates (see below). He also gave a presentation on the implications of the South China Sea arbitral award.

On 16–17 June 2017, CIL Head of Ocean Law and Policy Programme Assoc Prof Robert C Beckman and CIL Research Associate Hadyu Ikrami participated in the Asia-Pacific Ocean Law Institutions Alliance (APOLIA) Conference on ‘Maritime Law Enforcement: Asia-Pacific State Practice’ and the ‘South China Sea Workshop on South China Sea Arbitration and Incidental Maritime Issues’. The conference and workshop took place in Da Nang, Vietnam and were organised by the Diplomatic Academy of Vietnam and The Development of International Law in Asia-Korea (DILA-Korea).

CIL research associates (below) participated in the 14th Asian Law Institute Conference on “A Uniting Force? – ‘Asian Values’ and the Law” on 18–19 May 2017 in Manila, Philippines. The conference was organised by the Asian Law Institute of the National University of Singapore and College of Law at the University of the Philippines. The conference was attended by over 200 legal scholars and practitioners.

CIL Research Associate and Practice Fellow Elsa Sardinha and NUS Faculty of Law Assistant Professor Vincent-Joël Proulx presented a work-in-progress paper entitled ‘Requiem for a Deal, or the End of American Influence in the Investment Chapters of Asia-Relevant FTAs? Can Asian Trade and Investment “Values” Carry the RECP in the Wake of the TPP’s (Potential) Death?’

CIL Research Associate Millicent McCreath presented on ‘Burgeoning Practice of the Establishment of Marine Protected Areas in Southeast Asia to Target the Impacts of International Shipping’.

CIL Research Associate Hadyu Ikrami presented on ‘Indonesia-Malaysia-Philippines Cooperation in Combating Maritime Crimes: Lessons from the Malacca Straits Patrol and the Role of ASEAN’. 

CIL Senior Research Fellow Dr Hao Duy Phan was invited to participate in the 3rd ASEAN-EU High Level Dialogue on Maritime Security Cooperation on 15-16 September 2016 in Bangkok, Thailand. The Dialogue was jointly organised by the Ministry of Foreign Affairs of Thailand and the European Union. CIL Director Robert Beckman made a presentation in Jakarta, Indonesia on 17 March 2016 entitled ‘The Philippines v China Case and the South China Sea Disputes’. The one-day forum was organised by the Center for Southeast Asian Studies (CSEAS) in collaboration with The Netherlands Embassy in Jakarta, and was entitled ‘ASEAN Dialogue on International Law: Strengthening the Rule of Law in the Region on International Law of the Sea’. IELPO LL.M Programme at Universitat de Barcelona re-invited CIL for the 4th time to teach its course on Asian Regionalism. CIL Research Fellow Junianto James Losari replaced Associate Professor Michael Ewing-Chow this year to teach the two-day-course on 9-10 March 2016 in Barcelona, Spain. In his course, James shared various stories of integration in Asia and discussed the main drivers of the integration, including trade and investment. He also focused on the ASEAN integration, which is considered as one of the most advanced integrations in the region.

CIL Research Fellow Ms Ranyta Yusran participated in the AsianSIL Regional Conference – ‘International Law and a Dynamic Asia’ on 14-15 June 2016 in Hanoi, Viet Nam. The Conference was jointly organised by AsianSIL, the Diplomatic Academy of Viet Nam and the Ministry of Foreign Affairs of Viet Nam. At the Conference, Ranyta presented her paper on ‘The ASEAN Convention against Trafficking in Persons, Especially in Women and Children: Is It Up to the Task?’ in a panel on ‘ASEAN after 2015’, chaired by the dean of the NUS Law Faculty. CIL Research Fellow Ranyta Yusran and CIL Research Associates Shaun Kang and Elsa Sardinha participated in the 13th Annual Asian Law Institute Conference – ‘Asian Perspectives on Legal Globalisation’ on 19-20 May 2016 in Beijing, China. On 18 May 2016, CIL Research Associate Hadyu Ikrami participated in the International Seminar on the Establishment of a Regional Convention against Illegal, Unreported, and Unregulated Fishing (IUUF) and Its Related Crimes. The Seminar took place in Bali, Indonesia, and was organised by the Indonesian Coordinating Ministry for Maritime Affairs. It was attended by approximately 120 participants from 13 countries. The speakers of the Seminar were representatives of the Food and Agriculture Organization (FAO), United Nations Office on Drugs and Crime (UNODC), European Union (EU), Sub-Regional Fisheries Commission (SRFC) of the West African Countries, as well as representatives of the governments of Thailand, Australia, the Philippines and the United States. Another speaker was a New Zealander official who delivered a presentation on how Interpol has assisted New Zealand in combatting IUU fishing.

