CIL Practice Fellow Emily Choo was invited to present her paper, ‘The Impact of Amicus Curiae Submissions in Investment Treaty Arbitration’ at the 2015 Taipei International Conference on Arbitration and Mediation from 6-7 September 2015. The conference was attended by about 60 practitioners and academics from more than eight countries across Asia and Europe. Emily spoke about the investment arbitration tribunals’ treatment of amicus curiae participation in investment arbitration proceedings. Her paper is the latest comprehensive study of this particular area and her study of the cases shows that there are three main approaches that such tribunals have taken. She concluded her presentation by examining the precedential value of these earlier investment arbitration cases for the ongoing Philip Morris v Uruguay proceedings. CIL Senior Research Fellow Dr Hao Duy Phan and CIL Research Fellow Dr Sun Zhen were invited to speak at the China-ASEAN Forum on Law, Policy and Management of the Sea on 4 August 2015 in Guiyang, Guizhou, China. Hao Duy Phan delivered a presentation on ‘ASEAN Cooperation on Maritime Security’ (download in PDF). Sun Zhen made a presentation on ‘Regional Sea Cooperation in East Asia’ (download in PDF). The Forum was co-organised by the Ocean University of China and the Guiyang College of Traditional Chinese Medicine, and sponsored by the Ministry of Education and Ministry of Foreign Affairs of China. More than 50 participants from China, ASEAN Member States and other states attended the Forum.

CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to act as one of four instructors in a workshop in Nay Pyi Taw, Myanmar, from 6 to 8 July 2015 on ‘Public Policy and Investor State Dispute Settlement’, jointly organised by Myanmar’s Attorney-General’s Office and the International Commission of Jurists (Myanmar). It was attended by more than 60 government officials from across Myanmar, and presided over by Myanmar’s Attorney-General and Director-General. She taught in two 90-minute sessions on defences in investment treaty law, paying close attention to Myanmar’s existing investment treaties. She also developed, led and participated in exercises based on a simulation of an investor-state dispute that arises between Myanmar and investors of an ASEAN neighbour. CIL Practice Fellow Emily Choo attended the Pearl River Delta Academy of International Trade and Investment Law, which was held in Macau and Shenzhen from 6 July 2015 to 17 July 2015. The Academy was organised by the Institute of European Studies in Macau and the Peking University School of Transnational Law and covered WTO law, international investment law, international trade and other areas of international law. The two-week Academy brought together postgraduate students from various disciplines to be trained by a faculty comprising leading academics from various fields.

CIL Research Fellow Junianto James Losari was invited to speak at the Art of Negotiating Trade and Investment Agreements Workshop: Taking Into Account the Global Tobacco Treaty. The workshop was held in Chiang Mai, Thailand on 25-26 June 2015. It was attended by academics and government officials from the Ministry of Health in the region. James spoke about the ‘Investment Framework from the ASEAN Perspective’ and its implication on tobacco control measures taken by ASEAN Members. He highlighted the importance of ASEAN Members to terminate their intra-ASEAN BITs, which do not provide enough policy space for States to take tobacco control measures without incurring liability. On the other hand, the newer generation International Investment Agreements, such as the ASEAN Comprehensive Investment Agreement and other ASEAN + Dialogue Partner(s) Investment Agreements contain general exceptions clauses that allow States to take measures to protect its public health, including tobacco control measures without incurring any liability. However, ASEAN Members must carefully formulate their measures to fulfil the requirements of such clauses.

Assoc Prof Michael Ewing-Chow was invited by the International Institute for Trade and Development (Thailand) and the Ministry of Foreign Affairs of Thailand to speak at a seminar on International Investment Agreements (IIAs) towards Global Sustainability. The two-day seminar was held on 25-26 June 2015 in Bangkok, Thailand. In addition to explaining the general framework of IIAs and its recent development, Michael also discussed shareholder recovery in investment claims and advised on options for IIA and BITs clauses.

