CIL Director Robert Beckman presented lectures on 8 and 11 May 2015 on the law of the sea to the participants in the RSIS Command Staff College Course in Maritime Security Studies at S Rajaratnam School of International Studies, Nanyang Technological University, Singapore.

The British Institute of International and Comparative Law invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, to be one of the panellists in the 24th Investment Treaty Forum Public Conference, which was held on 8 May 2015 in London, United Kingdom. The theme of this year’s forum was “The European Union’s Investment Treaties in Global Context”. On the panel, “Comparing the Texts-Substantive Protections”, Michael discussed the most-favoured nation (MFN) clause, which has been a subject of controversy in international investment law. He noted that the Investment Chapter of the EU-Singapore Free Trade Agreement does not have an MFN clause, whereas the Investment Chapter of the Canada-EU Free Trade Agreement (CETA) has one that carves out dispute settlement and limits MFN application only to treatment. He then proposed that the necessity of an MFN clause should be re-evaluated in light of States’ attempts to refine their new International Investment Agreements (IIAs), and that National Treatment (NT) and Fair and Equitable Treatment (FET) clauses may be sufficient to address investors’ concerns regarding abuse.

The United Nations Conference on Trade and Development (UNCTAD) invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, as one of a select group of international investment law experts to a Peer Review Meeting for the forthcoming UNCTAD World Investment Report (WIR) 2015. The Meeting was held on 29-30 April 2015 in Geneva, Switzerland. During the Meeting, the experts discussed the issue of International Investment Agreement (IIA) reform and how a holistic approach to IIA should be conceptualised. UNCTAD will include the result of the discussions in the forthcoming WIR 2015.

CIL Director Robert Beckman and CIL Visiting Research Fellow Captain J Ashley Roach attended the annual Plenary Meeting of the International Cable Protection Committee (ICPC) in Hong Kong from 28-30 April 2015. CIL Research Fellow Denise Cheong was invited to speak at the Workshop on “National Ocean Environmental Contingency Plan in Asian Pacific States” on 27 April 2015 in Busan, Korea where she delivered a presentation on “National Ocean Environmental Contingency Plan in Asian Pacific States: The Singapore Perspective”. The Workshop was organised by Development of International Law in Asia (DILA-Asia) and The Institute for Legal Studies of INHA University, Korea. CIL Director Robert Beckman presented a paper at the 2nd Conference on the South China Sea at Nanjing University in Nanjing, China on 24-25 April 2015. The Conference was jointly organised by the Centre on Asia and Globalisation of Lee Kuan Yew School of Public Policy, NUS, and the Collaborative Innovation Centre for South China Sea Studies, Nanjing University. CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to speak at the 4th Conference for the Postgraduate and Early Professionals/Academics Network of the Society of International Economic Law on 16 and 17 April 2015 at the University of Milan in Milan, Italy. Harpreet delivered a paper on its Investment Dispute Settlement panel titled “The Makings of the Modern Investor-State Dispute Settlement (ISDS) Provision: the Case-Study of Singapore”, examining and critiquing the evolution of the ISDS provision in Singapore’s international investment agreements. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to speak at the ASEAN Comprehensive Investment Agreement (ACIA) Forum on “Transforming Investment in ASEAN through ACIA”, which was held on 15 April 2015 in Jakarta, Indonesia. He shared his views about how ASEAN could be transformed into an investment hub by the ACIA and the potential benefits of ACIA to Indonesia. He also chaired a session on “The experience of the Indonesian and Third-Country Businesses in Investing in ASEAN”. The speakers of the session included Indonesian business leaders from Indofood, Semen Indonesia and XL Axiata, as well as Mr Rizar Indomo Nazaroedin, Director of Regional Cooperation of the Indonesian Investment Coordination Board (BKPM).

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to train Indonesian government officials during a two-day seminar (15-16 April 2015) on the ASEAN Comprehensive Investment Agreement (ACIA). The theme of the seminar was how ACIA could be used to attract investments to Indonesia.

CIL Director Professor Robert Beckman was invited to speak in a panel discussion on “ASEAN Integration: An Economic Community in 2015?” organised by the Asia Foundation in Washington DC on 8 April 2015. The other two speakers on the panel were Edmund W. Sim, CIL Global Associate, Partner, Appleton Luff and Natalie Y. Morris-Sharma, Counsellor, Permanent Mission of Singapore to the UN, who presented the books that they co-authored in the CIL ASEAN Integration Through Law (ASEAN ITL) Series published by Cambridge University Press: The Foundation of the ASEAN Economic Community – An Institutional and Legal Profile by Stefano Inama and Edmund W. Sim and From Treaty-Making to Treaty-Breaking – Models for ASEAN External Trade Agreements.

CIL Director Robert Beckman, CIL Senior Research Fellow Dr Hao Duy Phan, CIL Research Fellows Dr Sun Zhen, Leonardo Bernard and Junianto James Losari attended the 109th Annual Meeting of the American Society of International Law (ASIL) in Washington DC on 8-11 April 2015. Dr Hao Duy Phan also judged at the International Round of the 2015 Philip C. Jessup International Law Moot Court Competition, which was held in conjunction with the ASIL Annual Meeting.

CIL Director Robert Beckman gave a talk at Yale Law School on 7 April 2015 on International Law and the South China Sea Disputes.

