CIL Senior Research Fellow Ms Youna Lyons was invited to speak at the International Seminar on ‘Environmental and Maritime Security for a Blue South China Sea’ held in Hai Phong City, Viet Nam, on 10-12 October 2016. She presented a paper titled ‘A path towards Marine Protected Areas in the South China Sea following the Arbitral Award’, in the first session on Environmental Security in the South China Sea (Bien Dong Sea) after the Hague Award. CIL Senior Research Fellow Ms Youna Lyons attended the 38th Conference of the Parties to the London Convention and Protocol on the Prevention of Pollution by Dumping of Wastes and other Matters as a member of the Advisory Committee for the Protection of the Sea (ACOPS) delegation. The meeting was held at the International Maritime Organization Headquarters in London from 19-23 September 2016.

On 29 August 2016, Professor Robert Beckman, Head of CIL’s Ocean Law and Policy Programme delivered the Keynote Address at an international conference on ocean governance and security at the Mandarin Orchard Hotel, Singapore. The title of the conference was ‘Resolving the Complex Challenges of Ocean Governance and Security for Secure and Sustainable Oceans in the Southeast Asian Region’. The organisers were the Mitsubishi Research Institute and the University of Tokyo Graduate School of Public Policy, with support from IHS Jane’s and the Ministry of Foreign Affairs of Japan. CIL Research Fellow, Ms. Denise Cheong; ESI Research Fellow, Dr Monique Taylor; and CIL Research Associate, Ms. S Nivedita who are part of the ESI-CIL Nuclear Governance Project’s multidisciplinary team attended this year’s International School of Nuclear Law (ISNL). ISNL, in continuing its unique contribution to the field of nuclear law, held its 2016 summer session from 22 August to 2 September 2016 in Montpellier, France. ISNL was established in 2001 by the OECD Nuclear Energy Agency (NEA) in partnership with the University of Montpellier to provide participants with a comprehensive overview of the various inter-related legal issues relating to the safe, efficient and secure use of nuclear energy. ISNL’s faculty comprises renowned specialists in nuclear law from international organisations, governments, and industry and ISNL participants have the option of applying for a University Diploma (Diplôme d’université – D.U.) in International Nuclear Law from the University of Montpellier. Professor Robert Beckman, Head of CIL’s Ocean Law and Policy Programme and Ms Youna Lyons, Senior Research Fellow participated in the Asian International Symposium 2016: The Contemporary Maritime Security Issues in Asian Region in Jakarta, Indonesia on 21-22 August 2016. The Conference was organised by the Center for Southeast Asian Studies (CSEAS) Indonesia. Professor Beckman chaired a panel session on The Role of UNCLOS and its Dispute Settlement Regime, and Ms Lyons made a presentation in the panel session on Marine Environmental Protection for Sustainability. CIL Senior Research Fellow Dr. Hao Duy Phan was invited to speak at the International Workshop on “Legal Status of Islands and Rocks in International Law and Practice in the South China Sea” on 17-18 August 2016 in Nha Trang, Vietnam. On 29 June 2016, CIL Director Professor Robert Beckman made a dinner speech on the South China Sea Disputes in New York at a meeting of the US-China Dialogue on Maritime Disputes and International Law. This is a Track Two mechanism between the National Institute for South China Sea Studies (NISCSS), Hainan, and the US National Committee on US-China Relations (NCUSCR), New York.