CIL was a sponsoring organisation at the 39th Annual Conference of the Center for Oceans Law and Policy (COLP) of the University of Virginia, which was held in Shanghai, China from 24-26 June 2015. The title of the Conference was ‘International Marine Economy: Law and Policy’. CIL Director Robert Beckman chaired a panel on grey areas in international boundary delimitation. CIL sponsored the participation of four speakers: CIL International Advisory Panel Member Arif Havas Oegroseno, Dr Clive Schofield, CIL Non-Resident Fellow Captain Ashley Roach and CIL Research Fellow Leonardo Bernard. CIL Director Professor Robert Beckman, CIL Non-Resident Fellow Captain Ashley Roach, and Research Fellows Leo Bernard and Dr Zhen Sun participated in the 2015 International Symposium on Global Commons and the Law of the Sea in Hangzhou, China on 22-23 June 2015. The Symposium was co-organised by the Centre for Ocean Law and Governance, Guanghua Law School and Collaborative Innovation Centre for the Belt and Road Initiative, Zhejiang University. Professor Beckman delivered a presentation on ‘The Development of the Polar Code and Challenges to Its Implementation’, while Captain Roach presented on ‘Evolution of Soviet Maritime Navigation Policy and China’s Far Seas Operations’. On 12 June 2015, the Symposium for the Commemoration of the 20th Anniversary of the Rhodes Academy on Oceans Law and Policy was held at the United Nations in New York. Hosted by the Permanent Mission of Iceland to the UN, the Symposium featured Judge Tomas Heidar and several other Rhodes Alumni, who presented on current law of the sea issues. Most of the Symposium’s 70 participants had attended the Meeting of States Parties to the Law of the Sea Convention that took place the previous week. CIL, one of the sponsoring organisations of the Rhodes Academy, was represented at the Symposium by CIL Research Fellow (Non-Resident) Tara Davenport at which she gave a presentation on ‘Submarine Cables in Areas Beyond National Jurisdiction’. CIL Senior Research Fellow Youna Lyons was invited by the Ministry of Foreign Affairs of the Philippines as a presenter in a side event they organised on UNCLOS and the protection of the marine environment during the Meeting of the States Parties to the Law of the Sea Convention, at the United Nations Headquarters in New York, on 10 June 2015. The Conference was jointly organised by the University of Dundee and the University of Tromso. At the Conference, Dr. Sun made a presentation on ‘The Interests and Potential Roles of Observers in the Arctic Council – In the Context of Marine Environmental Protection’. CIL Director Robert Beckman and CIL Research Fellow Leonardo Bernard participated at the 2015 ILA – ASIL Asia-Pacific Research Forum on 25-26 May 2015 in Taipei, Taiwan. The Research Forum was organised by the Chinese (Taiwan) Society of International Law – Chinese (Taiwan) Branch of the International Law Association, in cooperation with the American Society of International Law and Research Center for International Legal Studies, National Chengchi University. Prof Beckman was part of the panel on Law of the Sea: South China Sea, where he presented on the Philippines v China Case and Maritime Disputes in the South China Sea. On 25-27 May 2015, the Temasek Foundation held its Series on Trade & Negotiations: RSIS-WTO Parliamentarian Workshop 2015 in Singapore. This event brought together parliamentarian representatives from the region to learn and discuss further about the recent development in the World Trade Organization (WTO). The Director General of the WTO, Mr Roberto Azevedo, delivered his keynote address about the challenges for the WTO in the future. A/P Michael Ewing-Chow was invited to share Singapore’s experience in trade facilitation. In his talk, Michael talked about the situation in the region and how trade facilitation can help development. Using the history of Singapore and trade facilitation, he suggested some principles for trade facilitation, in particular the importance of dealing with corruption, garnering buy-in from all stakeholders, and upholding the rule of law.