CIL Senior Research Fellow Dr Hao Duy Phan was invited to speak at the Workshop on Maritime Security and the Marine Environment on 30 March 2015 in Honolulu, Hawaii, USA. Hao Duy Phan delivered a presentation on ‘Global Regimes for Protection and Preservation of the Marine Environment: An Overview’. The Workshop was organised by the United States Council for Security Cooperation in the Asia Pacific (USCSCAP) in conjunction with the Inter-Sessional Meeting of the ASEAN Regional Forum (ARF) on Maritime Security. CIL Director Robert Beckman and CIL Senior Visiting Research Fellow Lynn Kuok participated in a two-day workshop co-organised by the National Institute for South China Sea Studies entitled “South China Sea: Duel Track Approach and Win-Win Cooperation” on 28-29 March 2015 in Hainan, China. Prof Beckman made a presentation in a panel on International Cooperation in Enclosed and Semi-Enclosed Seas. The Workshop was attended by Chinese Government officials and by scholars from China, Taiwan, Southeast Asia, Australia, Canada, the United States and Sweden. CIL Research Fellow Leonardo Bernard presented at the International Workshop on the Legal Aspects of the Establishment of the Outer Limits of the Continental Shelf, held in Tokyo, Japan on 26-27 March 2015. The workshop was organised by the Japan Hydrographic Association and the Nippon Foundation. Leo was part of the third session on the Legal Regime of the Continental Shelf – Regional Experience, where he presented an overview of the maritime claims in the South China Sea. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited to speak on “The ASEAN Way to Interpret Integration” at the Asian Legal Business ASEAN Integration Summit on 26 March 2015 in Singapore.

CIL Research Fellow Leonardo Bernard participated in the International Seminar on Maritime Security in East Asia, held in Jakarta, Indonesia on 17 March 2015. The seminar was organised by the Centre for Strategic and International Studies, Jakarta. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by IELPO LL.M Programme to teach the course of Regionalism in Asia. The course, which was held on 12-13 March 2015, engaged the students in interactive discussions on Asia’s experience in economic integration, particularly the Southeast Asian States within the ASEAN.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by Universidad Sergio Arboleda in Colombia to teach in its Madrid campus. The course was attended by Colombian students as part of their course in Masters in International Commerce. The intensive course, which was held on 4-6 March 2015, discussed various aspects of ASEAN Integration and how it contributed to the improvement of the rule of law in the region.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited to the 2015 UNCTAD Expert Meeting on the Transformation of the IIA Regime, held from 25-27 February 2015. This Expert Meeting is the first-of-its-kind conference that brings together multi-stakeholders – treaty negotiators, academics, non-governmental organisations (NGOs) and relevant international organizations, e.g. the Organization for Economic Development (OECD) and the World Trade Organization (WTO) – to discuss and contribute to the transformation of the IIA regime which is currently under scrutiny by various States around the world. Associate Professor Michael Ewing-Chow was appointed as one of the Rapporteurs for the event. Various suggestions to improve the current IIA regime were put forward during the discussions, and the suggestions will be included in the 2015 World Investment Report.

CIL Head of Trade and Investment Law and Policy and Singapore’s WTO Chair, Prof. Michael Ewing-Chow and CIL Research Fellow, Junianto James Losari were invited for the third time to teach Investment Law at the Masters in Trade, Investment and Competition Law & Policy Program of Universitas Pelita Harapan in Jakarta, Indonesia. The intensive course was held on 9-13 February 2015.

CIL Senior Research Fellow Dr Hao Duy Phan, CIL Research Fellows Leonardo Bernard and Junianto James Losari and CIL Research Associate Harpreet Kaur Dhillon participated in the World Congress on International Law, held in New Delhi, India, from 9 to 11 January 2015. Organised by the Indian Society of International Law, the programme covered a wide range of areas in international law and practice. CIL Research Fellow Ms Ranyta Yusran was invited to participate in the Second Conference on the ‘Historical Origin of International Criminal Law’ (HOICL) in New Delhi, India on 29-30 November 2014. Ms Yusran presented a paper that she was invited to contribute entitled ‘Transitional Justice Delayed or Denied? A Case Study of Southeast Asia and Indonesia’. The Conference was organised by the Centre for International Law Research and Policy (CILRAP), the European University Institute and Peking University. The Conference proceedings will be published in the last instalment of CILRAP’s trilogy on the HOICL. CIL Director Professor Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Dr Hao Duy Phan were invited to participate in the 6th South China Sea International Conference on ‘Cooperation for Regional Security and Development’ on 17-18 November 2014 in Da Nang, Viet Nam. The Conference was jointly organised by the Diplomatic Academy of Viet Nam, the Viet Nam Lawyers Association and the East Sea Foundation. Professor Beckman and Dr Phan co-authored a paper on ‘Air Defence Identification Zones: Implications for Freedom of Overflight and Maritime Disputes’. CIL Director Robert Beckman gave a presentation at a Conference on ‘Energy Security in Southeast Asia: Implications and Concerns’. The conference was organised by the NUS Energy Studies Institute and held at the Carlton Hotel in Singapore. Professor Beckman participated in the panel on Maritime Disputes and Tensions in Southeast Asia. The title of his presentation was International Law and the South China Sea Disputes.

Senior Principal Research Fellow Christopher Thomas QC gave a speech at the 2014 Singapore International Arbitration Centre (SIAC) Congress on “Investment treaty arbitration: Just another form of commercial arbitration?” as part of the Closing Plenary Session on “Investment Treaty Arbitration in Asia: The meeting of international commercial arbitration and public international law”.