On 27-28 June 2016, CIL actively participated in the 40th Annual Conference of the Center for Oceans Law and Policy of the University of Virginia that was held at the United Nations Headquarters in New York. CIL Director Professor Robert Beckman made a presentation in Panel 3 on the International Tribunal for the Law of the Sea. CIL Research Fellow Dr Zhen Sun participated in the 4th Asia Pacific Ocean Law Institutions Alliance (APOLIA) Conference on ‘Regulation on Navigation of Foreign Vessels: Asia-Pacific State Practice’ in Zhoushan, China on 22-23 June 2016. The Conference was hosted by the Centre for Ocean Law and Governance of Zhejiang University, and co-organised by Inha University and the University of Wollongong. Dr Sun delivered a presentation on ‘Regulation on Navigation of Foreign Vessels – Singapore’s Practice’ in which she reviewed Singapore’s maritime legislation on foreign vessels and discussed its practice relating to the regulation of navigation in the Singapore Strait. CIL Research Fellow Ms Ranyta Yusran participated in the AsianSIL Regional Conference – ‘International Law and a Dynamic Asia’ on 14-15 June 2016 in Hanoi, Viet Nam. The Conference was jointly organised by AsianSIL, the Diplomatic Academy of Viet Nam and the Ministry of Foreign Affairs of Viet Nam. At the Conference, Ranyta presented her paper on ‘The ASEAN Convention against Trafficking in Persons, Especially in Women and Children: Is It Up to the Task?’ in a panel on ‘ASEAN after 2015’, chaired by the dean of the NUS Law Faculty. CIL Director Professor Robert Beckman was invited to participate in the EU-DAV High-Level Workshop: Maritime Security and Development: International Cooperation and European – Asian Experience Sharing, which was held on 8-9 June 2016 in Ha Long, Vietnam. The Workshop was jointly organised by the Diplomatic Academy of Vietnam and the European Union. Prof Beckman was unable to attend, but his PowerPoint presentation was distributed to participants and presented by another speaker. His presentation was entitled ‘UNCLOS Dispute Settlement Regime & Philippines v China Arbitration’. He has submitted a draft paper to the organisers on the same topic. CIL Director Robert Beckman attended the 2016 IISS Shangri-La Dialogue, the 15th annual Asia Security Summit, organised by the International Institute for Security Studies, which was held at the Shangri-La Hotel in Singapore from 3-5 June 2016. Prof Beckman participated in a panel discussion on ‘Managing South China Sea Tensions’, together with defence officials from China, Vietnam and the European Union.

CIL Director Robert Beckman and CIL Non-Resident Fellow Captain J Ashley Roach participated in the Expanded ASEAN Maritime Forum Workshop on Maritime Boundaries, which was held at the Hanoi Hilton Opera Hotel in Hanoi, Vietnam from 31 May to 3 June 2016. The full title of the Workshop was the EAMF International Law and Best Practices in Maritime Boundary Delimitation and Provisional Arrangements of a Practical Nature. The Workshop was organised by the Diplomatic Academy of Vietnam (DAV) and the US Department of State. CIL and the Australian Centre for Ocean Resources and Security (ANCORS) were supporting organisations. Prof Beckman and Captain Roach each made two presentations at the Workshop. CIL Research Associate Christine Sim attended the Workshop as an observer.

On 18 May 2016, CIL Research Associate Hadyu Ikrami participated in the International Seminar on the Establishment of a Regional Convention against Illegal, Unreported, and Unregulated Fishing (IUUF) and Its Related Crimes. The Seminar took place in Bali, Indonesia, and was organised by the Indonesian Coordinating Ministry for Maritime Affairs. It was attended by approximately 120 participants from 13 countries. The speakers of the Seminar were representatives of the Food and Agriculture Organization (FAO), United Nations Office on Drugs and Crime (UNODC), European Union (EU), Sub-Regional Fisheries Commission (SRFC) of the West African Countries, as well as representatives of the governments of Thailand, Australia, the Philippines and the United States. Another speaker was a New Zealander official who delivered a presentation on how Interpol has assisted New Zealand in combatting IUU fishing.