CIL Researchers Leonardo Bernard, Harpreet Kaur Dillon, Hao Duy Phan, Sun Zhen and Ranyta Yusran participated in the 12th Annual Asian Law Institute Conference – “Law 2.0: New Challenges in Asia” on 21-22 May 2015 in Taipei, Taiwan. The Conference was jointly organised by the National University of Taiwan and the Asian Law Institute. At the Conference, CIL researchers made various presentations on different topics of international law and chaired different panels. Dr Zhen Sun and Mr Leonardo Bernard spoke at a panel on international law with a particular focus on the law of the sea. Dr Zhen Sun made a presentation on “A Hot Land in A Cold Place: Opportunities and Challenges for Singapore in the Arctic” (download in PDF) and Mr Leonardo Bernard made a presentation on “Historic Fishing Rights and the EEZ” (download in PDF). Dr Hao Duy Phan and Ms Harpreet Dhillon participated in two different panels on international law and spoke about “ASEAN’s Legal Personality and its Treaty-Making Power” (download in PDF) and “Consolidation of Claims Arising under an International Investment Agreement: What is at Stake?” (download in PDF) respectively. Ms Ranyta Yusran was a panellist at the panel on cross-border issues. She made a presentation on “Mapping the ASEAN Framework on Transnational Crime” (download in PDF).

Universitas Kebangsaan Malaysia (UKM) invited A/P Michael Ewing-Chow to speak at the ASEAN Economic Community Forum, which was held on 21-22 May 2015 in Kuala Lumpur, Malaysia. In the panel on ‘Full Integration into the Global Community: RCEP’, Michael delivered his presentation, ‘RCEP = ASEAN Plus Six Is the Whole Greater than the Sum of the Parts?’. He discussed the current context of the trade and investment landscape in RCEP negotiating countries. He also talked about the potential gains if RCEP could be concluded and the challenges that the negotiating parties will face during the negotiation based on the gap between some of the ASEAN and its Dialogue Partners as evidenced by the existing ASEAN+1 FTAs.

CIL Research Fellow Junianto James Losari was invited by the Economic Research Institute for ASEAN and East Asia to present his research on the investment chapters in various ASEAN + Dialogue Partners Free Trade Agreements (FTAs) in the 1st Workshop on the Regional Comprehensive Economic Partnership (RCEP) which was held on 20-21st May 2015 in Tokyo, Japan. The Workshop was attended by scholars (mostly economists) from various universities in Japan, South Korea, Indonesia, Singapore, and the Philippines. James presented his paper titled, ‘Searching for an Ideal International Investment Protection Regime for ASEAN + Dialogue Partners (RCEP): Where do we Begin?’ The paper conducted a baseline study of various provisions contained in various BITs, regional investment agreements and investment chapters of FTAs among ASEAN and its Dialogue Partners. He also proposed that RCEP should be used as an opportunity to consolidate the existing investment agreements to solve parallelism caused by the spaghetti bowl phenomenon of investment agreements among the negotiating parties. The Workshop is expected to produce a report for RCEP negotiators that can support the negotiating process.

CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to speak at the Regional Arbitral Institutes Forum (RAIF) 2015 on 9 May 2015 at the Kuala Lumpur Regional Centre for Arbitration in Kuala Lumpur, Malaysia. She was part of a 3-member panel on investor-state arbitration, together with Professor Chester Brown of University of Sydney and Mr. Hussein Haeri of Withers LLP (London). Harpreet presented on the “Clash of Bilateralism and Regionalism in International Investment Agreements of ASEAN Member States: What Have We Overlooked?”, examining the overlap in investment treaty protection in existing agreements and why an investor may approach strategically the question of which amongst multiple investment agreements between the same State parties it may proceed in investor-state arbitration. The keynote address was delivered by Singapore’s Attorney-General, Mr. V K Rajah SC, and the conference was hosted by the Malaysian Institute of Arbitrators. The British Institute of International and Comparative Law invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, to be one of the panellists in the 24th Investment Treaty Forum Public Conference, which was held on 8 May 2015 in London, United Kingdom. The theme of this year’s forum was “The European Union’s Investment Treaties in Global Context”. On the panel, “Comparing the Texts-Substantive Protections”, Michael discussed the most-favoured nation (MFN) clause, which has been a subject of controversy in international investment law. He noted that the Investment Chapter of the EU-Singapore Free Trade Agreement does not have an MFN clause, whereas the Investment Chapter of the Canada-EU Free Trade Agreement (CETA) has one that carves out dispute settlement and limits MFN application only to treatment. He then proposed that the necessity of an MFN clause should be re-evaluated in light of States’ attempts to refine their new International Investment Agreements (IIAs), and that National Treatment (NT) and Fair and Equitable Treatment (FET) clauses may be sufficient to address investors’ concerns regarding abuse.