Senior Principal Research Fellow Christopher Thomas QC taught a two-day intensive training course for Ministry of Trade and Industry (MTI) officials on dispute settlement under international investment agreements. This was the second part to a three-day intensive course taught in November 2013.

CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow was invited to the Global Georgetown Alumni Academic Program on 11 December 2014 in Singapore to share his views on the ongoing Trans-Pacific Partnership (TPP) negotiations. He suggested that the slow progress must be understood in the context of the differences between the negotiating states, including the rule of law and the economic and social issues within each state. Further, the negotiating states also have different offensive and defensive interests. For example, the United States has an offensive interest in ensuring a better Intellectual Property (IP) regime, while Australia has the opposite. Similarly, Australia, Canada and New Zealand have an offensive interest in agriculture, while Japan seeks to protect this sector. These differences alone pose challenges for the negotiating countries in striking an agreement that can accommodate all their interests. In addition, he shared his view that it is likely that Multinational Companies (MNCs) who operate Global Value Chains (GVCs) will play a greater role in driving the negotiations. Another interesting interplay to watch will be China’s role, as it has announced its interest in joining the TPP.

CIL Research Fellow Dr Zhen Sun was invited to speak at a conference organised by the Joint Institute for Maritime Law and History of International Shipping Law School at East China University of Political Science and Law entitled ‘Maritime Non-Traditional Security Challenges in Asia-Pacific: An Interdisciplinary and Transnational Dialogue on Reconstruction of Legal Order’ on 15 November 2014, in Shanghai, China. More than 50 academics and students attended the Conference. Dr Sun delivered a presentation on ‘Mechanism under the 1988 SUA Convention for Combating Maritime Security Threats’, in which she argued that SUA provides States Parties with quasi-universal criminal jurisdiction over specific offences that threaten the safety of navigation. This may be an effective tool to address non-traditional maritime security threats in Southeast Asia if all States ratify and implement SUA. To download her presentation, click here.

CIL Senior Research Fellow Youna Lyons was invited as a speaker to the pre-conference policy discussions on the implementation of the D-2 regulations on 5 November 2014 in Singapore. In her presentation titled ‘Ballast Water Management Convention: D-1 and D-2 regulations and related compliance issues’, she discussed the circumstances in which Port States may proceed to indicative and detailed samplings and the sanctions that may be imposed by the Port State should the samplings suggest non-compliance with the regulations. CIL Senior Research Fellow Youna Lyons was invited as a speaker to the 6th Annual Offshore Decommissioning Training Workshop, Asia Pacific, in Kuala-Lumpur, Malaysia, on 4-5 November 2014, organised by DecomWorld. Youna presented a paper titled ‘Prospects for Rigs-to-Reefs in Southeast Asia: November 2013 Workshop Findings and Recommendations’. CIL Director Robert Beckman gave two lectures at the Ministry of National Defence of Viet Nam in Ha Noi on 23 October 2014. He was received by Deputy Minister of Defence and Navy Command Admiral Nguyen Van Hien. He also delivered a presentation at the Diplomatic Academy of Viet Nam on 24 October 2014. The lectures were on UNCLOS and the South China Sea.

On 23 October 2014, as part of CIL’s continuing collaboration with the International Cable Protection Committee (ICPC), CIL, ICPC, George Washington University Law School and the Sargasso Sea Commission, co-sponsored a workshop titled ‘Submarine Cables in the Sargasso Sea – Legal and Environmental Issues Beyond National Jurisdiction’. CIL Global Associate Tara Davenport represented CIL and served as rapporteur at the Workshop. The objective of the Workshop was to start a dialogue between the submarine cable industry and the newly established Sargasso Sea Commission regarding best environmental practices for the laying and repair of cables in the Sargasso Sea. The Workshop brought together government representatives, representatives from the cable industry, academics, scientists and lawyers to discuss the impact that cable operations may have on the marine environment, the ecological sensitivity of the Sargasso Sea and whether any best practices should be adopted to minimise the impact, if any, of cable operations in the Sargasso Sea. CIL Head of Trade Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Ranyta Yusran participated in the Legitimacy of International Trade Tribunals Meeting in Geneva on 17-18 October 2014, where they presented their paper on the ASEAN trade dispute settlement mechanism. The meeting was organised by PluriCourts of University of Oslo, Norway as the first editorial meeting for a book on international trade tribunals. United Nations Conference on Trade and Development (UNCTAD) invited CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow to the World Investment Forum 2014 to chair the session titled ‘Development and Investment Strategies’, together with Stephen Gelb and Xiaolan Fu on 15 October 2014 in Geneva, Switzerland. During the discussion, the participants discussed Global Value Chains (GVCs), Multinational Enterprises (MNEs) and Small and Medium Enterprises (SMEs), and institutions and governance as potential focus areas for research on investment and development.

