CIL Senior Research Fellow Youna Lyons was invited by the Ministry of Foreign Affairs of the Philippines as a presenter in a side event they organised on UNCLOS and the protection of the marine environment during the Meeting of the States Parties to the Law of the Sea Convention, at the United Nations Headquarters in New York, on 10 June 2015. CIL Research Fellow Dr Zhen Sun participated in the Conference on ‘The European Union and the Arctic’ on 29-30 May 2015, at the University of Dundee, Dundee, United Kingdom. The Conference was jointly organised by the University of Dundee and the University of Tromso. At the Conference, Dr. Sun made a presentation on ‘The Interests and Potential Roles of Observers in the Arctic Council – In the Context of Marine Environmental Protection’. CIL Director Robert Beckman and CIL Research Fellow Leonardo Bernard participated at the 2015 ILA – ASIL Asia-Pacific Research Forum on 25-26 May 2015 in Taipei, Taiwan. The Research Forum was organised by the Chinese (Taiwan) Society of International Law – Chinese (Taiwan) Branch of the International Law Association, in cooperation with the American Society of International Law and Research Center for International Legal Studies, National Chengchi University. Prof Beckman was part of the panel on Law of the Sea: South China Sea, where he presented on the Philippines v China Case and Maritime Disputes in the South China Sea. CIL Researchers Leonardo Bernard, Harpreet Kaur Dillon, Hao Duy Phan, Sun Zhen and Ranyta Yusran participated in the 12th Annual Asian Law Institute Conference – “Law 2.0: New Challenges in Asia” on 21-22 May 2015 in Taipei, Taiwan. The Conference was jointly organised by the National University of Taiwan and the Asian Law Institute. At the Conference, CIL researchers made various presentations on different topics of international law and chaired different panels. Dr Zhen Sun and Mr Leonardo Bernard spoke at a panel on international law with a particular focus on the law of the sea. Dr Zhen Sun made a presentation on “A Hot Land in A Cold Place: Opportunities and Challenges for Singapore in the Arctic” (download in PDF) and Mr Leonardo Bernard made a presentation on “Historic Fishing Rights and the EEZ” (download in PDF). Dr Hao Duy Phan and Ms Harpreet Dhillon participated in two different panels on international law and spoke about “ASEAN’s Legal Personality and its Treaty-Making Power” (download in PDF) and “Consolidation of Claims Arising under an International Investment Agreement: What is at Stake?” (download in PDF) respectively. Ms Ranyta Yusran was a panellist at the panel on cross-border issues. She made a presentation on “Mapping the ASEAN Framework on Transnational Crime” (download in PDF).

CIL Senior Research Fellow Dr Hao Duy Phan was invited to speak at the Workshop on Maritime Security and the Marine Environment on 30 March 2015 in Honolulu, Hawaii, USA. Hao Duy Phan delivered a presentation on ‘Global Regimes for Protection and Preservation of the Marine Environment: An Overview’. The Workshop was organised by the United States Council for Security Cooperation in the Asia Pacific (USCSCAP) in conjunction with the Inter-Sessional Meeting of the ASEAN Regional Forum (ARF) on Maritime Security. CIL Director Professor Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Dr Hao Duy Phan were invited to participate in the 6th South China Sea International Conference on ‘Cooperation for Regional Security and Development’ on 17-18 November 2014 in Da Nang, Viet Nam. The Conference was jointly organised by the Diplomatic Academy of Viet Nam, the Viet Nam Lawyers Association and the East Sea Foundation. Professor Beckman and Dr Phan co-authored a paper on ‘Air Defence Identification Zones: Implications for Freedom of Overflight and Maritime Disputes’. CIL Director Robert Beckman gave a presentation at a Conference on ‘Energy Security in Southeast Asia: Implications and Concerns’. The conference was organised by the NUS Energy Studies Institute and held at the Carlton Hotel in Singapore. Professor Beckman participated in the panel on Maritime Disputes and Tensions in Southeast Asia. The title of his presentation was International Law and the South China Sea Disputes.

CIL Research Fellow Dr Zhen Sun was invited to speak at a conference organised by the Joint Institute for Maritime Law and History of International Shipping Law School at East China University of Political Science and Law entitled ‘Maritime Non-Traditional Security Challenges in Asia-Pacific: An Interdisciplinary and Transnational Dialogue on Reconstruction of Legal Order’ on 15 November 2014, in Shanghai, China. More than 50 academics and students attended the Conference. Dr Sun delivered a presentation on ‘Mechanism under the 1988 SUA Convention for Combating Maritime Security Threats’, in which she argued that SUA provides States Parties with quasi-universal criminal jurisdiction over specific offences that threaten the safety of navigation. This may be an effective tool to address non-traditional maritime security threats in Southeast Asia if all States ratify and implement SUA. To download her presentation, click here.

