CIL Senior Research Fellow Dr. Hao Duy Phan was invited to speak at the ASEAN Regional Workshop on “The Promulgation of Laws and Regulations of ASEAN Member States: A Comparative Study” on 23-24 April 2014 in Jakarta, Indonesia. Hao Duy Phan delivered a presentation on “Treaty-Making and the Status of Treaties in ASEAN Member States: An Overview”. The Workshop was jointly organized by the Ministry of Law and Human Rights, Ministry of Foreign Affairs of Indonesia and the ASEAN Secretariat (ASEC). CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow along with CIL’s RA Junianto James Losari were invited to attend the first Forum on International Trade and Investment (FORTRIN) meeting. Former WTO Deputy Director General Alejandro Jara, now with King & Spalding hosted the meeting. Michael and James attended by videoconference from the King & Spalding office in New York, together with Prof. Karl Sauvant of the Vale Centre of Columbia University. The meeting was attended trade and investment experts from Geneva, London, Paris, Washington DC, and New York all linked by videoconference. FORTRIN aims to provide a platform to promote the application and development of trade and investment rules with a view to bolstering the global legal framework for international economic law activity. During the first meeting, the discussion revolved around how to frame the issues of current investment rules. This is an important foundation if a multilateral approach on investment rules were to be proposed. In his intervention, Prof. Michael Ewing-Chow suggested a way to contextualize the current issues by looking through the global value chains lens, as governments will be more interested in exploring further the idea of multilateral investment agreement if they can be more integrated to the value chains. The discussion also touched upon several challenges to this effort, among others: the growing reluctance of governments in being subjected to Investor-State Dispute Settlement (ISDS), the need for a better fact-finding procedure in international arbitration, the need to address burning issues such as abusive treaty shopping, and the need to educate the stakeholders, including the civil society. Preparations are required to deal with these matters before one can move towards creating a multilateral investment framework.

CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow and CIL’s RA Junianto James Losari were invited by the DC Bar’s International Dispute Resolution Committee to attend a lunchtime panel discussion on “Changes in the System of Investor-State Dispute Settlement: Viewpoints from the Americas” that was held on 10 April 2014 at the office of Arnold & Porter LLP in Washington DC. The panelists (Anna Joubin-Bret, Jonathan S. Kallmer, and Omar Garcia-Bolivar) presented their findings of the current state of development in investor-state dispute settlement (ISDS) in both North America and South America. Michael and James were invited to share their views on the developments in Asia and in particular ASEAN and Asia. During the discussion that was moderated by Jean Kalicki, various innovations were mentioned on how countries sought to improve the current legal frameworks. These innovations are to be implemented both at domestic and international levels and could be considered as fresh ideas for currently ongoing IIAs negotiations, including the Trans-Pacific Partnership and the Transatlantic Trade and Investment Partnership. Michael said that the ASEAN Comprehensive Investment Agreement (ACIA) has introduced several innovations, making it a more balanced agreement both in terms of investor protection and preserving the governments’ policy space. Separately, James queried whether there was any plans to consolidate agreements in the Americas, given that Asia has plans to do so under the Regional Comprehensive Economic Partnership (RCEP) negotiation.

CIL Director Robert Beckman attended the 76th Biennial Conference of the International Law Association (ILa) and 108th Annual Meeting of the American Society of International Law (ASIL) in Washington DC. The ASIL Annual Meeting and the ILA Biennial Conference were organised jointly and held together. The other CIL staff who attend the meetings were Michael Ewing-Chow, James Losari, Leonardo Bernard and Hao Duy Phan.

Professor Joseph Weiler, Director of the CIL ASEAN Integration Through Law Project (President of the European University Institute; NUS Law School; and University Professor at the NYU School of Law (on-leave)) convened and chaired the discussions on the ASEAN Economic Community at Plenary 4 of the ASEAN Integration Through Law Project: The ASEAN Economic Community at the Sofitel Plaza Hotel, Hanoi, Vietnam. CIL senior expert, Professor Michael-Ewing-Chow, shared his work on the ASEAN economic integration and investment regime. CIL Director Robert Beckman served as the coordinator and main lecturer in an International Law Course CIL conducted for government officials from more than 20 countries. The course was conducted under the auspices of the Singapore Cooperation Program of the Ministry of Foreign Affairs. Prof Beckman made presentations and led discussions in 14 sessions of 90 minutes each over the 5-day course. Assoc Prof Michael Ewing-Chow and Christopher Thomas also made presentations. CIL Research Fellow Ranyta Yusran played a major role in organising the course and the course materials. CIL Research Fellows Hao Duy Phan and Leonardo Bernard also led discussions at the course.