CIL Senior Research Fellow Dr Tan Hsien-Li presented a paper and presentation on ‘The Legalization and Institutionalization of ASEAN: Conceptualizing a New Pattern in Asian Regionalism’ at a workshop on Regional and Constitutional Structures in Tension, which was held at the University of Geneva, Switzerland, from 4-5 April 2016. The workshop was organised by the University of Geneva, Global Studies Institute (supported by the Swiss National Science Foundation), iCourts of the University of Copenhagen, and the Institute for Global Law and Policy at Harvard Law School.

Following the 16th Meeting of the ASEAN Working Group on the Coastal and Marine Environment (AWGCME), CIL Director Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Youna Lyons were invited to address members of the AWGCME, together with invited representatives of Singapore government agencies, at a seminar held on 10 June 2015 in Singapore, on issues under UNCLOS and other international legal frameworks governing the protection of the coastal and marine environment. CIL Senior Research Fellow Dr Tan Hsien-Li presented a paper and presentation on ‘Reputational Risks in the Post-Charter ASEAN: Rules-based Reformation or Rhetorical Repetition’ at a symposium organised by the New Zealand Centre for Public Law and the International Law Association (New Zealand Branch), on International Organisations and the Rule of Law: Perils and Promise, which was held at the Victoria University of Wellington Faculty of Law from 7-8 December 2015.

CIL Research Fellow Junianto James Losari was invited to speak at the Asia FDI Forum on 5-6 November 2015 in Hong Kong. James presented his paper “Searching for An Ideal Investment Protection Regime for ASEAN+ Dialogue Partners in RCEP: Where Do We Begin?” in which he discussed the baseline study and the method he used to better advise Regional Comprehensive Economic Partnership (RCEP) negotiators in the negotiation of the RCEP’s investment chapter. The Forum was jointly organised by the Centre for Financial Regulation and the Economic Development and Columbia Center on Sustainable Investment (Columbia University) and sponsored by Oxfam Hong Kong and the Chinese University of Hong Kong (Faculty of Law). CIL Research Fellow Junianto James Losari was invited to speak at the Art of Negotiating Trade and Investment Agreements Workshop: Taking Into Account the Global Tobacco Treaty. The workshop was held in Chiang Mai, Thailand on 25-26 June 2015. It was attended by academics and government officials from the Ministry of Health in the region. James spoke about the ‘Investment Framework from the ASEAN Perspective’ and its implication on tobacco control measures taken by ASEAN Members. He highlighted the importance of ASEAN Members to terminate their intra-ASEAN BITs, which do not provide enough policy space for States to take tobacco control measures without incurring liability. On the other hand, the newer generation International Investment Agreements, such as the ASEAN Comprehensive Investment Agreement and other ASEAN + Dialogue Partner(s) Investment Agreements contain general exceptions clauses that allow States to take measures to protect its public health, including tobacco control measures without incurring any liability. However, ASEAN Members must carefully formulate their measures to fulfil the requirements of such clauses.