The United Nations Conference on Trade and Development (UNCTAD) invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, as one of a select group of international investment law experts to a Peer Review Meeting for the forthcoming UNCTAD World Investment Report (WIR) 2015. The Meeting was held on 29-30 April 2015 in Geneva, Switzerland. During the Meeting, the experts discussed the issue of International Investment Agreement (IIA) reform and how a holistic approach to IIA should be conceptualised. UNCTAD will include the result of the discussions in the forthcoming WIR 2015.

The Conference was jointly organised by the Centre on Asia and Globalisation of Lee Kuan Yew School of Public Policy, NUS, and the Collaborative Innovation Centre for South China Sea Studies, Nanjing University. CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to speak at the 4th Conference for the Postgraduate and Early Professionals/Academics Network of the Society of International Economic Law on 16 and 17 April 2015 at the University of Milan in Milan, Italy. Harpreet delivered a paper on its Investment Dispute Settlement panel titled “The Makings of the Modern Investor-State Dispute Settlement (ISDS) Provision: the Case-Study of Singapore”, examining and critiquing the evolution of the ISDS provision in Singapore’s international investment agreements. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to speak at the ASEAN Comprehensive Investment Agreement (ACIA) Forum on “Transforming Investment in ASEAN through ACIA”, which was held on 15 April 2015 in Jakarta, Indonesia. He shared his views about how ASEAN could be transformed into an investment hub by the ACIA and the potential benefits of ACIA to Indonesia. He also chaired a session on “The experience of the Indonesian and Third-Country Businesses in Investing in ASEAN”. The speakers of the session included Indonesian business leaders from Indofood, Semen Indonesia and XL Axiata, as well as Mr Rizar Indomo Nazaroedin, Director of Regional Cooperation of the Indonesian Investment Coordination Board (BKPM).

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to train Indonesian government officials during a two-day seminar (15-16 April 2015) on the ASEAN Comprehensive Investment Agreement (ACIA). The theme of the seminar was how ACIA could be used to attract investments to Indonesia.

Dr Hao Duy Phan also judged at the International Round of the 2015 Philip C. Jessup International Law Moot Court Competition, which was held in conjunction with the ASIL Annual Meeting.

The Workshop was organised by the United States Council for Security Cooperation in the Asia Pacific (USCSCAP) in conjunction with the Inter-Sessional Meeting of the ASEAN Regional Forum (ARF) on Maritime Security. The workshop was organised by the Japan Hydrographic Association and the Nippon Foundation. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by Universidad Sergio Arboleda in Colombia to teach in its Madrid campus. The course was attended by Colombian students as part of their course in Masters in International Commerce. The intensive course, which was held on 4-6 March 2015, discussed various aspects of ASEAN Integration and how it contributed to the improvement of the rule of law in the region.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited to the 2015 UNCTAD Expert Meeting on the Transformation of the IIA Regime, held from 25-27 February 2015. This Expert Meeting is the first-of-its-kind conference that brings together multi-stakeholders – treaty negotiators, academics, non-governmental organisations (NGOs) and relevant international organizations, e.g. the Organization for Economic Development (OECD) and the World Trade Organization (WTO) – to discuss and contribute to the transformation of the IIA regime which is currently under scrutiny by various States around the world. Associate Professor Michael Ewing-Chow was appointed as one of the Rapporteurs for the event. Various suggestions to improve the current IIA regime were put forward during the discussions, and the suggestions will be included in the 2015 World Investment Report.