CIL Research Associate Junianto James Losari attended an academic conference held jointly by Universitas Pelita Harapan (Indonesia) and Foreign Trade University (Vietnam) in Jakarta on 14-15 October 2014 in cooperation with the World Trade Institute (Switzerland). James presented his paper on ‘Comprehensive or BIT by BIT: ACIA and Indonesia’s BITs’. He criticised the existence of intra-ASEAN BITs (bilateral investment treaties) alongside the ASEAN Comprehensive Investment Agreement (ACIA), which has resulted in dual regimes of investment protection in the region, allowing investors to pick and choose the most favourable standards applicable to them. James offered recommendations for reconciliation of the regimes and preservation of Member States’ regulatory space. The conference was coupled with the launch of UPH’s WTO Chair Programme by the Deputy Director General of the WTO, Mr Yi Xiaozhun and the Ministry of Trade of Indonesia, Mr Muhammad Lutfi. James represented Singapore’s WTO Chair, Prof Michael Ewing-Chow to convey his support and interest for future collaboration with UPH. [Photo from event]

CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow conducted a training session (organised by United Nations Conference on Trade and Development) for Pacific Island (PACER-Plus) countries’ government officials on Investor-State Dispute Settlement (ISDS) and alternative mechanisms to ISDS in Free Trade Agreements (FTAs). He discussed several alternative dispute resolution mechanisms in FTAs, including commercial arbitration, domestic courts, as well as the development of dispute management systems. This was done as part of the preparation for the PACER-Plus negotiations with Australia and New Zealand.

CIL Director Robert Beckman and CIL Research Fellow Leonardo Bernard participated in the Workshop on the Future of the Seas in East Asia, held in Jakarta, Indonesia on 5-6 October 2014. The Workshop was organised by the Centre for Strategic and International Studies, Jakarta. Professor Beckman was part of the panel on ‘Addressing the Challenges: Managing Disputes’, where he presented the legal perspective of the disputes in the East and South China Sea. CIL Research Associate Junianto James Losari was invited to speak about the ASEAN Comprehensive Investment Agreement (ACIA) before representatives of various ministries of the Republic of Myanmar as part of a capacity building seminar on investment organised by the Economic Research Institute for ASEAN and East Asia and the Ministry of National Planning and Economic Development (NPED). More than 50 government officials attended this seminar, which was held on 27 September 2014 at Hotel Sedona in Yangon. In his presentation, James emphasised the importance of improving governance and the rule of law in the country, as well as ensuring that Myanmar’s new regulations and policies comply with the ACIA in order to minimise the costly risks of litigation. CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow, assisted by CIL Research Associate Junianto James Losari, taught at the Singapore Ministry of Foreign Affairs Training on Competition Law Policy and Intellectual Property Rights, which was organised by Drew & Napier and attended by twenty-seven government officials from around the world. Professor Ewing-Chow taught ‘Intellectual Property (IP), Technology, Investments & International Economic Law’ where participants learned about policy considerations that may affect States’ interests when entering into negotiations of IP provisions. Through the use of negotiation exercises using hypothetical fact patterns, the participants were tasked with reaching acceptable compromises relating to pharmaceutical products, tobacco plain packaging regulations and other public concerns pertaining to international IP and competition law regimes. CIL Research Fellow Ranyta Yusran participated in the 2014 International Law Association (ILA) Regional Conference on ‘Towards a Universal Justice? Putting International Courts and Jurisdiction into Perspective’ at the Lisbon University Law School, Portugal, from 11-12 September 2014. Ms Yusran presented a paper that she co-authored with CIL Head of Trade Law and Policy Associate Professor Michael Ewing-Chow entitled ‘If You Build It, They Still Will Not Come: ASEAN Dispute Settlement and Intra-ASEAN Disputes’ in Session 4 of the Conference concerning Dispute Settlement. The Conference was organised by the Lisbon University Law School and the Portuguese branch of the ILA and was attended by legal academics and practitioners from all over Europe. CIL Research Fellow Ranyta Yusran attended the 10th Anniversary Conference of the European Society of International Law (ESIL) in Vienna, Austria, on 4-6 September 2014. This year’s theme was ‘International Law and…’, which highlighted the interrelatedness of international law and other fields of study such as literature, political science, anthropology, feminism, etc. The Conference was attended by more than four hundred legal academics and practitioners from Europe, Central America, the United States, Canada, Asia, the Middle East and Africa. Ms Yusran also attended the first ESIL interest group meeting on international courts and tribunals, which will be the theme of the next ESIL Conference.

CIL Director Robert Beckman participated in the 3rd Maritime Institute of Malaysia (MIMA) South China Sea Conference, entitled ‘Promoting Sustainable Use of the South China Sea in an Era of Dynamic Geostrategic Change’, at the Doubletree Hilton Hotel in Kuala Lumpur from 2-3 September 2014. Professor Beckman gave a paper and made a presentation on ‘UNCLOS Annex VII Arbitration’ in Panel 4 on Dispute Settlement Mechanisms and the South China Sea Disputes. His paper provided a background on UNCLOS Annex VII Arbitration and his oral presentation focused on the Philippines v. China case. Professor Beckman also served as one of three speakers in the final panel on Centering Diplomacy towards achieving a Sustainable and Peaceful South China Sea. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited to speak at the Inaugural ASEAN Center Seminar of the Richardson School of Law, Hawaii on 29 August 2014. He spoke on “ASEAN 2015 Integration and the Impact on CMLV Member States”.

CIL Director Robert Beckman participated in the ‘International Symposium on the Philippines v. China Arbitration Case: The Efficacy of the Annex VII Tribunal in Resolving Complex Territorial/Maritime Disputes’ from 21-22 August 2014 in Beijing, China. The Symposium was organised by the National Institute for South China Sea Studies in cooperation with the China Center for Collaborative Studies of the South China Sea. CIL Research Associate Junianto James Losari attended a meeting held by the Ministry of Foreign Affairs of Indonesia to discuss Indonesia’s review of the investor-state dispute settlement mechanisms included in its existing bilateral investment treaties and make recommendations for future investment agreements. The meeting, held on 14-16 August 2014 in Jakarta, was attended by government officials from various ministries and institutions in Indonesia.