CIL Research Fellow Junianto James Losari taught an International Investment Law course in the Masters Programme on Trade, Investment, and Competition at the Universitas Pelita Harapan, Indonesia, which was held on 23-26 February 2016 in Jakarta, Indonesia. In his lecture, James provided an overview of international investment law with some specific discussions on Indonesia’s recent investment policies. On Monday, 22 February 2016, CIL Research Fellow Junianto James Losari was the guest lecturer at a workshop to advise Indonesian government officials from the Ministry of Trade, the Indonesian Investment Coordinating Board, the Central Bank of Indonesia, and various other institutions on cross-cutting issues between Trade in Services and Investment. The workshop was organised by the Ministry of Trade’s Centre for Advocacy and the EU-Indonesia Trade Cooperation Facility at the Ministry of Trade in Jakarta, Indonesia. In his lecture, James highlighted the need for Indonesian government officials to clarify their policy objectives both in trade and investment before the process of negotiating or drafting free trade agreements (FTAs). Furthermore, he noted the potential overlap of commitments made under trade in services chapter and investment chapters in FTAs that requires different institutions to cooperate and coordinate closely to prevent inconsistency. CIL Director Robert Beckman participated in a conference hosted by the National Institute for South China Sea Studies (NISCSS) in Hainan, China from 17-19 January 2016. The conference was the Second Conference on the Partnership for Regional Peace: Operationalising ASEAN-China Comprehensive Strategic Partnership in Southeast Asia under a project headed by the Centre for Strategic and International Studies (CSIS), Indonesia and the NISCSS to try to find a resolution to the issues in the South China Sea. Prof Beckman served as the Co-Chair of the Working Group on Legal Principles, one of four working groups established under the project.

CIL Senior Non-Resident Fellow, retired Navy Captain J. Ashley Roach addressed the ASEAN Regional Forum (ARF) on Regional Confidence Building and the Law of the Sea, which was held in Tokyo, Japan on 4 December 2015, and convened by the Division of Maritime Security of the Japanese Foreign Ministry. The seminar was co-chaired by Japan, Vietnam and India. Captain Roach suggested that the ARF members review carefully the Award on the Merits in the Philippine-PRC arbitration expected by mid-June 2016, and the Final Report of the International Law Association’s (ILA) Committee on Baselines under the International Law of the Sea (chaired by Captain Roach) expected to be adopted at the ILA’s biennial conference in August 2016. He suggested the documents be reviewed in light of the ARF members’ maritime claims that are inconsistent with the Law of the Sea Convention.

CIL Research Fellow Junianto James Losari was invited to speak at the Asia FDI Forum on 5-6 November 2015 in Hong Kong. James presented his paper “Searching for An Ideal Investment Protection Regime for ASEAN+ Dialogue Partners in RCEP: Where Do We Begin?” in which he discussed the baseline study and the method he used to better advise Regional Comprehensive Economic Partnership (RCEP) negotiators in the negotiation of the RCEP’s investment chapter. The Forum was jointly organised by the Centre for Financial Regulation and the Economic Development and Columbia Center on Sustainable Investment (Columbia University) and sponsored by Oxfam Hong Kong and the Chinese University of Hong Kong (Faculty of Law). CIL Research Fellow Junianto James Losari attended the Southeast Asia Law Scholars Colloquium held by Universitas Indonesia in Jakarta, Indonesia on 22 October 2015. James presented a paper that he co-wrote with A/P Michael Ewing-Chow titled “Multiple Authorisation: The Complexity of Desentralisasi in Indonesia and the Potential Contribution of IIAs in Resolving Confusion”. James discussed the problems posed by the desentralisasi system on foreign investors in Indonesia. Subsequently, he suggested ways to alleviate the problems by utilising Indonesia’s existing IIAs to discipline the regional governments. To view his presentation, click here.

CIL Research Associate Mark Huber attended the British Institute of International and Comparative Law Investment Treaty Forum’s Twenty-fifth ITF Public Conference, “The ICSID Convention at 50”, in London, England on 18 September 2015. This meeting of the Investment Treaty Forum, organised in partnership with the ICSID Secretariat, discussed the history of the ICSID Convention, the legal issues raised in its interpretation and application, and its continuing role in the investment treaty regime.