CIL Research Fellow Ms Ranyta Yusran was invited to participate in the Second Conference on the ‘Historical Origin of International Criminal Law’ (HOICL) in New Delhi, India on 29-30 November 2014. Ms Yusran presented a paper that she was invited to contribute entitled ‘Transitional Justice Delayed or Denied? A Case Study of Southeast Asia and Indonesia’. The Conference was organised by the Centre for International Law Research and Policy (CILRAP), the European University Institute and Peking University. CIL Director Professor Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Dr Hao Duy Phan were invited to participate in the 6th South China Sea International Conference on ‘Cooperation for Regional Security and Development’ on 17-18 November 2014 in Da Nang, Viet Nam. The Conference was jointly organised by the Diplomatic Academy of Viet Nam, the Viet Nam Lawyers Association and the East Sea Foundation. Professor Beckman and Dr Phan co-authored a paper on ‘Air Defence Identification Zones: Implications for Freedom of Overflight and Maritime Disputes’. CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow was invited to the Global Georgetown Alumni Academic Program on 11 December 2014 in Singapore to share his views on the ongoing Trans-Pacific Partnership (TPP) negotiations. He suggested that the slow progress must be understood in the context of the differences between the negotiating states, including the rule of law and the economic and social issues within each state. Further, the negotiating states also have different offensive and defensive interests. For example, the United States has an offensive interest in ensuring a better Intellectual Property (IP) regime, while Australia has the opposite. Similarly, Australia, Canada and New Zealand have an offensive interest in agriculture, while Japan seeks to protect this sector. These differences alone pose challenges for the negotiating countries in striking an agreement that can accommodate all their interests. In addition, he shared his view that it is likely that Multinational Companies (MNCs) who operate Global Value Chains (GVCs) will play a greater role in driving the negotiations. Another interesting interplay to watch will be China’s role, as it has announced its interest in joining the TPP.

CIL Research Fellow Dr Zhen Sun was invited to speak at a conference organised by the Joint Institute for Maritime Law and History of International Shipping Law School at East China University of Political Science and Law entitled ‘Maritime Non-Traditional Security Challenges in Asia-Pacific: An Interdisciplinary and Transnational Dialogue on Reconstruction of Legal Order’ on 15 November 2014, in Shanghai, China. More than 50 academics and students attended the Conference. Dr Sun delivered a presentation on ‘Mechanism under the 1988 SUA Convention for Combating Maritime Security Threats’, in which she argued that SUA provides States Parties with quasi-universal criminal jurisdiction over specific offences that threaten the safety of navigation. This may be an effective tool to address non-traditional maritime security threats in Southeast Asia if all States ratify and implement SUA. To download her presentation, click here.

CIL Senior Research Fellow Youna Lyons was invited as a speaker to the pre-conference policy discussions on the implementation of the D-2 regulations on 5 November 2014 in Singapore. In her presentation titled ‘Ballast Water Management Convention: D-1 and D-2 regulations and related compliance issues’, she discussed the circumstances in which Port States may proceed to indicative and detailed samplings and the sanctions that may be imposed by the Port State should the samplings suggest non-compliance with the regulations. On 23 October 2014, as part of CIL’s continuing collaboration with the International Cable Protection Committee (ICPC), CIL, ICPC, George Washington University Law School and the Sargasso Sea Commission, co-sponsored a workshop titled ‘Submarine Cables in the Sargasso Sea – Legal and Environmental Issues Beyond National Jurisdiction’. CIL Global Associate Tara Davenport represented CIL and served as rapporteur at the Workshop. The objective of the Workshop was to start a dialogue between the submarine cable industry and the newly established Sargasso Sea Commission regarding best environmental practices for the laying and repair of cables in the Sargasso Sea. The Workshop brought together government representatives, representatives from the cable industry, academics, scientists and lawyers to discuss the impact that cable operations may have on the marine environment, the ecological sensitivity of the Sargasso Sea and whether any best practices should be adopted to minimise the impact, if any, of cable operations in the Sargasso Sea. CIL Research Associate Junianto James Losari attended an academic conference held jointly by Universitas Pelita Harapan (Indonesia) and Foreign Trade University (Vietnam) in Jakarta on 14-15 October 2014 in cooperation with the World Trade Institute (Switzerland). James presented his paper on ‘Comprehensive or BIT by BIT: ACIA and Indonesia’s BITs’. He criticised the existence of intra-ASEAN BITs (bilateral investment treaties) alongside the ASEAN Comprehensive Investment Agreement (ACIA), which has resulted in dual regimes of investment protection in the region, allowing investors to pick and choose the most favourable standards applicable to them. James offered recommendations for reconciliation of the regimes and preservation of Member States’ regulatory space. The conference was coupled with the launch of UPH’s WTO Chair Programme by the Deputy Director General of the WTO, Mr Yi Xiaozhun and the Ministry of Trade of Indonesia, Mr Muhammad Lutfi. James represented Singapore’s WTO Chair, Prof Michael Ewing-Chow to convey his support and interest for future collaboration with UPH. [Photo from event]

CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow conducted a training session (organised by United Nations Conference on Trade and Development) for Pacific Island (PACER-Plus) countries’ government officials on Investor-State Dispute Settlement (ISDS) and alternative mechanisms to ISDS in Free Trade Agreements (FTAs). He discussed several alternative dispute resolution mechanisms in FTAs, including commercial arbitration, domestic courts, as well as the development of dispute management systems. This was done as part of the preparation for the PACER-Plus negotiations with Australia and New Zealand.

CIL Research Associate Junianto James Losari was invited to speak about the ASEAN Comprehensive Investment Agreement (ACIA) before representatives of various ministries of the Republic of Myanmar as part of a capacity building seminar on investment organised by the Economic Research Institute for ASEAN and East Asia and the Ministry of National Planning and Economic Development (NPED). More than 50 government officials attended this seminar, which was held on 27 September 2014 at Hotel Sedona in Yangon. In his presentation, James emphasised the importance of improving governance and the rule of law in the country, as well as ensuring that Myanmar’s new regulations and policies comply with the ACIA in order to minimise the costly risks of litigation. CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow, assisted by CIL Research Associate Junianto James Losari, taught at the Singapore Ministry of Foreign Affairs Training on Competition Law Policy and Intellectual Property Rights, which was organised by Drew & Napier and attended by twenty-seven government officials from around the world. Professor Ewing-Chow taught ‘Intellectual Property (IP), Technology, Investments & International Economic Law’ where participants learned about policy considerations that may affect States’ interests when entering into negotiations of IP provisions. Through the use of negotiation exercises using hypothetical fact patterns, the participants were tasked with reaching acceptable compromises relating to pharmaceutical products, tobacco plain packaging regulations and other public concerns pertaining to international IP and competition law regimes. Ms Yusran presented a paper that she co-authored with CIL Head of Trade Law and Policy Associate Professor Michael Ewing-Chow entitled ‘If You Build It, They Still Will Not Come: ASEAN Dispute Settlement and Intra-ASEAN Disputes’ in Session 4 of the Conference concerning Dispute Settlement. The Conference was organised by the Lisbon University Law School and the Portuguese branch of the ILA and was attended by legal academics and practitioners from all over Europe. CIL Research Fellow Ranyta Yusran attended the 10th Anniversary Conference of the European Society of International Law (ESIL) in Vienna, Austria, on 4-6 September 2014. This year’s theme was ‘International Law and…’, which highlighted the interrelatedness of international law and other fields of study such as literature, political science, anthropology, feminism, etc. The Conference was attended by more than four hundred legal academics and practitioners from Europe, Central America, the United States, Canada, Asia, the Middle East and Africa. Ms Yusran also attended the first ESIL interest group meeting on international courts and tribunals, which will be the theme of the next ESIL Conference.