On 3-5 June 2015, the Asian Society of International Law (AsianSIL), together with the Ministry of Justice of Thailand and the Thailand Institute of Justice, held the AsianSIL Inter-Sessional Conference on ‘The Rule of Law and Development Nexus: A New Deal for Asia?’ in Bangkok, Thailand. A/P Michael Ewing-Chow was invited to speak on a panel on ‘International Law and ASEAN Integration’ and delivered his presentation entitled ‘Outcomes and Costs – Towards A Just Peace’. CIL Researchers Leonardo Bernard, Harpreet Kaur Dillon, Hao Duy Phan, Sun Zhen and Ranyta Yusran participated in the 12th Annual Asian Law Institute Conference – “Law 2.0: New Challenges in Asia” on 21-22 May 2015 in Taipei, Taiwan. The Conference was jointly organised by the National University of Taiwan and the Asian Law Institute. At the Conference, CIL researchers made various presentations on different topics of international law and chaired different panels. Dr Zhen Sun and Mr Leonardo Bernard spoke at a panel on international law with a particular focus on the law of the sea. Dr Zhen Sun made a presentation on “A Hot Land in A Cold Place: Opportunities and Challenges for Singapore in the Arctic” (download in PDF) and Mr Leonardo Bernard made a presentation on “Historic Fishing Rights and the EEZ” (download in PDF). Dr Hao Duy Phan and Ms Harpreet Dhillon participated in two different panels on international law and spoke about “ASEAN’s Legal Personality and its Treaty-Making Power” (download in PDF) and “Consolidation of Claims Arising under an International Investment Agreement: What is at Stake?” (download in PDF) respectively. CIL Research Fellow Junianto James Losari was invited by the Economic Research Institute for ASEAN and East Asia to present his research on the investment chapters in various ASEAN + Dialogue Partners Free Trade Agreements (FTAs) in the 1st Workshop on the Regional Comprehensive Economic Partnership (RCEP) which was held on 20-21st May 2015 in Tokyo, Japan. The Workshop was attended by scholars (mostly economists) from various universities in Japan, South Korea, Indonesia, Singapore, and the Philippines. James presented his paper titled, ‘Searching for an Ideal International Investment Protection Regime for ASEAN + Dialogue Partners (RCEP): Where do we Begin?’ The paper conducted a baseline study of various provisions contained in various BITs, regional investment agreements and investment chapters of FTAs among ASEAN and its Dialogue Partners. He also proposed that RCEP should be used as an opportunity to consolidate the existing investment agreements to solve parallelism caused by the spaghetti bowl phenomenon of investment agreements among the negotiating parties. The Workshop is expected to produce a report for RCEP negotiators that can support the negotiating process.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to speak at the ASEAN Comprehensive Investment Agreement (ACIA) Forum on “Transforming Investment in ASEAN through ACIA”, which was held on 15 April 2015 in Jakarta, Indonesia. He shared his views about how ASEAN could be transformed into an investment hub by the ACIA and the potential benefits of ACIA to Indonesia. He also chaired a session on “The experience of the Indonesian and Third-Country Businesses in Investing in ASEAN”. The speakers of the session included Indonesian business leaders from Indofood, Semen Indonesia and XL Axiata, as well as Mr Rizar Indomo Nazaroedin, Director of Regional Cooperation of the Indonesian Investment Coordination Board (BKPM).

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to train Indonesian government officials during a two-day seminar (15-16 April 2015) on the ASEAN Comprehensive Investment Agreement (ACIA). The theme of the seminar was how ACIA could be used to attract investments to Indonesia.

CIL Director Professor Robert Beckman was invited to speak in a panel discussion on “ASEAN Integration: An Economic Community in 2015?” organised by the Asia Foundation in Washington DC on 8 April 2015. The other two speakers on the panel were Edmund W. Sim, CIL Global Associate, Partner, Appleton Luff and Natalie Y. Morris-Sharma, Counsellor, Permanent Mission of Singapore to the UN, who presented the books that they co-authored in the CIL ASEAN Integration Through Law (ASEAN ITL) Series published by Cambridge University Press: The Foundation of the ASEAN Economic Community – An Institutional and Legal Profile by Stefano Inama and Edmund W. Sim and From Treaty-Making to Treaty-Breaking – Models for ASEAN External Trade Agreements.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited to speak on “The ASEAN Way to Interpret Integration” at the Asian Legal Business ASEAN Integration Summit on 26 March 2015 in Singapore.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by IELPO LL.M Programme to teach the course of Regionalism in Asia. The course, which was held on 12-13 March 2015, engaged the students in interactive discussions on Asia’s experience in economic integration, particularly the Southeast Asian States within the ASEAN.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by Universidad Sergio Arboleda in Colombia to teach in its Madrid campus. The course was attended by Colombian students as part of their course in Masters in International Commerce. The intensive course, which was held on 4-6 March 2015, discussed various aspects of ASEAN Integration and how it contributed to the improvement of the rule of law in the region.

