CIL Research Fellow Ms Ranyta Yusran participated in the AsianSIL Regional Conference – ‘International Law and a Dynamic Asia’ on 14-15 June 2016 in Hanoi, Viet Nam. The Conference was jointly organised by AsianSIL, the Diplomatic Academy of Viet Nam and the Ministry of Foreign Affairs of Viet Nam. At the Conference, Ranyta presented her paper on ‘The ASEAN Convention against Trafficking in Persons, Especially in Women and Children: Is It Up to the Task?’ in a panel on ‘ASEAN after 2015’, chaired by the dean of the NUS Law Faculty. Within the same panel, Asst Prof Tan Hsien-Li, CIL’s ASEAN Integration through Law Director, also presented her paper on ‘The ASEAN Community: Its Ambitions, Laws and Dispute Settlement Mechanisms’. CIL Director Professor Robert Beckman was invited to participate in the EU-DAV High-Level Workshop: Maritime Security and Development: International Cooperation and European – Asian Experience Sharing, which was held on 8-9 June 2016 in Ha Long, Vietnam. The Workshop was jointly organised by the Diplomatic Academy of Vietnam and the European Union. Prof Beckman was unable to attend, but his PowerPoint presentation was distributed to participants and presented by another speaker. His presentation was entitled ‘UNCLOS Dispute Settlement Regime & Philippines v China Arbitration’. He has submitted a draft paper to the organisers on the same topic. CIL Director Robert Beckman attended the 2016 IISS Shangri-La Dialogue, the 15th annual Asia Security Summit, organised by the International Institute for Security Studies, which was held at the Shangri-La Hotel in Singapore from 3-5 June 2016. Prof Beckman participated in a panel discussion on ‘Managing South China Sea Tensions’, together with defence officials from China, Vietnam and the European Union.

CIL Director Robert Beckman and CIL Non-Resident Fellow Captain J Ashley Roach participated in the Expanded ASEAN Maritime Forum Workshop on Maritime Boundaries, which was held at the Hanoi Hilton Opera Hotel in Hanoi, Vietnam from 31 May to 3 June 2016. The full title of the Workshop was the EAMF International Law and Best Practices in Maritime Boundary Delimitation and Provisional Arrangements of a Practical Nature. The Workshop was organised by the Diplomatic Academy of Vietnam (DAV) and the US Department of State. CIL and the Australian Centre for Ocean Resources and Security (ANCORS) were supporting organisations. Prof Beckman and Captain Roach each made two presentations at the Workshop. CIL Research Associate Christine Sim attended the Workshop as an observer.

CIL Research Fellow Ranyta Yusran and CIL Research Associates Shaun Kang and Elsa Sardinha participated in the 13th Annual Asian Law Institute Conference – ‘Asian Perspectives on Legal Globalisation’ on 19-20 May 2016 in Beijing, China. The Conference was jointly organised by Peking University and the Asian Law Institute. At the Conference, Ranyta Yusran spoke at a panel on ‘International Law and Human Rights’ and delivered a presentation entitled ‘No Longer Taboo and Yet Still Awkward: Human Rights in ASEAN’. CIL Senior Research Fellow Dr. Hao Duy Phan was invited to speak at an international conference on ‘Maritime Boundaries and the Law of the Sea’ on 19 May 2016 in Dili, Timor-Leste. Hao Duy Phan delivered a presentation on ‘UNCLOS Dispute Settlement Mechanisms and the Timor Sea’. The Conference was organised by the Government of Timor-Leste. On 18 May 2016, CIL Research Associate Hadyu Ikrami participated in the International Seminar on the Establishment of a Regional Convention against Illegal, Unreported, and Unregulated Fishing (IUUF) and Its Related Crimes. The Seminar took place in Bali, Indonesia, and was organised by the Indonesian Coordinating Ministry for Maritime Affairs. It was attended by approximately 120 participants from 13 countries. The speakers of the Seminar were representatives of the Food and Agriculture Organization (FAO), United Nations Office on Drugs and Crime (UNODC), European Union (EU), Sub-Regional Fisheries Commission (SRFC) of the West African Countries, as well as representatives of the governments of Thailand, Australia, the Philippines and the United States. Another speaker was a New Zealander official who delivered a presentation on how Interpol has assisted New Zealand in combatting IUU fishing.