CIL Director Robert Beckman participated in a conference on the South China Sea in Jakarta, Indonesia from 14-16 September 2015. The Conference was co-organised by the Centre of Strategic and International Studies (CSIS) Indonesia and the National Institute for South China Sea Studies (NISCSS) in Hainan, China. This was the First Conference in a project led by Indonesia and China to enhance cooperation and help manage the security situation in the South China Sea. Prof Beckman served as the co-chair of a Working Group on UNCLOS and the South China Sea.

CIL Practice Fellow Emily Choo was invited to present her paper, ‘The Impact of Amicus Curiae Submissions in Investment Treaty Arbitration’ at the 2015 Taipei International Conference on Arbitration and Mediation from 6-7 September 2015. The conference was attended by about 60 practitioners and academics from more than eight countries across Asia and Europe. Emily spoke about the investment arbitration tribunals’ treatment of amicus curiae participation in investment arbitration proceedings. Her paper is the latest comprehensive study of this particular area and her study of the cases shows that there are three main approaches that such tribunals have taken. She concluded her presentation by examining the precedential value of these earlier investment arbitration cases for the ongoing Philip Morris v Uruguay proceedings. CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to act as one of four instructors in a workshop in Nay Pyi Taw, Myanmar, from 6 to 8 July 2015 on ‘Public Policy and Investor State Dispute Settlement’, jointly organised by Myanmar’s Attorney-General’s Office and the International Commission of Jurists (Myanmar). It was attended by more than 60 government officials from across Myanmar, and presided over by Myanmar’s Attorney-General and Director-General. She taught in two 90-minute sessions on defences in investment treaty law, paying close attention to Myanmar’s existing investment treaties. She also developed, led and participated in exercises based on a simulation of an investor-state dispute that arises between Myanmar and investors of an ASEAN neighbour. CIL Practice Fellow Emily Choo attended the Pearl River Delta Academy of International Trade and Investment Law, which was held in Macau and Shenzhen from 6 July 2015 to 17 July 2015. The Academy was organised by the Institute of European Studies in Macau and the Peking University School of Transnational Law and covered WTO law, international investment law, international trade and other areas of international law. The two-week Academy brought together postgraduate students from various disciplines to be trained by a faculty comprising leading academics from various fields.

CIL Research Fellow Junianto James Losari was invited to speak at the Art of Negotiating Trade and Investment Agreements Workshop: Taking Into Account the Global Tobacco Treaty. The workshop was held in Chiang Mai, Thailand on 25-26 June 2015. It was attended by academics and government officials from the Ministry of Health in the region. James spoke about the ‘Investment Framework from the ASEAN Perspective’ and its implication on tobacco control measures taken by ASEAN Members. He highlighted the importance of ASEAN Members to terminate their intra-ASEAN BITs, which do not provide enough policy space for States to take tobacco control measures without incurring liability. On the other hand, the newer generation International Investment Agreements, such as the ASEAN Comprehensive Investment Agreement and other ASEAN + Dialogue Partner(s) Investment Agreements contain general exceptions clauses that allow States to take measures to protect its public health, including tobacco control measures without incurring any liability. However, ASEAN Members must carefully formulate their measures to fulfil the requirements of such clauses.

Assoc Prof Michael Ewing-Chow was invited by the International Institute for Trade and Development (Thailand) and the Ministry of Foreign Affairs of Thailand to speak at a seminar on International Investment Agreements (IIAs) towards Global Sustainability. The two-day seminar was held on 25-26 June 2015 in Bangkok, Thailand. In addition to explaining the general framework of IIAs and its recent development, Michael also discussed shareholder recovery in investment claims and advised on options for IIA and BITs clauses.