CIL Research Fellow Ms Ranyta Yusran was invited to participate in the Second Conference on the ‘Historical Origin of International Criminal Law’ (HOICL) in New Delhi, India on 29-30 November 2014. Ms Yusran presented a paper that she was invited to contribute entitled ‘Transitional Justice Delayed or Denied? A Case Study of Southeast Asia and Indonesia’. The Conference was organised by the Centre for International Law Research and Policy (CILRAP), the European University Institute and Peking University. CIL Head of Trade Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Ranyta Yusran participated in the Legitimacy of International Trade Tribunals Meeting in Geneva on 17-18 October 2014, where they presented their paper on the ASEAN trade dispute settlement mechanism. The meeting was organised by PluriCourts of University of Oslo, Norway as the first editorial meeting for a book on international trade tribunals. CIL Research Associate Junianto James Losari was invited to speak about the ASEAN Comprehensive Investment Agreement (ACIA) before representatives of various ministries of the Republic of Myanmar as part of a capacity building seminar on investment organised by the Economic Research Institute for ASEAN and East Asia and the Ministry of National Planning and Economic Development (NPED). More than 50 government officials attended this seminar, which was held on 27 September 2014 at Hotel Sedona in Yangon. In his presentation, James emphasised the importance of improving governance and the rule of law in the country, as well as ensuring that Myanmar’s new regulations and policies comply with the ACIA in order to minimise the costly risks of litigation. CIL Research Fellow Ranyta Yusran participated in the 2014 International Law Association (ILA) Regional Conference on ‘Towards a Universal Justice? Putting International Courts and Jurisdiction into Perspective’ at the Lisbon University Law School, Portugal, from 11-12 September 2014. Ms Yusran presented a paper that she co-authored with CIL Head of Trade Law and Policy Associate Professor Michael Ewing-Chow entitled ‘If You Build It, They Still Will Not Come: ASEAN Dispute Settlement and Intra-ASEAN Disputes’ in Session 4 of the Conference concerning Dispute Settlement. The Conference was organised by the Lisbon University Law School and the Portuguese branch of the ILA and was attended by legal academics and practitioners from all over Europe. CIL Senior Research Fellow Dr. Hao Duy Phan was invited to speak at the ASEAN Regional Workshop on “The Promulgation of Laws and Regulations of ASEAN Member States: A Comparative Study” on 23-24 April 2014 in Jakarta, Indonesia. Professor Joseph Weiler, Director of the CIL ASEAN Integration Through Law Project (President of the European University Institute; NUS Law School; and University Professor at the NYU School of Law (on-leave)) convened and chaired the discussions on the ASEAN Economic Community at Plenary 4 of the ASEAN Integration Through Law Project: The ASEAN Economic Community at the Sofitel Plaza Hotel, Hanoi, Vietnam. CIL Director Robert Beckman made a presentation titled “Role of ASEAN and the Philippines v China Case” on 4 April 2013 at the 107th Annual Meeting of the American Society of International Law in Washington DC. Prof Beckman served on a Panel on Legal Solutions to Maritime Disputes in Asia, and he spoke about the South China Sea Disputes. The other members of the panel were Rosalyn Higgins, past President of the International Court of Justice; Loretta Malintoppi, Eversheds LLP Paris; and Galo Carrera Hurtado, Member of the Commission on the Limits of the Continental Shelf. CIL researchers participated in the 4th Biennial Conference of the Asian Society of International Law in New Delhi, India on 14-16 November 2013. They presented their papers in a panel titled “ASEAN: the Good, the Bad and the Ugly”. On 22 – 25 October 2013, CIL Research Associates Mr. Junianto James LOSARI and Ms. Ranyta YUSRAN attended the 2013 Padjdjaran International Legal Conference Series, “Regional Perspectives on Law and Human Rights: Where are we not and where are we heading?” in Bandung, West Java, Indonesia. The Conference was organised by the Law Faculty of Padjadjaran University and opened by the Dean of Universitas Padjadjaran. CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her expertise on ASEAN regional integration as part of the Singapore contingent led by Professor Tommy Koh at the 8th China-Singapore Forum held in Beijing, China. The meeting was comprised of senior officials and representatives from both countries at which they shared their nation-building experiences on such topics as urban growth, housing, income gaps, economic cooperation and wider regional cooperation initiatives.