CIL Director Robert Beckman and CIL Research Associate Monique Page were invited to attend the annual meeting of the International Cable Protection Committee (ICPC) in Dubai, United Arab Emirates. Prof Beckman made a presentation on ‘UNCLOS and the 2012 OSPAR Guidelines on BEP in Cable Laying and Operation’.

CIL Director Robert Beckman participated in the Norway-Singapore Arctic Symposium at the Riverview Hotel on 14 March 2014. The symposium was organised by the Maritime and Port Authority of Singapore (MPA), the Norwegian Embassy and the Singapore Maritime Institute (SMI). The keynote speaker was Else Berit Eikeland, Norway’s senior Arctic official in the Norwegian Ministry of Foreign Affairs. The International Economic Law and Policy (IELPO) LL.M Programme of the Universidad de Barcelona invited CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow for the second consecutive year to teach ‘Regionalism in Asia’ as part of their programme. The course was held on 10-11 March 2014 and focused on the unique features of Asian Regionalism, with an emphasis on the trade and investment aspects of the Association of South East Asian Nations (ASEAN).

CIL staff organised and participated in the ‘International Conference on Transboundary Pollution: Evolving Issues of International Law and Policy’. The conference was held at the Orchard Hotel, Singapore. Prof Tommy Koh and Prof S Jayakumar served as co-chairs of the conference. CIL Director Robert Beckman presented a paper on ‘State Responsibility for Transboundary Marine Pollution’, CIL Senior Research Fellow Youna Lyons presented a paper on ‘Transboundary Pollution from Offshore Activities: A Study of the Montara Offshore Oil Spill’, and Prof Alan Tan presented a paper on ‘Co-operative and Unilateral Mechanisms to Combat Forest Fires and Transboundary Haze’ in Southeast Asia. CIL Director Robert Beckman and CIL Research Associate Monique Page attended a CSCAP Experts Group Meeting on Security of Vital Undersea Communications Infrastructure on Monday 17 February in Jakarta. On Tuesday 18 February they will be attending a meeting of the CSCAP Study Group on Maritime Security. CSCAP is Council for Security Cooperation in the Asia Pacific (CSCAP). The Study Group is co-chaired by CSCAP Singapore, CSCAP Indonesia and CSCAP New Zealand. Prof Beckman will be making presentations at both of the meetings. CIL Research Associate, Junianto James Losari spoke in the Plenary Discussion on Cooperative Ventures toward ASEAN Integration. The Plenary discussion was a part of the full day Business Law Convention held by De La Salle University College of Law in cooperation with the Department of Trade and Industry of the Philippines on Doing Business in Free Trade Areas: Cooperative Ventures toward ASEAN Integration. The event, attended by almost 1,000 students, academia and business community, was meant to raise awareness about the upcoming ASEAN Economic Community (AEC) in 2015. On 8-9 February 2014, CIL Research Associate Junianto James Losari judged three preliminary rounds and the final round of the 2014 Indonesian National Rounds of the Philip C. Jessup International Law Moot Court Competition, held at Universitas Pelita Harapan (UPH), Indonesia. Universitas Indonesia and UPH respectively came as the Champion and the Runner Up of the competition in which 17 universities participated. In April, the two teams along with Universitas Udayana (Exhibition Team) will compete in Washington DC, USA.

CIL Head of Trade and Investment Law and Policy and Singapore’s WTO Chair, Prof. Michael Ewing-Chow and CIL Research Associate, Junianto James Losari taught Investment Law at the Master in Trade, Investment and Competition Law & Policy Program of Universitas Pelita Harapan in Jakarta, Indonesia. CIL Director Robert Beckman visited the International Boundaries Research Unit (IBRU) of Durham University in order to discuss continued links between IBRU and CIL. While at the University, Prof Beckman also met with members of the Faculty of Law.

CIL Research Associate Yvette Anthony assisted Senior Principal Research Fellow Christopher Thomas QC in teaching a three-day intensive training course for Singapore Ministry of Trade and Industry (MTI) officials on dispute settlement under international investment agreements.