CIL Research Associate Zhen Sun participated in the 8th IFLOS Summer Academy at the International Tribunal for the Law of the Sea (ITLOS) from 27 July to 22 August 2014, in Hamburg, Germany. Ms Sun received a partial scholarship from the International Foundation for the Law of the Sea to participate in the Academy. The four-week programme brought together a prestigious faculty to cover important issues on the international law of the sea and maritime law, including ITLOS judges and leading academics and practitioners from the maritime field. There were 41 participants from 33 nations who attended the 2014 Summer Academy. Ms Sun also participated in the moot court competition, where she and her team argued in front of a panel of four judges. Ms Sun’s Certificate was awarded by the Chair of the International Foundation for the Law of the Sea, Ms Doris Konig, during the formal Senate Reception in the Town Hall of the Free and Hanseatic City of Hamburg. CIL Director Professor Robert Beckman and CIL Senior Research Fellow Dr. Hao Duy Phan were invited to participate in the Conference on ‘Legal Issues regarding China’s Placement of the Oil Rig Haiyang Shiyou 981 in Viet Nam’s Exclusive Economic Zone and Continental Shelf’ in Ho Chi Minh City, Viet Nam. The Conference was organised jointly by the Ho Chi Minh City University of Law and the Viet Nam Lawyers Association. Ambassador-at-Large Tommy Koh delivered the keynote speech at the International Seabed Authority’s 20th Anniversary Commemorative Session in Kingston, Jamaica, on 22 July 2014. Noting that “the time for seabed mining has come”, Prof Koh emphasized that it “is now within our power to turn the ideal of the common heritage of mankind into reality”. CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow and CIL Research Associate Junianto James Losari spoke at the 2014 Society of International Economic Law Conference (SIEL) in Bern, Switzerland, on 10-12 July 2014. This biennial conference brings together the top academic experts and practitioners in the field to present their work and research on topics of trade, investment, and financial law. Professor Michael Ewing-Chow was an invited speaker at the session entitled ‘”Burning Issue” in IEL: Russia, Ukraine and the Crimea – IEL Dimensions’. Mr Losari presented a paper that he co-wrote with Professor Michael Ewing-Chow on ‘A Clash of Treaties – The Legality of Countermeasures in International Trade Law and International Investment Law’. CIL Director Robert Beckman taught at the 19th Annual Session of the Rhodes Academy of Oceans Law and Policy, which was held in in Rhodes, Greece. Professor Beckman delivered three lectures on the marine environment during the third week of the Academy and organised a 3-hour workshop on the legal regimes governing seafarers and fishers. He also judged the oral examination at the end of the course, together with three judges from the International Tribunal for the Law of the Sea. In addition, he attended meetings with other members of the Board of Directors of the Academy. CIL sponsored three participants to the 2014 Rhodes Academy: Ms Lusitania Lopez of Timor Leste, Mr Dara In of Cambodia and Mr Chen Li of China. Two Singaporeans who attended the Academy, Luke Tang of the Attorney-General’s Chambers and Kenneth Kwa of the Ministry of Foreign Affairs, won prizes for being the top students in the written examination.

CIL Director Robert Beckman and CIL Global Associate Captain J. Ashley Roach participated in the 38^th Annual Conference of the Center for Oceans Law and Policy (COLP) of the University of Virginia in Bergen, Norway. The title of the Conference was ‘Challenges of the Changing Arctic: Continental Shelf, Navigation, and Fisheries’. CIL Research Fellow Leonardo Bernard participated in the Summer Academy on the Continental Shelf, held at Torshavn, Faroe Islands on 21-28 June 2014. The Academy was organized by the University of the Faroe Islands. The Academy focused on the intricate legal and technical conditions governing the entitlement to and establishment of the continental shelf beyond 200 nautical miles, and on the delimitation of overlapping entitlements to such areas.

CIL Research Associate Zhen Sun participated in the Second Asia Pacific Ocean Law Institutions Alliance (APOLIA) Conference, ‘After 20 Years of Implementation of UNCLOS by Asian Pacific States’, from 20-21 June 2014. The Conference was organised by the Centre for Ocean Law and Governance, Zhejiang University and the Korea Maritime Institute. Zhen delivered a presentation on Singapore’s implementation of UNCLOS, where she addressed the issues of Singapore’s international boundaries with its neighbouring countries and Singapore’s practice regarding IMO conventions. She also participated as a discussant at the International Symposium on ‘Sustainable Development and the Law of the Sea’ from 22-23 June 2014.

CIL Head of International Trade and Law Professor Michael Ewing-Chow and CIL Research Associate Junianto James Losari met with ERIA Researchers, Mr. Yoshifumi Fukunaga, Ms. Lili Yan Ing, and Mr. Chandra Tri Putra to discuss ERIA’s baseline study of various investment agreements among the countries involved in the Regional Comprehensive Economic Partnership (RCEP) negotiations. The discussion focused on creating baseline study indicators to assess commitments on liberalisation and protection, the creation of which will provide useful information for negotiators of the RCEP.