CIL Director Robert Beckman participated in the 3rd Maritime Institute of Malaysia (MIMA) South China Sea Conference, entitled ‘Promoting Sustainable Use of the South China Sea in an Era of Dynamic Geostrategic Change’, at the Doubletree Hilton Hotel in Kuala Lumpur from 2-3 September 2014. Professor Beckman gave a paper and made a presentation on ‘UNCLOS Annex VII Arbitration’ in Panel 4 on Dispute Settlement Mechanisms and the South China Sea Disputes. His paper provided a background on UNCLOS Annex VII Arbitration and his oral presentation focused on the Philippines v. China case. Professor Beckman also served as one of three speakers in the final panel on Centering Diplomacy towards achieving a Sustainable and Peaceful South China Sea. CIL Research Associate Zhen Sun participated in the 8th IFLOS Summer Academy at the International Tribunal for the Law of the Sea (ITLOS) from 27 July to 22 August 2014, in Hamburg, Germany. Ms Sun received a partial scholarship from the International Foundation for the Law of the Sea to participate in the Academy. The four-week programme brought together a prestigious faculty to cover important issues on the international law of the sea and maritime law, including ITLOS judges and leading academics and practitioners from the maritime field. There were 41 participants from 33 nations who attended the 2014 Summer Academy. Ms Sun also participated in the moot court competition, where she and her team argued in front of a panel of four judges. Ms Sun’s Certificate was awarded by the Chair of the International Foundation for the Law of the Sea, Ms Doris Konig, during the formal Senate Reception in the Town Hall of the Free and Hanseatic City of Hamburg. CIL Director Robert Beckman taught at the 19th Annual Session of the Rhodes Academy of Oceans Law and Policy, which was held in in Rhodes, Greece. Professor Beckman delivered three lectures on the marine environment during the third week of the Academy and organised a 3-hour workshop on the legal regimes governing seafarers and fishers. He also judged the oral examination at the end of the course, together with three judges from the International Tribunal for the Law of the Sea. In addition, he attended meetings with other members of the Board of Directors of the Academy. CIL sponsored three participants to the 2014 Rhodes Academy: Ms Lusitania Lopez of Timor Leste, Mr Dara In of Cambodia and Mr Chen Li of China. Two Singaporeans who attended the Academy, Luke Tang of the Attorney-General’s Chambers and Kenneth Kwa of the Ministry of Foreign Affairs, won prizes for being the top students in the written examination.

CIL Research Fellow Leonardo Bernard participated in the Summer Academy on the Continental Shelf, held at Torshavn, Faroe Islands on 21-28 June 2014. The Academy was organized by the University of the Faroe Islands. The Academy focused on the intricate legal and technical conditions governing the entitlement to and establishment of the continental shelf beyond 200 nautical miles, and on the delimitation of overlapping entitlements to such areas.

CIL Research Associate Zhen Sun participated in the Second Asia Pacific Ocean Law Institutions Alliance (APOLIA) Conference, ‘After 20 Years of Implementation of UNCLOS by Asian Pacific States’, from 20-21 June 2014. The Conference was organised by the Centre for Ocean Law and Governance, Zhejiang University and the Korea Maritime Institute. Zhen delivered a presentation on Singapore’s implementation of UNCLOS, where she addressed the issues of Singapore’s international boundaries with its neighbouring countries and Singapore’s practice regarding IMO conventions. She also participated as a discussant at the International Symposium on ‘Sustainable Development and the Law of the Sea’ from 22-23 June 2014.

CIL Head of International Trade and Law Professor Michael Ewing-Chow and CIL Research Associate Junianto James Losari met with ERIA Researchers, Mr. Yoshifumi Fukunaga, Ms. Lili Yan Ing, and Mr. Chandra Tri Putra to discuss ERIA’s baseline study of various investment agreements among the countries involved in the Regional Comprehensive Economic Partnership (RCEP) negotiations. The discussion focused on creating baseline study indicators to assess commitments on liberalisation and protection, the creation of which will provide useful information for negotiators of the RCEP.

More than 300 participants attended the seminar, including government officials from various institutions in Indonesia, academics, and members of the media and business community. He is a co-editor of the Symposium proceedings under the general editorship of Sir Jeffrey Jowell. Hao Duy Phan delivered a presentation on “Treaty-Making and the Status of Treaties in ASEAN Member States: An Overview”. The Workshop was jointly organized by the Ministry of Law and Human Rights, Ministry of Foreign Affairs of Indonesia and the ASEAN Secretariat (ASEC). CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow along with CIL’s RA Junianto James Losari were invited to attend the first Forum on International Trade and Investment (FORTRIN) meeting. Former WTO Deputy Director General Alejandro Jara, now with King & Spalding hosted the meeting. Michael and James attended by videoconference from the King & Spalding office in New York, together with Prof. Karl Sauvant of the Vale Centre of Columbia University. The meeting was attended trade and investment experts from Geneva, London, Paris, Washington DC, and New York all linked by videoconference. FORTRIN aims to provide a platform to promote the application and development of trade and investment rules with a view to bolstering the global legal framework for international economic law activity. During the first meeting, the discussion revolved around how to frame the issues of current investment rules. This is an important foundation if a multilateral approach on investment rules were to be proposed. In his intervention, Prof. Michael Ewing-Chow suggested a way to contextualize the current issues by looking through the global value chains lens, as governments will be more interested in exploring further the idea of multilateral investment agreement if they can be more integrated to the value chains. The discussion also touched upon several challenges to this effort, among others: the growing reluctance of governments in being subjected to Investor-State Dispute Settlement (ISDS), the need for a better fact-finding procedure in international arbitration, the need to address burning issues such as abusive treaty shopping, and the need to educate the stakeholders, including the civil society. Preparations are required to deal with these matters before one can move towards creating a multilateral investment framework.

CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow and CIL’s RA Junianto James Losari were invited by the DC Bar’s International Dispute Resolution Committee to attend a lunchtime panel discussion on “Changes in the System of Investor-State Dispute Settlement: Viewpoints from the Americas” that was held on 10 April 2014 at the office of Arnold & Porter LLP in Washington DC. The panelists (Anna Joubin-Bret, Jonathan S. Kallmer, and Omar Garcia-Bolivar) presented their findings of the current state of development in investor-state dispute settlement (ISDS) in both North America and South America. Michael and James were invited to share their views on the developments in Asia and in particular ASEAN and Asia. During the discussion that was moderated by Jean Kalicki, various innovations were mentioned on how countries sought to improve the current legal frameworks. These innovations are to be implemented both at domestic and international levels and could be considered as fresh ideas for currently ongoing IIAs negotiations, including the Trans-Pacific Partnership and the Transatlantic Trade and Investment Partnership. Michael said that the ASEAN Comprehensive Investment Agreement (ACIA) has introduced several innovations, making it a more balanced agreement both in terms of investor protection and preserving the governments’ policy space. Separately, James queried whether there was any plans to consolidate agreements in the Americas, given that Asia has plans to do so under the Regional Comprehensive Economic Partnership (RCEP) negotiation.

Professor Joseph Weiler, Director of the CIL ASEAN Integration Through Law Project (President of the European University Institute; NUS Law School; and University Professor at the NYU School of Law (on-leave)) convened and chaired the discussions on the ASEAN Economic Community at Plenary 4 of the ASEAN Integration Through Law Project: The ASEAN Economic Community at the Sofitel Plaza Hotel, Hanoi, Vietnam. CIL senior expert, Professor Michael-Ewing-Chow, shared his work on the ASEAN economic integration and investment regime. CIL Director Robert Beckman served as the coordinator and main lecturer in an International Law Course CIL conducted for government officials from more than 20 countries. The course was conducted under the auspices of the Singapore Cooperation Program of the Ministry of Foreign Affairs. Prof Beckman made presentations and led discussions in 14 sessions of 90 minutes each over the 5-day course. Assoc Prof Michael Ewing-Chow and Christopher Thomas also made presentations. CIL Research Fellow Ranyta Yusran played a major role in organising the course and the course materials. CIL Research Fellows Hao Duy Phan and Leonardo Bernard also led discussions at the course.

The symposium was organised by the Maritime and Port Authority of Singapore (MPA), the Norwegian Embassy and the Singapore Maritime Institute (SMI). The keynote speaker was Else Berit Eikeland, Norway’s senior Arctic official in the Norwegian Ministry of Foreign Affairs. The International Economic Law and Policy (IELPO) LL.M Programme of the Universidad de Barcelona invited CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow for the second consecutive year to teach ‘Regionalism in Asia’ as part of their programme. The course was held on 10-11 March 2014 and focused on the unique features of Asian Regionalism, with an emphasis on the trade and investment aspects of the Association of South East Asian Nations (ASEAN).

The conference was held at the Orchard Hotel, Singapore. Prof Tommy Koh and Prof S Jayakumar served as co-chairs of the conference. CIL Director Robert Beckman presented a paper on ‘State Responsibility for Transboundary Marine Pollution’, CIL Senior Research Fellow Youna Lyons presented a paper on ‘Transboundary Pollution from Offshore Activities: A Study of the Montara Offshore Oil Spill’, and Prof Alan Tan presented a paper on ‘Co-operative and Unilateral Mechanisms to Combat Forest Fires and Transboundary Haze’ in Southeast Asia. CIL Senior Research Fellow Hao Duy Phan played a major role in organising the Conference.