On 5 April 2013 CIL research staff had a roundtable discussion on the South China Sea Disputes with research staff of the Center for Strategic and International Studies (CSIS) at their offices in Washington. The CIL delegation included CIL Director Robert Beckman, CIL researchers Tara Davenport and Leo Bernard, and Ambassador Arif Havas Oegroseno of Indonesia, a member of CIL International Advisory Panel. Prof Beckman began the discussion with a brief presentation, and it was followed by a general discussion. The CIL researchers were in Washington DC to attend the Annual Meeting of the American Society of International Law. The roundtable discussion was arranged by Murray Hiebert, Deputy Director and Senior Fellow in the Southeast Asia Program at CSIS.

CIL Director Robert Beckman made a presentation titled “Role of ASEAN and the Philippines v China Case” on 4 April 2013 at the 107th Annual Meeting of the American Society of International Law in Washington DC. Prof Beckman served on a Panel on Legal Solutions to Maritime Disputes in Asia, and he spoke about the South China Sea Disputes. The other members of the panel were Rosalyn Higgins, past President of the International Court of Justice; Loretta Malintoppi, Eversheds LLP Paris; and Galo Carrera Hurtado, Member of the Commission on the Limits of the Continental Shelf. Senior Principal Research Fellow Mr. Christopher Thomas, QC, was invited by Thailand’s Department of International Economic Affairs to participate in a panel discussion on 27 March 2013 organised by the Thailand Ministry of Foreign Affairs, together with the Royal Thai Embassy in Brussels and the Mission of Thailand to the European Union, on the issue of investor-state dispute settlement under the current EU investment regime. Fellow panellists were Ms. Eugenia Costanza Laurenza of FratiniVergano Brussels and Professor Jayavadh Bunnag of International Legal Counsellors Thailand Ltd, and the session was moderated by Dr. Vilawan Mangklatanakul, Director in the International Law Development Division in Thailand’s Ministry of Foreign Affairs. The purpose of the session was to assist Thai government officials in their understanding of the kind of protection offered and reciprocally demanded in the present model of investment protection advocated by the EU and the significance of the option of investor-state dispute settlement in arbitrating disputes which may arise.

CIL Director Robert Beckman participated in the Five Universities Conference 2013 organised by the LKY School of Public Policy. He made a presentation on ‘Dispute Settlement Mechanisms and the South China Sea Disputes’.

CIL Senior Research Fellow Dr Tan Hsien-Li presented her paper on “International Human Rights Law, Regional Mechanisms and ASEAN: Disconnected Paradigms” at the European University Institute’s Human Rights Day Colloquium held in Florence, Italy.

CIL Director Robert Beckman participated in a Roundtable on Maritime Security in East Asia.The Roundtable was organised by the S. Rajaratnam School of International Studies (RSIS) and the Japan Institute of International Affairs (JIIA) and held at the Four Seasons Hotel in Singapore. Prof Beckman made a presentation on ‘International Law & Maritime Security in East Asia’.

On 8 December 2013, Universitas Gadjah Mada (UGM) and its Center for World Trade Studies held a seminar with the theme of “Promoting Fair Trade to Achieve Sustainable Development through Doha Agenda”, a part of its three-day event, the 1st Model World Trade Organization (WTO). CIL Associate Junianto James Losari, representing Prof. Michael Ewing-Chow as the WTO Chair at NUS, delivered a talk on Diplomacy in World Trade Organization. In his talk, James explained about the dynamic of negotiations during the 9th WTO Ministerial Conference in Bali. With the consensus decision-making mechanism, every Member has an equal vote. With the number of developing countries outweighing the number of developed countries, it would be naive to argue that the WTO remains a club of rich nations or developed countries. He further observed the various advantages of having the Bali Package agreed by all WTO Members by also looking at the counterfactual. Besides James, Bapak Riza Noer Arfani, MA (WTO Chair at UGM) also delivered a talk on “Sustainable Development through Trade” which continues on exploring the results of the Bali Package and its impacts for developing countries.

The President of the Republic of Indonesia, Susilo Bambang Yudhoyono delivered his opening speech and officially declared the Conference open on 3 December 2013. CIL researchers participated in the 4th Biennial Conference of the Asian Society of International Law in New Delhi, India on 14-16 November 2013. They presented their papers in a panel titled “ASEAN: the Good, the Bad and the Ugly”. CIL Research Fellow Dr Hao Duy PHAN opened the Panel with a discussion on ASEAN’s role on intra-regional security (download in PDF format) followed by a presentation from CIL Research Fellow Mr Leonardo BERNARD on the use of extra-ASEAN dispute settlement mechanisms for ASEAN disputes (download in PDF format). CIL Senior Research Fellow Youna Lyons played a key role as CIL’s point person in organising a marine science, engineering, law and policy workshop entitled ‘Rigs-to-Reefs Prospects for Large Scale Artificial Reefs in Tropical Southeast Asian Seas’. The Workshop was organised jointly by CIL, the NUS Tropical Marine Science Institute (TMSI) and the NUS Centre for Offshore Engineering (CORE). CIL Senior Research Fellow Youna Lyons was invited as a speaker to the 2013 APAC Offshore Decommissioning Training Workshop organized by DecomWorld. She was a member of the regulatory panel and made a presentation on the international legal framework for rigs-to-reefs (download in PDF format) and on International law on offshore decommissioning in Southeast Asia (download in PDF format).