Following the publication of their article in the Jakarta Post entitled “Indonesia should not withdraw from ICSID”, CIL Head of Trade and Investment Law and Policy, Prof Michael Ewing-Chow, and CIL Research Associate, Junianto James Losari were invited by the University of Indonesia to the National Seminar on Settlement of Investment Disputes: Indonesia, ASEAN, International, on 5 June 2014 in Jakarta, Indonesia to participate in the discussion regarding Indonesia’s policy on discontinuing or terminating its Bilateral Investment Treaties (BITs) regime. More than 300 participants attended the seminar, including government officials from various institutions in Indonesia, academics, and members of the media and business community. CIL Senior Research Fellow Youna Lyons participated in the 28th Asia-Pacific Roundtable on 3-4 June 2014 in Kuala Lumpur, Malaysia. CIL Research Fellow Leonardo Bernard participated in the South China Sea Panel: Current Disputes and Possible Future Outcomes of the Multi-Dimensional Conflict, held at the Asian Civilization Museum, Singapore on 26 May 2014. The Panel was organized by Singapore’s American Chamber of Commerce. Leo joined the panel where he addressed legal issues associated with current state of disputes in the South China Sea.

CIL Director Robert Beckman gave a lecture in the Foreign Service Advance Programme organised by the Diplomatic Academy of the Ministry of Foreign Affairs. The lecture was on “Current Issues in International Law and Implications for Singapore”.

Senior Principal Research Fellow Christopher Thomas QC chaired a session at the Rule of Law Symposium 2014 on “The Importance of The Rule of Law in Promoting Development”. He is a co-editor of the Symposium proceedings under the general editorship of Sir Jeffrey Jowell. This was the second year that the Singapore Academy of Law organised this Symposium in collaboration with the Bingham Centre for the Rule of Law.

CIL Senior Research Fellow Dr. Hao Duy Phan was invited to speak at the ASEAN Regional Workshop on “The Promulgation of Laws and Regulations of ASEAN Member States: A Comparative Study” on 23-24 April 2014 in Jakarta, Indonesia. Hao Duy Phan delivered a presentation on “Treaty-Making and the Status of Treaties in ASEAN Member States: An Overview”. CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow along with CIL’s RA Junianto James Losari were invited to attend the first Forum on International Trade and Investment (FORTRIN) meeting. Former WTO Deputy Director General Alejandro Jara, now with King & Spalding hosted the meeting. Michael and James attended by videoconference from the King & Spalding office in New York, together with Prof. Karl Sauvant of the Vale Centre of Columbia University. The meeting was attended trade and investment experts from Geneva, London, Paris, Washington DC, and New York all linked by videoconference. FORTRIN aims to provide a platform to promote the application and development of trade and investment rules with a view to bolstering the global legal framework for international economic law activity. During the first meeting, the discussion revolved around how to frame the issues of current investment rules. This is an important foundation if a multilateral approach on investment rules were to be proposed. In his intervention, Prof. Michael Ewing-Chow suggested a way to contextualize the current issues by looking through the global value chains lens, as governments will be more interested in exploring further the idea of multilateral investment agreement if they can be more integrated to the value chains. The discussion also touched upon several challenges to this effort, among others: the growing reluctance of governments in being subjected to Investor-State Dispute Settlement (ISDS), the need for a better fact-finding procedure in international arbitration, the need to address burning issues such as abusive treaty shopping, and the need to educate the stakeholders, including the civil society. Preparations are required to deal with these matters before one can move towards creating a multilateral investment framework.

CIL’s Head of Trade and Investment Law and Policy, Prof. Michael Ewing-Chow and CIL’s RA Junianto James Losari were invited by the DC Bar’s International Dispute Resolution Committee to attend a lunchtime panel discussion on “Changes in the System of Investor-State Dispute Settlement: Viewpoints from the Americas” that was held on 10 April 2014 at the office of Arnold & Porter LLP in Washington DC. The panelists (Anna Joubin-Bret, Jonathan S. Kallmer, and Omar Garcia-Bolivar) presented their findings of the current state of development in investor-state dispute settlement (ISDS) in both North America and South America. Michael and James were invited to share their views on the developments in Asia and in particular ASEAN and Asia. During the discussion that was moderated by Jean Kalicki, various innovations were mentioned on how countries sought to improve the current legal frameworks. These innovations are to be implemented both at domestic and international levels and could be considered as fresh ideas for currently ongoing IIAs negotiations, including the Trans-Pacific Partnership and the Transatlantic Trade and Investment Partnership. Michael said that the ASEAN Comprehensive Investment Agreement (ACIA) has introduced several innovations, making it a more balanced agreement both in terms of investor protection and preserving the governments’ policy space. Separately, James queried whether there was any plans to consolidate agreements in the Americas, given that Asia has plans to do so under the Regional Comprehensive Economic Partnership (RCEP) negotiation.

CIL Director Robert Beckman attended the 76th Biennial Conference of the International Law Association (ILa) and 108th Annual Meeting of the American Society of International Law (ASIL) in Washington DC. The ASIL Annual Meeting and the ILA Biennial Conference were organised jointly and held together. Professor Joseph Weiler, Director of the CIL ASEAN Integration Through Law Project (President of the European University Institute; NUS Law School; and University Professor at the NYU School of Law (on-leave)) convened and chaired the discussions on the ASEAN Economic Community at Plenary 4 of the ASEAN Integration Through Law Project: The ASEAN Economic Community at the Sofitel Plaza Hotel, Hanoi, Vietnam. CIL senior expert, Professor Michael-Ewing-Chow, shared his work on the ASEAN economic integration and investment regime. CIL Director Robert Beckman served as the coordinator and main lecturer in an International Law Course CIL conducted for government officials from more than 20 countries. The course was conducted under the auspices of the Singapore Cooperation Program of the Ministry of Foreign Affairs. Prof Beckman made presentations and led discussions in 14 sessions of 90 minutes each over the 5-day course. Assoc Prof Michael Ewing-Chow and Christopher Thomas also made presentations. CIL Research Fellow Ranyta Yusran played a major role in organising the course and the course materials. CIL Research Fellows Hao Duy Phan and Leonardo Bernard also led discussions at the course.