CIL Director Robert Beckman participated in the 11th Japan-Singapore Symposium, which was held in Tokyo, Japan on 25-26 April 2016. Prof Beckman made a presentation on ‘Security Outlook in the Asia-Pacific: Roles of Maritime Nations’.

CIL Research Fellow Dr Zhen Sun and Research Assistant Anjali Sugadev participated in the DEHUKAM International Workshop – “Legal Status of Submarine Cables, Pipelines and ABNJ” on 7-8 April 2016 in Ankara, Turkey. The Conference was jointly organized by the Ankara University Research Center of the Sea and Maritime Law, Center for Oceans Law and Policy, University of Virginia and the International Cable Protection Committee. CIL Senior Research Fellow Youna Lyons was invited by the Department of Foreign Affairs of the Philippines as a resource speaker at the 8th ASEAN Regional Forum Inter-sessional Meeting on Maritime Security, held 6-7 April 2016, in Makati City, Philippines. CIL Senior Research Fellow Dr Tan Hsien-Li presented a paper and presentation on ‘The Legalization and Institutionalization of ASEAN: Conceptualizing a New Pattern in Asian Regionalism’ at a workshop on Regional and Constitutional Structures in Tension, which was held at the University of Geneva, Switzerland, from 4-5 April 2016. The workshop was organised by the University of Geneva, Global Studies Institute (supported by the Swiss National Science Foundation), iCourts of the University of Copenhagen, and the Institute for Global Law and Policy at Harvard Law School.

CIL Senior Research Fellow Youna Lyons was invited by the Council for Security Cooperation in the Asia Pacific (CSCAP) – Singapore to participate in the 1st Meeting of the CSCAP Study Group on Marine Environmental Protection, which was held on 3-5 April 2016 at the Marco Polo Ortigas Hotel in Manila, Philippines. CIL Senior Research Fellow Dr Hao Duy Phan was invited to participate in the International Workshop entitled ‘Cultural Heritage Law and the Built Environment: Preserving Outstanding Universal Value in Asia’s Historic Cities’ on 17-18 March 2016 in Singapore. The Workshop was organised by the Centre for Asian Legal Studies, National University of Singapore. Hao Duy Phan moderated the session on ‘Global Trends in Urban Heritage Conservation’.

CIL Research Fellow Junianto James Losari taught an International Investment Law course in the Masters Programme on Trade, Investment, and Competition at the Universitas Pelita Harapan, Indonesia, which was held on 23-26 February 2016 in Jakarta, Indonesia. In his lecture, James provided an overview of international investment law with some specific discussions on Indonesia’s recent investment policies. On Monday, 22 February 2016, CIL Research Fellow Junianto James Losari was the guest lecturer at a workshop to advise Indonesian government officials from the Ministry of Trade, the Indonesian Investment Coordinating Board, the Central Bank of Indonesia, and various other institutions on cross-cutting issues between Trade in Services and Investment. The workshop was organised by the Ministry of Trade’s Centre for Advocacy and the EU-Indonesia Trade Cooperation Facility at the Ministry of Trade in Jakarta, Indonesia. In his lecture, James highlighted the need for Indonesian government officials to clarify their policy objectives both in trade and investment before the process of negotiating or drafting free trade agreements (FTAs). Furthermore, he noted the potential overlap of commitments made under trade in services chapter and investment chapters in FTAs that requires different institutions to cooperate and coordinate closely to prevent inconsistency. CIL Director Robert Beckman participated in a conference hosted by the National Institute for South China Sea Studies (NISCSS) in Hainan, China from 17-19 January 2016. The conference was the Second Conference on the Partnership for Regional Peace: Operationalising ASEAN-China Comprehensive Strategic Partnership in Southeast Asia under a project headed by the Centre for Strategic and International Studies (CSIS), Indonesia and the NISCSS to try to find a resolution to the issues in the South China Sea. Prof Beckman served as the Co-Chair of the Working Group on Legal Principles, one of four working groups established under the project.