CIL Staff organised and participated in the first CIL Conference on Food Security and Trade. The conference was at Fort Canning Hotel, Singapore. The Conference brought together leading experts on international trade in agriculture to provide an analysis of the ways in which the current international trade system can affect food security. CIL Head of Trade and Investment Law and Policy, Prof Michael Ewing-Chow presented a paper on the relationship between self-sufficiency and food security ‘From Self-Sufficiency to Collective Food Security’ and CIL Senior Research Fellow, Melania Vilarasau Slade presented a paper on ‘The Role of International Law in Tackling the Resource Challenge’. CIL Director Robert Beckman participated in a conference organised by the National Institute for South China Sea Studies, Haikou, Hainan, China. On 22 – 25 October 2013, CIL Research Associates Mr. Junianto James LOSARI and Ms. Ranyta YUSRAN attended the 2013 Padjdjaran International Legal Conference Series, “Regional Perspectives on Law and Human Rights: Where are we not and where are we heading?” in Bandung, West Java, Indonesia. The Conference was organised by the Law Faculty of Padjadjaran University and opened by the Dean of Universitas Padjadjaran. Mr. LOSARI presented his paper on “ASEAN Comprehensive Investment Agreement: Will Indonesia’s BITs Obligations be Irrelevant?” and Ms. YUSRAN presented her paper on “Combating Trafficking in Women and Children in Southeast Asia: the ASEAN Framework”. CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her expertise on ASEAN regional integration as part of the Singapore contingent led by Professor Tommy Koh at the 8th China-Singapore Forum held in Beijing, China. The meeting was comprised of senior officials and representatives from both countries at which they shared their nation-building experiences on such topics as urban growth, housing, income gaps, economic cooperation and wider regional cooperation initiatives.

CIL Director Robert Beckman participated in the APEC Workshop on ‘Enhancing Supply Chain Connectivity: Submarine Telecommunications Cable Resilience in the Asia-Pacific Region’. The Workshop was organised by Australia and held at the Pullman Bali Legian Nirwanna, Bali Indonesia. CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow was invited to teach at the Foreign Trade University in Hanoi, Vietnam, where he taught the course titled ‘Investment Law’ to students of the Masters of Trade and Investment Program on 14-18 October 2013.

CIL Senior Research Fellow Dr Tan Hsien-Li participated in the CIL Fireside Chat on ASEAN and Human Rights, chaired by Professor S Jayakumar and Professor Tommy Koh. She discussed the impact of the rule of law in ASEAN and Human Rights on regional and national levels. For more information, click here.

CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her work on human rights in ASEAN at the Human Rights Colloquium held at the University of Geneva, Switzerland. In particular, she was tasked to discuss the vulnerabilities of the protection mechanisms in the Human Rights Commissions of the League of Arab States, Organization of Islamic Cooperation and Association of Southeast Asian Nations (ASEAN).

On 19 September 2013, CIL Senior Research Fellow Youna Lyons took part as speaker and facilitator to the Rigs-to-Reef workshop organized by Universiti Technologi Petronas (UTP) Offshore Engineering Centre (OECE) at Impiana KLCC, Kuala Lumpur. She made a presentation on the international legal issues surrounding rigs-to-reefs in Southeast Asia. This presentation which focused on the development of Rigs-to-Reef in Malaysia is a prelude to the regional level workshop on the Prospects for Rigs-to-Reefs in Southeast Asia co-organized by CIL on 12-13 November 2013. A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by the Rajaratnam School of International Studies to speak at their Workshop on Governance of East Asian Regional Economic Architectures: The Dynamics of Regional and Global Economic Governance on 10 September 2013. Prof Ewing-Chow spoke on how the ASEAN Economic Community still relies on the WTO for many trade issues and how the WTO Trade Policy Review Mechanism was more transparent than the ASEAN Scorecard. However, he also expressed the view that the ASEAN International Investment Agreements were WTO Plus rules that were useful for the integration of the ASEAN production networks. CIL Research Fellow Leonardo Bernard participated at the Conference on Global Ocean Issues and Challenges on 9 September 2013 in Dankook University, Korea. The Conference was organized by the Wooseok Institute of Korean Territory Studies, Dankook University in cooperation with the Korea Institute of Maritime Strategy and SLOC Study Group-Korea. Leo spoke on Cooperative Mechanism in the Straits of Malacca and Singapore, which addressed issues associated with current state of maritime cooperation under Article 43 of UNCLOS. Leo was also invited to attend the Conference celebrating the 60th Anniversary of the Korea Coast Guard on 11 September 2013 at Incheon, Korea.