CIL Senior Research Fellow Dr Tan Hsien-Li participated in the CIL Fireside Chat on ASEAN and Human Rights, chaired by Professor S Jayakumar and Professor Tommy Koh. CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her work on human rights in ASEAN at the Human Rights Colloquium held at the University of Geneva, Switzerland. CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her expertise at the Regional Track Two Meeting “ASEAN Human Rights Mechanisms: Challenges and Ways Forward” and engage with officials from the ASEAN Intergovernmental Commission on Human Rights (AICHR), ASEAN Commission for the Promotion and Protection of the Rights of Women and Children (ACWC) and ASEAN Committee on the Implementation of the ASEAN Declaration on the Promotion and Protection of Migrant Workers (ACMW). This meeting was hosted by the Thai Ministry of Foreign Affairs and the Working Group for an ASEAN Human Rights Mechanism and was held in Bangkok, Thailand.

CIL Research Fellow Dr Hao Duy Phan and CIL Research Associate Junianto James Losari participated at the 10th Annual Asian Law Institute Conference – “Celebrating Diversity: 10 Years of ASLI” on 23-24 May 2013 in Bangalore, India. The Conference was jointly organized by the Asian Law Institute and the National Law School of India University. Dr Hao Duy Phan opened the first panel on International and Transnational Regulation by discussing the Protocol to the ASEAN Charter on Dispute Settlement Mechanisms and its significance in further institutionalizing ASEAN into a rules-based regional organization. Junianto James Losari presented a paper by Dr. Lin Lin and Prof. Michael Ewing-Chow on “The Doing Business Indicators in Singapore: Only that Which is Measured is Measured” at the Panel on Business Law which discussed about the significance of the Doing Business Project of the World Bank in influencing the Company Law reforms in Singapore. In April 2013, the Human Rights Resource Centre (HRRC), an Indonesian-based research institution, published two baseline studies to which CIL Research Fellow and Associate contributed as Country Rapporteurs. Dr. Hao Duy PHAN is the Country Rapporteur for Viet Nam in HRRC’s Baseline Study on “Business and Human Rights in ASEAN”; the Baseline Study was recently launched in Jakarta, Indonesia, on 9 April 2013. Ms. Ranyta YUSRAN contributed to HRRC’s Baseline Study on “Violence, Exploitation, and Abuse and Discrimination in Migration Affecting Women and Children in ASEAN” as the Country Rapporteur for Indonesia; due to the wide scope of the Study, the Baseline Study is only published a year after its launch on 30 May 2012. CIL Fellows and Research Associate have been involved constantly as Country Rapporteurs in HRRC’s Baseline Study series since 2011. CIL Research Fellow Hao Duy Phan was a presenter at the Conference on Business and Human Rights in ASEAN in Jakarta, Indonesia on April 9, 2013. The Conference was a major event organized by the Human Rights Resource Centre for ASEAN to launch a baseline study that examines the legal framework of ASEAN member states in response to business and human rights issues. The outcome of the study is a book published and distributed on the occasion of the Conference. Dr. Phan participated as a rapporteur of the Vietnam Country Report chapter. CIL sponsored a Panel at the 107th Annual Meeting of the American Society of International Law (ASIL) in Washington DC on 5 April 2013, titled “Challenges for ASEAN: The South China Sea, Investment Protection and Myanmar”. Prof Michael Ewing-Chow opened the Panel with discussion on ASEAN legalization, institutionalization and economic law issues facing ASEAN, followed by Ambassador Arif Havas Oegroseno who talked about ASEAN and the South China Sea disputes. CIL’s Research Fellow Tara Davenport then talked about the approach of ASEAN Member States in negotiating and settling maritime boundaries (download her presentation in PDF format). Finally, CIL’s Senior Research Fellow Dr Tan Hsien-Li closed the Panel with a discussion of ASEAN’s approach to the human rights situation in Myanmar. A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited to teach at the University of Barcelona’s IELPO LLM Programme. He taught “Asian Regionalism” and suggested that the production network, the ASEAN hub and legalization were essential elements of the development of Asian Regionalism.