Following the 16th Meeting of the ASEAN Working Group on the Coastal and Marine Environment (AWGCME), CIL Director Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Youna Lyons were invited to address members of the AWGCME, together with invited representatives of Singapore government agencies, at a seminar held on 10 June 2015 in Singapore, on issues under UNCLOS and other international legal frameworks governing the protection of the coastal and marine environment. CIL Senior Research Fellow Dr Tan Hsien-Li presented a paper and presentation on ‘Reputational Risks in the Post-Charter ASEAN: Rules-based Reformation or Rhetorical Repetition’ at a symposium organised by the New Zealand Centre for Public Law and the International Law Association (New Zealand Branch), on International Organisations and the Rule of Law: Perils and Promise, which was held at the Victoria University of Wellington Faculty of Law from 7-8 December 2015.

CIL Senior Non-Resident Fellow, retired Navy Captain J. Ashley Roach addressed the ASEAN Regional Forum (ARF) on Regional Confidence Building and the Law of the Sea, which was held in Tokyo, Japan on 4 December 2015, and convened by the Division of Maritime Security of the Japanese Foreign Ministry. The seminar was co-chaired by Japan, Vietnam and India. Captain Roach suggested that the ARF members review carefully the Award on the Merits in the Philippine-PRC arbitration expected by mid-June 2016, and the Final Report of the International Law Association’s (ILA) Committee on Baselines under the International Law of the Sea (chaired by Captain Roach) expected to be adopted at the ILA’s biennial conference in August 2016. He suggested the documents be reviewed in light of the ARF members’ maritime claims that are inconsistent with the Law of the Sea Convention.

CIL Research Fellow Zhen Sun participated in the 5th AsianSIL Biennial Conference – “International Law and the Changing Economic & Political Landscape in Asia” on 26-27 November 2015 in Bangkok, Thailand. The Conference was organised by the Asian Society of International Law. CIL Research Fellow Junianto James Losari was invited to speak at the Asia FDI Forum on 5-6 November 2015 in Hong Kong. James presented his paper “Searching for An Ideal Investment Protection Regime for ASEAN+ Dialogue Partners in RCEP: Where Do We Begin?” in which he discussed the baseline study and the method he used to better advise Regional Comprehensive Economic Partnership (RCEP) negotiators in the negotiation of the RCEP’s investment chapter. The Forum was jointly organised by the Centre for Financial Regulation and the Economic Development and Columbia Center on Sustainable Investment (Columbia University) and sponsored by Oxfam Hong Kong and the Chinese University of Hong Kong (Faculty of Law). CIL Senior Principal Research Fellow J. Christopher Thomas, QC delivered the keynote address on ‘The New Era of Investment Treaty-Making’ to open the 4th Asia Pacific ADR Conference in Seoul, Korea on 3 November 2015. The Conference was jointly sponsored by the Korean Ministry of Justice, UNCITRAL, the KCAB, and the ICC.

CIL Research Fellow Junianto James Losari attended the Southeast Asia Law Scholars Colloquium held by Universitas Indonesia in Jakarta, Indonesia on 22 October 2015. James presented a paper that he co-wrote with A/P Michael Ewing-Chow titled “Multiple Authorisation: The Complexity of Desentralisasi in Indonesia and the Potential Contribution of IIAs in Resolving Confusion”. James discussed the problems posed by the desentralisasi system on foreign investors in Indonesia. Subsequently, he suggested ways to alleviate the problems by utilising Indonesia’s existing IIAs to discipline the regional governments. To view his presentation, click here.

CIL Senior Research Fellow Youna Lyons attended the 8th ABLOS Conference 2015 in Monaco – UNCLOS: Advances in Managing the Blue World. CIL Research Fellow Denise Cheong participated in the Nuclear Energy Experts Group (NEEG) organised by the Council for Security Cooperation in the Asia Pacific (CSCAP) and held in Singapore on 15-16 October 2015.

CIL Senior Research Fellow Youna Lyons attended the 37th Consultative Meeting of Contracting Parties to the 1972 London Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter and the 10th Meeting of Contracting Parties to the 1996 London Protocol to the London Convention at the IMO, in London, from 11-15 October 2015.