CIL Director Robert Beckman and CIL Senior Research Fellow Youna Lyons took part at Pacem in Maribus XXXIV in Bangkok, on 5-8 September 2013. Professor Beckman co-chaired the theme 2 of the conference on the implementation of UNCLOS in Southeast Asia and Youna Lyons was co-rapporteur for this theme.

CIL Research Associate, Junianto James Losari, participated at the International Law Association Regional Conference 2013 held in Cape Sounion, Greece, on 29-31 August 2013. The conference was hosted by the Hellenic Branch of the ILA and was held at the premise of the European Public Law Organization. This year’s conference took the theme Imperium Juris: Governance, Trade Resources. James presented a paper that he wrote together with Prof. Michael Ewing-Chow (Head of Trade and Investment Law and Policy of CIL) in one of the panels on trade. The paper titled “Countermeasures in International Trade Law and their Illegality in International Investment Law”, analyses the interaction between the trade and investment regimes and the issue that arises in it. CIL Research Fellow Leonardo Bernard participated at the Conference on Maritime Confidence Building Measure in the South China Sea on 11-13 August 2013 in Sydney, Australia. The Conference was organized by the Australian Strategic Policy Institute. Leo joined the second panel on Maritime cooperation in the South China Sea, which addressed issues associated with current state of maritime cooperation and prospective areas for cooperation. CIL Researchers Ms. Ranyta Yusran and Ms. Harpreet Kaur Dhillon attended the Hague Academy of International Law’s Summer Programme on Public International Law, held at the Peace Palace from 8 July 2013 to 26 July 2013. They participated in a general course conducted by Professor James Crawford (Whewell Professor at the University of Cambridge) on the Practice and Process of the Law of Nations, and special courses conducted by Professor Lucius Caflisch (Member of the International Law Commission), Professor Eyal Benvenisti (Tel Aviv University), Professor Jean-Marc Sorel (Sorbonne Law School), Professor Robert Kolb (University of Geneva), Professor Anna Wyrozumska (University of Lodz), Professor Bruno Nascimbene (University of Milan) and Professor Ki Gab Park (Korea University). The Summer Programme was attended by more than 350 participants coming from over 90 Countries.

CIL participated in the 18th session of the Rhodes Academy of Oceans Law and Policy in Rhodes, Greece as a full sponsor, together with the Center for Oceans Law and Policy, University of Virginia School of Law (Charlottesville, USA); the Aegean Institute of the Law of the Sea and Maritime Law (Rhodes, Greece); the Law of the Sea Institute of Iceland (Reykjavik, Iceland); the Max Planck Institute for Comparative Public Law and International Law (Heidelberg, Germany); and The Netherlands Institute for the Law of the Sea, Utrecht University (Utrecht, The Netherlands). CIL Director Robert Beckman lectured at the Academy, where he delivered three seminars on ship-source pollution, non ship-source pollution and the South China Sea disputes and co-supervised a workshop on the international regulation of shipping. He also served as one of the four examiners for the oral examination at the end of the course, together with Judges Wolfrum, Cot and Golitsyn from the International Tribunal for the Law of the Sea. CIL Director Robert Beckman participated in the ‘CIL Roundtable on the South China Sea Disputes’. The Roundtable was held at the Orchard Hotel, Singapore. CIL Director Robert Beckman and CIL Research Fellow Leonardo Bernard participated at the International Symposium on Peaceful Use of the Sea and Maritime on 22-23 June 2013 in Hangzhou, China. The Conference was organized by Centre for Ocean Law and Governance at Guanghua Law School, Zhengjian University. Prof Beckman and Leo joined the third panel on peaceful means for maritime dispute settlement together with Dustin Kuan-Hsiung Wang from national Taiwan Normal University and Anne Hsiu-An Hsiao from National Chengchi University, Taiwan. CIL Director Robert Beckman presented a lunchtime talk on the South China Sea Disputes for members of the Europe-ASEAN Business Alliance (EABA).