CIL Senior Research Fellow Dr Tan Hsien-Li presented her paper on “Legal Integration in the ASEAN Community” at the Congreso Internacional Sobre Globalizacion Juridica, Derecho Supranacional E Integracion Americana (International Conference on Globalization, Supranational Law and Legal Integration of the Americas) at the Escuela Libre de Derecho in Mexico City, Mexico.

CIL Director Robert Beckman made a presentation on 24 October 2012 at the Workshop on ASEAN Enhanced Dispute Settlement Mechanisms at the ASEAN Secretariat in Jakarta. CIL Research Associate Ranyta Yusran participated in the 2nd Meeting on Violence, Exploitation, and Migration Affecting Women and Children in ASEAN held in Kuala Lumpur, Malaysia. The Meeting was held by the Human Rights Resource Centre. Ms Yusran is appointed to be the Country Rapporteur to conduct a baseline survey on issues of violence, exploitation, and migration affecting women and children in Indonesia. The baseline survey initiative receives positive support from members of the ASEAN Commission for the Promotion and Protection of the Rights of Women and Children (ACWC) and is intended to be used to assist the work of ACWC. The baseline surveys of all 10 ASEAN Member Countries are expected to be completed in April 2012 and launched in May 2012.

CIL Senior Research Fellow Dr Tan Hsien-Li’s paper, co-written with CIL Research Associate Ranyta Yusran, on “Post-Conflict Justice in Southeast Asia: the Limited Impact of the Rome Statute on Indonesia and in the Region” was presented by Ms Yusran at the Conference on “Post Conflict Justice: Assessing the Impact of the Rome Statute” held at Leiden University in The Hague.

CIL Director Robert Beckman participated at a conference organized by the ASEAN Studies Centre (ASC) of the Institute of Southeast Asian Studies (ISEAS) on “Entering Uncharted Waters?: ASEAN and the South China Sea Dispute”. The main objective of the one-day conference was to discuss on how ASEAN, as an organization, should be handling the South China Sea dispute and through what channels and mechanisms. CIL Research Associate Leonardo Bernard participated in the 2nd Indonesian Centre for International Law Studies (CILS) Conference 2011 on ‘The ASEAN’s Role in Sustainable Development’ in Yogyakarta, Indonesia. The Conference was jointly organized by the Law Faculties of University of Indonesia and University of Gajah Mada. Mr Bernard was one of the Speakers in a Panel that focus on delimitation in the North Malacca Strait, where he talked about the legal history of the continental shelf and EEZ, as well as possible legal solution for delimitation between Indonesia and Malaysia in the North Malacca Strait. A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law & Policy Programme was invited by the ASEAN Studies Centre to participate in the 3rd Train-the-Trainers Course on the ASEAN Charter as the legal expert. CIL Senior Research Fellow Dr Tan Hsien-Li presented her paper on “The ASEAN Intergovernmental Commission on Human Rights and Soft Law: Broadening the Reach of Regional Human Rights Protections” at the Third Biennial Conference of the Asian Society of International Law held in Beijing, China.

CIL Director Robert Beckman gave two presentations at the ASEAN Workshop on UNCLOS and Marine Biodiversity Conservation at Fort Canning Park, Singapore. The conference was organized by the National Parks Board of Singapore. Prof Beckman’s presentations were on “International Legal Frameworks on Marine Biodiversity” and “Marine Protected Areas and the Protection of Marine Biodiversity”.