CIL Research Associate Mark Huber attended the Centre for International Dispute Settlement’s International Conference on “International Dispute Settlement on the Crossroads of Public and Private International Law”, in Geneva, Switzerland on 25 September 2015. The conference discussed the public and private paradigms in investment treaty arbitration, the intersection between the trade and investment regimes, and conflicts, coordination and international responsibility in international arbitration and domestic litigation.

CIL Research Associate Mark Huber attended the British Institute of International and Comparative Law Investment Treaty Forum’s Twenty-fifth ITF Public Conference, “The ICSID Convention at 50”, in London, England on 18 September 2015. This meeting of the Investment Treaty Forum, organised in partnership with the ICSID Secretariat, discussed the history of the ICSID Convention, the legal issues raised in its interpretation and application, and its continuing role in the investment treaty regime.

CIL Non-Resident Fellow Captain J Ashley Roach and CIL Research Fellow Zhen Sun participated in the Arctic Deeply Roundtable Discussion on ‘Asia and the Arctic: Where Things Stand’ on 16 September 2015 in Singapore. The Roundtable was jointly organised by Arctic Deeply and the World Policy Institute, in collaboration with Guggenheim Partners and the Lee Kuan Yew School of Public Policy, NUS. CIL Director Robert Beckman participated in a conference on the South China Sea in Jakarta, Indonesia from 14-16 September 2015. The Conference was co-organised by the Centre of Strategic and International Studies (CSIS) Indonesia and the National Institute for South China Sea Studies (NISCSS) in Hainan, China. This was the First Conference in a project led by Indonesia and China to enhance cooperation and help manage the security situation in the South China Sea. Prof Beckman served as the co-chair of a Working Group on UNCLOS and the South China Sea.

CIL Senior Research Fellow Dr Hao Duy Phan and CIL Research Fellow Ranyta Yusran attended the 11th Annual Conference of the European Society of International Law in Oslo, Norway from 10-12 September 2015. The Conference was hosted by the PluriCourts Centre for the Study of the Legitimate Roles of the Judiciary in the Global Order, University of Oslo.

Senior Research Fellow Youna Lyons and Research Fellow Denise Cheong participated in the 2015 Colloquium of the IUCN Academy of Environmental Law held at the Atma Jaya Catholic University in Jakarta, Indonesia, from 7-11 September 2015. CIL Practice Fellow Emily Choo was invited to present her paper, ‘The Impact of Amicus Curiae Submissions in Investment Treaty Arbitration’ at the 2015 Taipei International Conference on Arbitration and Mediation from 6-7 September 2015. The conference was attended by about 60 practitioners and academics from more than eight countries across Asia and Europe. Emily spoke about the investment arbitration tribunals’ treatment of amicus curiae participation in investment arbitration proceedings. Her paper is the latest comprehensive study of this particular area and her study of the cases shows that there are three main approaches that such tribunals have taken. She concluded her presentation by examining the precedential value of these earlier investment arbitration cases for the ongoing Philip Morris v Uruguay proceedings. CIL Senior Research Fellow Dr Hao Duy Phan and CIL Research Fellow Dr Sun Zhen were invited to speak at the China-ASEAN Forum on Law, Policy and Management of the Sea on 4 August 2015 in Guiyang, Guizhou, China. Hao Duy Phan delivered a presentation on ‘ASEAN Cooperation on Maritime Security’ (download in PDF). Sun Zhen made a presentation on ‘Regional Sea Cooperation in East Asia’ (download in PDF). The Forum was co-organised by the Ocean University of China and the Guiyang College of Traditional Chinese Medicine, and sponsored by the Ministry of Education and Ministry of Foreign Affairs of China. More than 50 participants from China, ASEAN Member States and other states attended the Forum.

CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to act as one of four instructors in a workshop in Nay Pyi Taw, Myanmar, from 6 to 8 July 2015 on ‘Public Policy and Investor State Dispute Settlement’, jointly organised by Myanmar’s Attorney-General’s Office and the International Commission of Jurists (Myanmar). It was attended by more than 60 government officials from across Myanmar, and presided over by Myanmar’s Attorney-General and Director-General. She taught in two 90-minute sessions on defences in investment treaty law, paying close attention to Myanmar’s existing investment treaties. She also developed, led and participated in exercises based on a simulation of an investor-state dispute that arises between Myanmar and investors of an ASEAN neighbour. CIL Practice Fellow Emily Choo attended the Pearl River Delta Academy of International Trade and Investment Law, which was held in Macau and Shenzhen from 6 July 2015 to 17 July 2015. The Academy was organised by the Institute of European Studies in Macau and the Peking University School of Transnational Law and covered WTO law, international investment law, international trade and other areas of international law. The two-week Academy brought together postgraduate students from various disciplines to be trained by a faculty comprising leading academics from various fields.

CIL Research Fellow Junianto James Losari was invited to speak at the Art of Negotiating Trade and Investment Agreements Workshop: Taking Into Account the Global Tobacco Treaty. The workshop was held in Chiang Mai, Thailand on 25-26 June 2015. It was attended by academics and government officials from the Ministry of Health in the region. James spoke about the ‘Investment Framework from the ASEAN Perspective’ and its implication on tobacco control measures taken by ASEAN Members. He highlighted the importance of ASEAN Members to terminate their intra-ASEAN BITs, which do not provide enough policy space for States to take tobacco control measures without incurring liability. On the other hand, the newer generation International Investment Agreements, such as the ASEAN Comprehensive Investment Agreement and other ASEAN + Dialogue Partner(s) Investment Agreements contain general exceptions clauses that allow States to take measures to protect its public health, including tobacco control measures without incurring any liability. However, ASEAN Members must carefully formulate their measures to fulfil the requirements of such clauses.

Assoc Prof Michael Ewing-Chow was invited by the International Institute for Trade and Development (Thailand) and the Ministry of Foreign Affairs of Thailand to speak at a seminar on International Investment Agreements (IIAs) towards Global Sustainability. The two-day seminar was held on 25-26 June 2015 in Bangkok, Thailand. In addition to explaining the general framework of IIAs and its recent development, Michael also discussed shareholder recovery in investment claims and advised on options for IIA and BITs clauses.

CIL was a sponsoring organisation at the 39th Annual Conference of the Center for Oceans Law and Policy (COLP) of the University of Virginia, which was held in Shanghai, China from 24-26 June 2015. The title of the Conference was ‘International Marine Economy: Law and Policy’. CIL Director Robert Beckman chaired a panel on grey areas in international boundary delimitation. CIL sponsored the participation of four speakers: CIL International Advisory Panel Member Arif Havas Oegroseno, Dr Clive Schofield, CIL Non-Resident Fellow Captain Ashley Roach and CIL Research Fellow Leonardo Bernard. CIL Director Professor Robert Beckman, CIL Non-Resident Fellow Captain Ashley Roach, and Research Fellows Leo Bernard and Dr Zhen Sun participated in the 2015 International Symposium on Global Commons and the Law of the Sea in Hangzhou, China on 22-23 June 2015. The Symposium was co-organised by the Centre for Ocean Law and Governance, Guanghua Law School and Collaborative Innovation Centre for the Belt and Road Initiative, Zhejiang University. Professor Beckman delivered a presentation on ‘The Development of the Polar Code and Challenges to Its Implementation’, while Captain Roach presented on ‘Evolution of Soviet Maritime Navigation Policy and China’s Far Seas Operations’. On 12 June 2015, the Symposium for the Commemoration of the 20th Anniversary of the Rhodes Academy on Oceans Law and Policy was held at the United Nations in New York. Hosted by the Permanent Mission of Iceland to the UN, the Symposium featured Judge Tomas Heidar and several other Rhodes Alumni, who presented on current law of the sea issues. Most of the Symposium’s 70 participants had attended the Meeting of States Parties to the Law of the Sea Convention that took place the previous week. CIL, one of the sponsoring organisations of the Rhodes Academy, was represented at the Symposium by CIL Research Fellow (Non-Resident) Tara Davenport at which she gave a presentation on ‘Submarine Cables in Areas Beyond National Jurisdiction’.