CIL Senior Research Fellow Dr Tan Hsien-Li was invited to share her expertise at the Regional Track Two Meeting “ASEAN Human Rights Mechanisms: Challenges and Ways Forward” and engage with officials from the ASEAN Intergovernmental Commission on Human Rights (AICHR), ASEAN Commission for the Promotion and Protection of the Rights of Women and Children (ACWC) and ASEAN Committee on the Implementation of the ASEAN Declaration on the Promotion and Protection of Migrant Workers (ACMW). This meeting was hosted by the Thai Ministry of Foreign Affairs and the Working Group for an ASEAN Human Rights Mechanism and was held in Bangkok, Thailand.

CIL Director Robert Beckman chaired a panel on Boundary Disputes Involving Oil & Gas Fields at the Oil & Gas Asia Dispute Resolution Conference at the Shangri-la Hotel in Jakarta on 5 June 2013. The conference was organized by the Singapore International Arbitration Centre (SIAC). The other members of the panel were Will Thomas of the Paris Office of Eversheds, Dominic Roughton of the Tokyo office of Herbert Smith Freehills, and Wesley Harris of the Malaysian office of Royal Dutch Shell.

CIL Research Fellow Leonardo Bernard spoke at the 3rd Annual CSIS South China Sea Conference – “Managing Tensions in the South China Sea” on 5-6 June 2013 in Washington DC, USA. The Conference was organized by the CSIS Sumitro Chair for Southeast Asia Studies. Leo joined the last panel on Policy Recommendation to Boost Cooperation in the South China Sea together with Ms Bonnie Glaser, CSIS Freeman Chair in China Studies, and Mr Chirstian Le Miere, Senior Research Fellow from the International Institute for Strategic Studies. CIL Director Robert Beckman made a presentation on The Significance of Islands to Maritime Claims on 4 June 2013 at the 26th Annual International Military Law and Operations (MILOPS) Engagement at the Imperial Queen’s Park Hotel, Bangkok. CIL Research Fellow Dr Hao Duy Phan and CIL Research Associate Junianto James Losari participated at the 10th Annual Asian Law Institute Conference – “Celebrating Diversity: 10 Years of ASLI” on 23-24 May 2013 in Bangalore, India. The Conference was jointly organized by the Asian Law Institute and the National Law School of India University. Dr Hao Duy Phan opened the first panel on International and Transnational Regulation by discussing the Protocol to the ASEAN Charter on Dispute Settlement Mechanisms and its significance in further institutionalizing ASEAN into a rules-based regional organization. CIL Director Robert Beckman did an invited presentation on 25 April 2013 on the South China Sea Disputes to the Chinese Students & Scholars Association at the University of Oxford, United Kingdom.

CIL Director Robert Beckman attended the SubOptic 2013 Conference in Paris on 22-23 April 2013. Professor Beckman served as a presenter in a Masterclass Tutorial on Maritime Jurisdiction and Submarine Telecommunications Marine Activities. The other presenters were Douglas Burnett, the International Law advisor of ICPC, and Graham Evans, a Director of EGS Survey Group.