CIL Senior Research Fellow Youna Lyons was invited as a speaker to the pre-conference policy discussions on the implementation of the D-2 regulations on 5 November 2014 in Singapore. In her presentation titled ‘Ballast Water Management Convention: D-1 and D-2 regulations and related compliance issues’, she discussed the circumstances in which Port States may proceed to indicative and detailed samplings and the sanctions that may be imposed by the Port State should the samplings suggest non-compliance with the regulations. The discussion was based on the language of the Convention, as well as the new Port State Control Guidelines adopted at MEPC 67. To view her presentation, click here.

CIL Director Robert Beckman gave two lectures at the Ministry of National Defence of Viet Nam in Ha Noi on 23 October 2014. He was received by Deputy Minister of Defence and Navy Command Admiral Nguyen Van Hien. He also delivered a presentation at the Diplomatic Academy of Viet Nam on 24 October 2014. The lectures were on UNCLOS and the South China Sea.

On 23 October 2014, as part of CIL’s continuing collaboration with the International Cable Protection Committee (ICPC), CIL, ICPC, George Washington University Law School and the Sargasso Sea Commission, co-sponsored a workshop titled ‘Submarine Cables in the Sargasso Sea – Legal and Environmental Issues Beyond National Jurisdiction’. CIL Global Associate Tara Davenport represented CIL and served as rapporteur at the Workshop. The objective of the Workshop was to start a dialogue between the submarine cable industry and the newly established Sargasso Sea Commission regarding best environmental practices for the laying and repair of cables in the Sargasso Sea. The Workshop brought together government representatives, representatives from the cable industry, academics, scientists and lawyers to discuss the impact that cable operations may have on the marine environment, the ecological sensitivity of the Sargasso Sea and whether any best practices should be adopted to minimise the impact, if any, of cable operations in the Sargasso Sea. CIL Director Robert Beckman participated in the 3rd Maritime Institute of Malaysia (MIMA) South China Sea Conference, entitled ‘Promoting Sustainable Use of the South China Sea in an Era of Dynamic Geostrategic Change’, at the Doubletree Hilton Hotel in Kuala Lumpur from 2-3 September 2014. Professor Beckman gave a paper and made a presentation on ‘UNCLOS Annex VII Arbitration’ in Panel 4 on Dispute Settlement Mechanisms and the South China Sea Disputes. His paper provided a background on UNCLOS Annex VII Arbitration and his oral presentation focused on the Philippines v. China case. Professor Beckman also served as one of three speakers in the final panel on Centering Diplomacy towards achieving a Sustainable and Peaceful South China Sea. CIL Research Associate Zhen Sun participated in the 8th IFLOS Summer Academy at the International Tribunal for the Law of the Sea (ITLOS) from 27 July to 22 August 2014, in Hamburg, Germany. Ms Sun received a partial scholarship from the International Foundation for the Law of the Sea to participate in the Academy. The four-week programme brought together a prestigious faculty to cover important issues on the international law of the sea and maritime law, including ITLOS judges and leading academics and practitioners from the maritime field. There were 41 participants from 33 nations who attended the 2014 Summer Academy. Ms Sun also participated in the moot court competition, where she and her team argued in front of a panel of four judges. Ms Sun’s Certificate was awarded by the Chair of the International Foundation for the Law of the Sea, Ms Doris Konig, during the formal Senate Reception in the Town Hall of the Free and Hanseatic City of Hamburg. CIL Director Professor Robert Beckman and CIL Senior Research Fellow Dr. Hao Duy Phan were invited to participate in the Conference on ‘Legal Issues regarding China’s Placement of the Oil Rig Haiyang Shiyou 981 in Viet Nam’s Exclusive Economic Zone and Continental Shelf’ in Ho Chi Minh City, Viet Nam. The Conference was organised jointly by the Ho Chi Minh City University of Law and the Viet Nam Lawyers Association. Professor Beckman made a presentation on the Dispute Settlement regime under the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and Implications for the Disputes between Viet Nam and China. CIL Director Robert Beckman taught at the 19th Annual Session of the Rhodes Academy of Oceans Law and Policy, which was held in in Rhodes, Greece. Professor Beckman delivered three lectures on the marine environment during the third week of the Academy and organised a 3-hour workshop on the legal regimes governing seafarers and fishers. He also judged the oral examination at the end of the course, together with three judges from the International Tribunal for the Law of the Sea. In addition, he attended meetings with other members of the Board of Directors of the Academy. CIL sponsored three participants to the 2014 Rhodes Academy: Ms Lusitania Lopez of Timor Leste, Mr Dara In of Cambodia and Mr Chen Li of China. Two Singaporeans who attended the Academy, Luke Tang of the Attorney-General’s Chambers and Kenneth Kwa of the Ministry of Foreign Affairs, won prizes for being the top students in the written examination.