CIL Director Robert Beckman and CIL Research Associate Monique Page were invited to attend the annual meeting of the International Cable Protection Committee (ICPC) in Dubai, United Arab Emirates. Prof Beckman made a presentation on ‘UNCLOS and the 2012 OSPAR Guidelines on BEP in Cable Laying and Operation’.

CIL Director Robert Beckman participated in the Norway-Singapore Arctic Symposium at the Riverview Hotel on 14 March 2014. The symposium was organised by the Maritime and Port Authority of Singapore (MPA), the Norwegian Embassy and the Singapore Maritime Institute (SMI). The International Economic Law and Policy (IELPO) LL.M Programme of the Universidad de Barcelona invited CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow for the second consecutive year to teach ‘Regionalism in Asia’ as part of their programme. The course was held on 10-11 March 2014 and focused on the unique features of Asian Regionalism, with an emphasis on the trade and investment aspects of the Association of South East Asian Nations (ASEAN).

CIL staff organised and participated in the ‘International Conference on Transboundary Pollution: Evolving Issues of International Law and Policy’. The conference was held at the Orchard Hotel, Singapore. Prof Tommy Koh and Prof S Jayakumar served as co-chairs of the conference. CIL Director Robert Beckman presented a paper on ‘State Responsibility for Transboundary Marine Pollution’, CIL Senior Research Fellow Youna Lyons presented a paper on ‘Transboundary Pollution from Offshore Activities: A Study of the Montara Offshore Oil Spill’, and Prof Alan Tan presented a paper on ‘Co-operative and Unilateral Mechanisms to Combat Forest Fires and Transboundary Haze’ in Southeast Asia. CIL Director Robert Beckman and CIL Research Associate Monique Page attended a CSCAP Experts Group Meeting on Security of Vital Undersea Communications Infrastructure on Monday 17 February in Jakarta. On Tuesday 18 February they will be attending a meeting of the CSCAP Study Group on Maritime Security. CSCAP is Council for Security Cooperation in the Asia Pacific (CSCAP). The Study Group is co-chaired by CSCAP Singapore, CSCAP Indonesia and CSCAP New Zealand. Prof Beckman will be making presentations at both of the meetings. CIL Research Associate, Junianto James Losari spoke in the Plenary Discussion on Cooperative Ventures toward ASEAN Integration. The Plenary discussion was a part of the full day Business Law Convention held by De La Salle University College of Law in cooperation with the Department of Trade and Industry of the Philippines on Doing Business in Free Trade Areas: Cooperative Ventures toward ASEAN Integration. The event, attended by almost 1,000 students, academia and business community, was meant to raise awareness about the upcoming ASEAN Economic Community (AEC) in 2015. On 8-9 February 2014, CIL Research Associate Junianto James Losari judged three preliminary rounds and the final round of the 2014 Indonesian National Rounds of the Philip C. Jessup International Law Moot Court Competition, held at Universitas Pelita Harapan (UPH), Indonesia. Universitas Indonesia and UPH respectively came as the Champion and the Runner Up of the competition in which 17 universities participated. In April, the two teams along with Universitas Udayana (Exhibition Team) will compete in Washington DC, USA.

CIL Head of Trade and Investment Law and Policy and Singapore’s WTO Chair, Prof. Michael Ewing-Chow and CIL Research Associate, Junianto James Losari taught Investment Law at the Master in Trade, Investment and Competition Law & Policy Program of Universitas Pelita Harapan in Jakarta, Indonesia. CIL Director Robert Beckman visited the International Boundaries Research Unit (IBRU) of Durham University in order to discuss continued links between IBRU and CIL. While at the University, Prof Beckman also met with members of the Faculty of Law.

CIL Research Associate Yvette Anthony assisted Senior Principal Research Fellow Christopher Thomas QC in teaching a three-day intensive training course for Singapore Ministry of Trade and Industry (MTI) officials on dispute settlement under international investment agreements.

On 5 April 2013 CIL research staff had a roundtable discussion on the South China Sea Disputes with research staff of the Center for Strategic and International Studies (CSIS) at their offices in Washington. The CIL delegation included CIL Director Robert Beckman, CIL researchers Tara Davenport and Leo Bernard, and Ambassador Arif Havas Oegroseno of Indonesia, a member of CIL International Advisory Panel. Prof Beckman began the discussion with a brief presentation, and it was followed by a general discussion. The CIL researchers were in Washington DC to attend the Annual Meeting of the American Society of International Law. The roundtable discussion was arranged by Murray Hiebert, Deputy Director and Senior Fellow in the Southeast Asia Program at CSIS.