CIL Director Robert Beckman attended the London International Boundary Conference at the Royal Geographic Society in London from 18-19 April 2013. The Conference was organized by the UK Hydrographic Office, Volterra Fietta and King’s College London and was held at the Royal Geographic Society. Prof Beckman spoke on a panel on the South China Sea and presented on the topic of “The Philippines v China Case and the South China Sea Disputes”. In April 2013, the Human Rights Resource Centre (HRRC), an Indonesian-based research institution, published two baseline studies to which CIL Research Fellow and Associate contributed as Country Rapporteurs. Dr. Hao Duy PHAN is the Country Rapporteur for Viet Nam in HRRC’s Baseline Study on “Business and Human Rights in ASEAN”; the Baseline Study was recently launched in Jakarta, Indonesia, on 9 April 2013. Ms. Ranyta YUSRAN contributed to HRRC’s Baseline Study on “Violence, Exploitation, and Abuse and Discrimination in Migration Affecting Women and Children in ASEAN” as the Country Rapporteur for Indonesia; due to the wide scope of the Study, the Baseline Study is only published a year after its launch on 30 May 2012. CIL Fellows and Research Associate have been involved constantly as Country Rapporteurs in HRRC’s Baseline Study series since 2011. CIL Research Fellow Hao Duy Phan was a presenter at the Conference on Business and Human Rights in ASEAN in Jakarta, Indonesia on April 9, 2013. The Conference was a major event organized by the Human Rights Resource Centre for ASEAN to launch a baseline study that examines the legal framework of ASEAN member states in response to business and human rights issues. The outcome of the study is a book published and distributed on the occasion of the Conference. Dr. Phan participated as a rapporteur of the Vietnam Country Report chapter. CIL sponsored a Panel at the 107th Annual Meeting of the American Society of International Law (ASIL) in Washington DC on 5 April 2013, titled “Challenges for ASEAN: The South China Sea, Investment Protection and Myanmar”. Prof Michael Ewing-Chow opened the Panel with discussion on ASEAN legalization, institutionalization and economic law issues facing ASEAN, followed by Ambassador Arif Havas Oegroseno who talked about ASEAN and the South China Sea disputes. CIL’s Research Fellow Tara Davenport then talked about the approach of ASEAN Member States in negotiating and settling maritime boundaries (download her presentation in PDF format). Finally, CIL’s Senior Research Fellow Dr Tan Hsien-Li closed the Panel with a discussion of ASEAN’s approach to the human rights situation in Myanmar. The Panel was chaired by Edmund Sim of Appleton & Luff, and co-sponsored by the ASIL Law in Pacific Rim Interest Group and the ASIL International Economic Law Interest Group.

A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by the World Trade Institute of the University of Berne and the Universitas Pelita Harapan to teach at the inaugural Masters of Law in Trade, Investment and Competition Law & Policy (MTIC) Program in Jakarta. Together with Research Associate, James Losari, he taught Investment Law with a particular emphasis on ASEAN and the context of investment policy in Indonesia.

A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by the Universitas Pelita Harapan (UPH) and the Economic Research Institute for ASEAN (ERIA) and East Asia to speak at the UPH-ERIA Distinguished Lecture Series on “Engendering ASEAN’s Services Value Chains”. H.E. Gita Wirjawan, the Minister of Trade for Indonesia opened the session and Prof Ewing-Chow emphasized the value of the rule of law for investor confidence in services investments particularly for telecommunications, logistics and finance.

CIL Director Robert Beckman participated in the 9th Japan-Singapore Symposium organised by the Ministry of Foreign Affairs of Japan in Tokyo, Japan. Prof Beckman made a presentation on the South China Sea Disputes as part of the panel on ‘Maritime Issues in the Region: Establishment of the Order of the Law of the Sea’.

A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by UNCTAD to attend its closed door planning meeting for the World Investment Report 2013 in Geneva from 31 Jan to 1 Feb 2013. Issues regarding Global Value Chains, EU investment treaties post Lisbon and recent international investment arbitration jurisprudence were discussed.

A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by UNESCAP and the Thai Ministry of Commerce to participate as an expert for the Dialogue Trade and Investment Coherence in Bangkok. Prof Ewing-Chow spoke on the need to understand that trade and investment policy needed to be coordinated to fully maximize the productivity gains from integrated production networks. He also highlighted the value of the legalization of the ASEAN Economic Community which will incentivize a more transparent process of governmental economic policy and decision making through the disciplines of clear rules, monitoring and in extremis dispute settlement options.

A/P Michael Ewing-Chow, WTO Chair and Head of CIL’s Trade and Investment Programme chaired Dialogue on Improving the Investor State Dispute System. Meg Kinnear, Secretary General, ICSID, Roberto Echandi, Director, Investment Programme, WTI, Anna Joubin-Brett, Partner, Foley Hoag and Chris Thomas Q.C., CIL Senior Principal Research Fellow, participated in the Dialogue. Ideas about how capacity could be built in developing countries and how fact finding could be improved during the arbitration process as were canvassed. Participants were also keen to encourage conflict management and mediation and conciliation as an alternative to immediate litigation.