The title of the Conference was ‘Challenges of the Changing Arctic: Continental Shelf, Navigation, and Fisheries’. CIL Research Fellow Leonardo Bernard participated in the Summer Academy on the Continental Shelf, held at Torshavn, Faroe Islands on 21-28 June 2014. The Academy was organized by the University of the Faroe Islands. The Academy focused on the intricate legal and technical conditions governing the entitlement to and establishment of the continental shelf beyond 200 nautical miles, and on the delimitation of overlapping entitlements to such areas.

CIL Research Associate Zhen Sun participated in the Second Asia Pacific Ocean Law Institutions Alliance (APOLIA) Conference, ‘After 20 Years of Implementation of UNCLOS by Asian Pacific States’, from 20-21 June 2014. The Conference was organised by the Centre for Ocean Law and Governance, Zhejiang University and the Korea Maritime Institute. Zhen delivered a presentation on Singapore’s implementation of UNCLOS, where she addressed the issues of Singapore’s international boundaries with its neighbouring countries and Singapore’s practice regarding IMO conventions. She also participated as a discussant at the International Symposium on ‘Sustainable Development and the Law of the Sea’ from 22-23 June 2014.

CIL Director Robert Beckman and CIL Research Associate Monique Page attended a CSCAP Experts Group Meeting on Security of Vital Undersea Communications Infrastructure on Monday 17 February in Jakarta. On Tuesday 18 February they will be attending a meeting of the CSCAP Study Group on Maritime Security. CSCAP is Council for Security Cooperation in the Asia Pacific (CSCAP). The Study Group is co-chaired by CSCAP Singapore, CSCAP Indonesia and CSCAP New Zealand. Prof Beckman will be making presentations at both of the meetings. On 5 April 2013 CIL research staff had a roundtable discussion on the South China Sea Disputes with research staff of the Center for Strategic and International Studies (CSIS) at their offices in Washington. The CIL delegation included CIL Director Robert Beckman, CIL researchers Tara Davenport and Leo Bernard, and Ambassador Arif Havas Oegroseno of Indonesia, a member of CIL International Advisory Panel. Prof Beckman began the discussion with a brief presentation, and it was followed by a general discussion. The CIL researchers were in Washington DC to attend the Annual Meeting of the American Society of International Law. The roundtable discussion was arranged by Murray Hiebert, Deputy Director and Senior Fellow in the Southeast Asia Program at CSIS.

CIL Director Robert Beckman made a presentation titled “Role of ASEAN and the Philippines v China Case” on 4 April 2013 at the 107th Annual Meeting of the American Society of International Law in Washington DC. Prof Beckman served on a Panel on Legal Solutions to Maritime Disputes in Asia, and he spoke about the South China Sea Disputes. The other members of the panel were Rosalyn Higgins, past President of the International Court of Justice; Loretta Malintoppi, Eversheds LLP Paris; and Galo Carrera Hurtado, Member of the Commission on the Limits of the Continental Shelf. CIL Research Fellow Leonardo Bernard participated at the Conference on Global Ocean Issues and Challenges on 9 September 2013 in Dankook University, Korea. The Conference was organized by the Wooseok Institute of Korean Territory Studies, Dankook University in cooperation with the Korea Institute of Maritime Strategy and SLOC Study Group-Korea. Leo spoke on Cooperative Mechanism in the Straits of Malacca and Singapore, which addressed issues associated with current state of maritime cooperation under Article 43 of UNCLOS. Leo was also invited to attend the Conference celebrating the 60th Anniversary of the Korea Coast Guard on 11 September 2013 at Incheon, Korea.