CIL Director Robert Beckman made a presentation titled “Role of ASEAN and the Philippines v China Case” on 4 April 2013 at the 107th Annual Meeting of the American Society of International Law in Washington DC. Prof Beckman served on a Panel on Legal Solutions to Maritime Disputes in Asia, and he spoke about the South China Sea Disputes. The other members of the panel were Rosalyn Higgins, past President of the International Court of Justice; Loretta Malintoppi, Eversheds LLP Paris; and Galo Carrera Hurtado, Member of the Commission on the Limits of the Continental Shelf. Senior Principal Research Fellow Mr. Christopher Thomas, QC, was invited by Thailand’s Department of International Economic Affairs to participate in a panel discussion on 27 March 2013 organised by the Thailand Ministry of Foreign Affairs, together with the Royal Thai Embassy in Brussels and the Mission of Thailand to the European Union, on the issue of investor-state dispute settlement under the current EU investment regime. Fellow panellists were Ms. Eugenia Costanza Laurenza of FratiniVergano Brussels and Professor Jayavadh Bunnag of International Legal Counsellors Thailand Ltd, and the session was moderated by Dr. Vilawan Mangklatanakul, Director in the International Law Development Division in Thailand’s Ministry of Foreign Affairs. The purpose of the session was to assist Thai government officials in their understanding of the kind of protection offered and reciprocally demanded in the present model of investment protection advocated by the EU and the significance of the option of investor-state dispute settlement in arbitrating disputes which may arise.

CIL Director Robert Beckman participated in the Five Universities Conference 2013 organised by the LKY School of Public Policy. He made a presentation on ‘Dispute Settlement Mechanisms and the South China Sea Disputes’.

CIL Senior Research Fellow Dr Tan Hsien-Li presented her paper on “International Human Rights Law, Regional Mechanisms and ASEAN: Disconnected Paradigms” at the European University Institute’s Human Rights Day Colloquium held in Florence, Italy.

CIL Director Robert Beckman participated in a Roundtable on Maritime Security in East Asia.The Roundtable was organised by the S. Rajaratnam School of International Studies (RSIS) and the Japan Institute of International Affairs (JIIA) and held at the Four Seasons Hotel in Singapore. Prof Beckman made a presentation on ‘International Law & Maritime Security in East Asia’.

On 8 December 2013, Universitas Gadjah Mada (UGM) and its Center for World Trade Studies held a seminar with the theme of “Promoting Fair Trade to Achieve Sustainable Development through Doha Agenda”, a part of its three-day event, the 1st Model World Trade Organization (WTO). CIL Associate Junianto James Losari, representing Prof. Michael Ewing-Chow as the WTO Chair at NUS, delivered a talk on Diplomacy in World Trade Organization. In his talk, James explained about the dynamic of negotiations during the 9th WTO Ministerial Conference in Bali. With the consensus decision-making mechanism, every Member has an equal vote. With the number of developing countries outweighing the number of developed countries, it would be naive to argue that the WTO remains a club of rich nations or developed countries. He further observed the various advantages of having the Bali Package agreed by all WTO Members by also looking at the counterfactual. Besides James, Bapak Riza Noer Arfani, MA (WTO Chair at UGM) also delivered a talk on “Sustainable Development through Trade” which continues on exploring the results of the Bali Package and its impacts for developing countries.

The President of the Republic of Indonesia, Susilo Bambang Yudhoyono delivered his opening speech and officially declared the Conference open on 3 December 2013. CIL researchers participated in the 4th Biennial Conference of the Asian Society of International Law in New Delhi, India on 14-16 November 2013. They presented their papers in a panel titled “ASEAN: the Good, the Bad and the Ugly”. CIL Research Fellow Dr Hao Duy PHAN opened the Panel with a discussion on ASEAN’s role on intra-regional security (download in PDF format) followed by a presentation from CIL Research Fellow Mr Leonardo BERNARD on the use of extra-ASEAN dispute settlement mechanisms for ASEAN disputes (download in PDF format). The third presentation was delivered by CIL Research Associate Ms Ranyta YUSRAN on ASEAN and human rights (download in PDF format). Finally, Professor Michael Ewing Chow, Head of Trade and Investment Law and Policy of CIL, concluded the panel with a presentation on the purpose-driven architecture of dispute settlement and suggestions to strengthen the architecture of ASEAN (download in PDF format). CIL Senior Research Fellow Youna Lyons played a key role as CIL’s point person in organising a marine science, engineering, law and policy workshop entitled ‘Rigs-to-Reefs Prospects for Large Scale Artificial Reefs in Tropical Southeast Asian Seas’. The Workshop was organised jointly by CIL, the NUS Tropical Marine Science Institute (TMSI) and the NUS Centre for Offshore Engineering (CORE). CIL Director Robert Beckman made a presentation on ‘The International Legal Regime Governing the Disposal and Re-Use of Offshore Platforms’. CIL Director Robert Beckman participated in the 5th International Workshop on the South China Sea in Hanoi, Vietnam. The Workshop was organised by the Diplomatic Academy of Vietnam and its title was ‘The South China Sea: Cooperation for Regional Security and Development’. CIL Staff organised and participated in the Conference on Transparency in the WTO: Between Legislation and Litigation. The Conference was held at Fort Canning Hotel, Singapore. CIL Head of Trade and Investment Law and Policy, Prof Michael Ewing-Chow presented a paper on the ‘Conceptual Framework of Transparency in WTO Context’. While CIL Research Fellow, Dr Lin Lin and CIL Research Associate, Junianto James Losari presented papers on ‘TPRs in China’ and ‘ASEAN Economic Community (AEC) Scorecard and TPR’, respectively. CIL Senior Research Fellow Youna Lyons was invited as a speaker to the 2013 APAC Offshore Decommissioning Training Workshop organized by DecomWorld. She was a member of the regulatory panel and made a presentation on the international legal framework for rigs-to-reefs (download in PDF format) and on International law on offshore decommissioning in Southeast Asia (download in PDF format).