CIL Director Robert Beckman participated in an international conference on the South China Sea which was organized and hosted by the National Institute for South China Sea Studies (NISCSS) in Haikou, Hainan, China from 5-7 December 2012. The theme of the conference was “Recent Development of the South China Sea Dispute and Prospects of Joint Development Regime”. Prof Beckman presented a paper entitled “Legal Framework for Joint Development in the South China Sea”. CIL Director Robert Beckman contributed to the CSCAP Regional Security Outlook 2013 with a short article on “Increased Tension and Risk of Potential Conflict in the South China Sea”. CSCAP is the Council for Security Cooperation in the Asia Pacific. It provides an informal mechanism for scholars, officials and others in their private capacities to discuss political and security issues and challenges facing the region. The CSCAP regional security outlook (CRSO) is an annual publication to highlight regional security concerns and to promote informed policy-relevant outputs to advance regional security cooperation at official (Track One) levels. CIL Research Associate Leonardo Bernard participated in the International Conference for the 30th Anniversary of UNCLOS with the theme “China and the Law of the Sea” from 22-24 November 2012 at Qingdao, China. CIL Senior Research Fellow Youna Lyons was invited by the Ministry of Transportation and the Ministry of Foreign Affair of Indonesia to 2nd International Conference on Liability and Compensation Regime for transboundary oil damage resulting from offshore exploration and exploitation activities and contributed to the expert discussion on the establishment of a new regime.

CIL Senior Research Fellow Youna Lyons was invited to attend the Conference Offshore Structures Asia held in Kuala Lumpur on 19-21 November 2012 and chaired the decommissioning panel organized on the first day. A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited by the Government of Myanmar and UNESCAP to advise Myanmar on its Investment Laws and Policies. Prof Ewing-Chow spent a week in Myanmar from 18 to 24 November understanding the needs of the various stakeholders while outlining the parameters and issues relating to foreign investments. CIL Director Robert Beckman participated in the Fourth International Workshop on the South China Sea organized by the Diplomatic Academy of Vietnam and the Vietnam Lawyers Association. The workshop was held from 18-21 November 2012 in Ho Chi Minh City, Vietnam, and its theme was “The South China Sea: Cooperation for Regional Security and Development”. Prof Ewing-Chow taught “The WTO Dispute Settlement System” with Chibole Waikole, WTO Legal Affairs Officer and Alan Yanovich, Counselor, WTO Appellate Body Secretariat from 5-8 November 2012. Prof Ewing-Chow also shared his completed research on the use by Asian Developing Countries of the WTO Dispute Settlement System co-authored with CIL Student Research Assistant Alex Goh.

CIL Patron Prof S Jayakumar, Chairman of CIL’s International Advisory Panel (IAP), delivered the keynote address on “International Law and the South China Sea – Claims and Joint Development” at the Blue South China Sea, Green Joint Development Conference in Xiamen, China, on 3 November 2012. From 2 to 5 November 2012 CIL Director Robert Beckman participated in three separate events during World Ocean Week (WOW) in Xiamen, China. On Friday 2 November, he attended the Blue Economy, Green Grow Technology-led Marine Economy Development Conference and made a presentation on “International Regulation of Low-carbon Marine Economy Development” at the Forum of Marine Science and Technology. On Saturday 3 November, he participated in the 1st Annual Meeting of the 3rd International Academic Advisory Committee of the Coastal and Ocean Management Institute of Xiamen University. On Sunday 4 November he attended the “Blue South China Sea: Green Joint Development” Conference organized by the programme on Oceans Law and Policy of the Xiamen University Law School. A/P Michael Ewing-Chow, Head of CIL’s Trade and Investment Law and Policy Programme and WTO Chair, NUS was invited to attend Hague Institute for the Internationalisation of Law (HiiL) Innovating Justice Forum 2012 from 1-2 November 2012. The forum focused on the issue of the rise of international rule making as a phenomenon and the problem of building trust in the rulemaking by transnational public and private networks. CIL Director Robert Beckman and Senior Research Fellow Youna Lyons participated actively in the APAC decommissioning workshop organized by Decomworld in Singapore on 31st October-1st November 2012. Professor Beckman chaired the regulatory panel and made a presentation on the global legal regime on the decommissioning of offshore installations and structures.

CIL Director Robert Beckman made a presentation on 24 October 2012 at the Workshop on ASEAN Enhanced Dispute Settlement Mechanisms at the ASEAN Secretariat in Jakarta. Prof Beckman’s presentation was on “Dispute Settlement Mechanisms and Compliance with ASEAN Agreements”. CIL Senior Research Fellow Youna Lyons attended and made a presentation at the SCS-2012, 2nd Conference for Regional Cooperation in Ocean and Earth Science Research in the South China Sea: Sharing Knowledge, Resources and Technologies for a Sustainable South China Sea, jointly organized by the University of Malaya and the Ministry of Science, Technology and Innovation Malaysia (MOSTI). This conference took place on 21-24 October in Kuala Lumpur, Malaysia. Youna’s presentation was titled: ‘Documenting Biodiversity Research to Assist with the Implementation of International Instruments and the Protection of Marine Biodiversity’.