CIL participated in the 18th session of the Rhodes Academy of Oceans Law and Policy in Rhodes, Greece as a full sponsor, together with the Center for Oceans Law and Policy, University of Virginia School of Law (Charlottesville, USA); the Aegean Institute of the Law of the Sea and Maritime Law (Rhodes, Greece); the Law of the Sea Institute of Iceland (Reykjavik, Iceland); the Max Planck Institute for Comparative Public Law and International Law (Heidelberg, Germany); and The Netherlands Institute for the Law of the Sea, Utrecht University (Utrecht, The Netherlands). CIL Director Robert Beckman lectured at the Academy, where he delivered three seminars on ship-source pollution, non ship-source pollution and the South China Sea disputes and co-supervised a workshop on the international regulation of shipping. He also served as one of the four examiners for the oral examination at the end of the course, together with Judges Wolfrum, Cot and Golitsyn from the International Tribunal for the Law of the Sea. CIL Research Fellow Dr Hao Duy Phan won the Best Oralist Award at the Academy. CIL sponsored a Panel at the 107th Annual Meeting of the American Society of International Law (ASIL) in Washington DC on 5 April 2013, titled Challenges for ASEAN: The South China Sea, Investment Protection and Myanmar”. Prof Michael Ewing-Chow opened the Panel with discussion on ASEAN legalization, institutionalization and economic law issues facing ASEAN, followed by Ambassador Arif Havas Oegroseno who talked about ASEAN and the South China Sea disputes. CIL’s Research Fellow Tara Davenport then talked about the approach of ASEAN Member States in negotiating and settling maritime boundaries (download her presentation in PDF format). Finally, CIL’s Senior Research Fellow Dr Tan Hsien-Li closed the Panel with a discussion of ASEAN’s approach to the human rights situation in Myanmar. The Panel was chaired by Edmund Sim of Appleton & Luff, and co-sponsored by the ASIL Law in Pacific Rim Interest Group and the ASIL International Economic Law Interest Group.

CSCAP is the Council for Security Cooperation in the Asia Pacific. The session was jointly organised by the Singapore Maritime Foundation (SMF) and General Insurance Association (GIA). Prof Beckman was one two speakers. CIL Director Robert Beckman participated in an International Symposium on “The East China Sean and the Law of the Sea: Defusing Tensions and Enhancing Cooperation” from 21-22 August at Zhejiang University in Hangzhou, China. Prof Beckman presented a paper on “Non-living Resources in Disputed Areas in the East China Sea: Law and Policy Issues concerning Provisional Arrangements under Articles 74 and 83” which he co-authored with CIL Research Fellow Tara Davenport. Prof Beckman also served as a moderator for one session and a discussant in another session. Prof Beckman also delivered a congratulatory address at a ceremony establishing the Zhejiang University Centre for Ocean Law and Governance. CIL Director Robert Beckman delivered four lectures on the South China Sea at the Diplomatic Academy of Vietnam (DAV) in Hanoi on 9 and 10 August 2012. CIL Research Associate Leonardo Bernard participated in the 6th Summer Academy at the International Tribunal of the Law of the Sea on 22 July – 18 August 2012, in Hamburg, Germany. Mr Bernard received a partial scholarship from the International Foundation for the Law of the Sea to participate in this year’s Summer Academy. Mr Bernard and his team also managed to win the moot court competition, where he had to argue a maritime boundary delimitation case in front of a panel of judges presided by Judge H. Turk. The award was presented by the Chair of the International Foundation for the Law of the Sea, Doris Konig, during the formal Senate Reception in the Town Hall of the Free and Hanseatic City of Hamburg. On Sunday 1st July at 10.30pm, CIL Director Robert Beckman participated in a panel discussion on the South China Sea disputes on World Insight, an in-depth news analysis program on the English language channel of China Central Television (CCTV). Prof Beckman participated from a studio in Singapore. The programme was broadcast live in Singapore.

CIL Patron Prof S Jayakumar, CIL Director Robert Beckman and CIL Senior Research Fellow Youna Lyons participated in the 36th Annual Conference of the Center for Oceans Law and Policy (COLP) In Halifax, Nova Scotia, from 21-22 June 2012. Prof S Jayakumar delivered the Opening Address at the Conference with a paper entitled “The Continental Shelf Regime under the UN Convention on the Law of the Sea: Reflections after Thirty Years”. CIL sponsored a panel at the Conference on the Decommissioning of Offshore Installations and Structures. The Workshop was co-organized by CSIS, the Malaysian Institute of Defense and Security (MiDAS) and the Malaysian International Affairs Forum (MIAF). Prof Beckman gave a presentation on “Resolution of Disputes in the South China Sea” (download in PDF). Research Fellow Dr Lin Lin and Research Associates Ranyta Yusran and Sanjay Pala Krishnan participated in the 9th Asian Law Institute (ASLI) Conference held at the NUS Bukit Timah Campus from 31 May to 1 June 2012. In the first panel on Corporate Law & Governance, Dr Lin Lin presented on “The Evolution of Partnerships and Partnership Law in China: From the Perspective of Asset Partitioning”. Ranyta Yusran opened the first panel on International & Comparative Law by discussing “ASEAN Treaty Practice: Mapping out the Unknown”.