On 12 June 2015, the Symposium for the Commemoration of the 20th Anniversary of the Rhodes Academy on Oceans Law and Policy was held at the United Nations in New York. Hosted by the Permanent Mission of Iceland to the UN, the Symposium featured Judge Tomas Heidar and several other Rhodes Alumni, who presented on current law of the sea issues. Most of the Symposium’s 70 participants had attended the Meeting of States Parties to the Law of the Sea Convention that took place the previous week. CIL, one of the sponsoring organisations of the Rhodes Academy, was represented at the Symposium by CIL Research Fellow (Non-Resident) Tara Davenport at which she gave a presentation on ‘Submarine Cables in Areas Beyond National Jurisdiction’. On 25-27 May 2015, the Temasek Foundation held its Series on Trade & Negotiations: RSIS-WTO Parliamentarian Workshop 2015 in Singapore. This event brought together parliamentarian representatives from the region to learn and discuss further about the recent development in the World Trade Organization (WTO). The Director General of the WTO, Mr Roberto Azevedo, delivered his keynote address about the challenges for the WTO in the future. A/P Michael Ewing-Chow was invited to share Singapore’s experience in trade facilitation. In his talk, Michael talked about the situation in the region and how trade facilitation can help development. Using the history of Singapore and trade facilitation, he suggested some principles for trade facilitation, in particular the importance of dealing with corruption, garnering buy-in from all stakeholders, and upholding the rule of law.

CIL Researchers Leonardo Bernard, Harpreet Kaur Dillon, Hao Duy Phan, Sun Zhen and Ranyta Yusran participated in the 12th Annual Asian Law Institute Conference – “Law 2.0: New Challenges in Asia” on 21-22 May 2015 in Taipei, Taiwan. The Conference was jointly organised by the National University of Taiwan and the Asian Law Institute. At the Conference, CIL researchers made various presentations on different topics of international law and chaired different panels. Dr Zhen Sun and Mr Leonardo Bernard spoke at a panel on international law with a particular focus on the law of the sea. Dr Zhen Sun made a presentation on “A Hot Land in A Cold Place: Opportunities and Challenges for Singapore in the Arctic” (download in PDF) and Mr Leonardo Bernard made a presentation on “Historic Fishing Rights and the EEZ” (download in PDF). Universitas Kebangsaan Malaysia (UKM) invited A/P Michael Ewing-Chow to speak at the ASEAN Economic Community Forum, which was held on 21-22 May 2015 in Kuala Lumpur, Malaysia. In the panel on ‘Full Integration into the Global Community: RCEP’, Michael delivered his presentation, ‘RCEP = ASEAN Plus Six Is the Whole Greater than the Sum of the Parts?’. He discussed the current context of the trade and investment landscape in RCEP negotiating countries. He also talked about the potential gains if RCEP could be concluded and the challenges that the negotiating parties will face during the negotiation based on the gap between some of the ASEAN and its Dialogue Partners as evidenced by the existing ASEAN+1 FTAs.

CIL Research Fellow Junianto James Losari was invited by the Economic Research Institute for ASEAN and East Asia to present his research on the investment chapters in various ASEAN + Dialogue Partners Free Trade Agreements (FTAs) in the 1st Workshop on the Regional Comprehensive Economic Partnership (RCEP) which was held on 20-21st May 2015 in Tokyo, Japan. The Workshop was attended by scholars (mostly economists) from various universities in Japan, South Korea, Indonesia, Singapore, and the Philippines. James presented his paper titled, ‘Searching for an Ideal International Investment Protection Regime for ASEAN + Dialogue Partners (RCEP): Where do we Begin?’ The paper conducted a baseline study of various provisions contained in various BITs, regional investment agreements and investment chapters of FTAs among ASEAN and its Dialogue Partners. He also proposed that RCEP should be used as an opportunity to consolidate the existing investment agreements to solve parallelism caused by the spaghetti bowl phenomenon of investment agreements among the negotiating parties. The Workshop is expected to produce a report for RCEP negotiators that can support the negotiating process.

CIL Practice Fellow Ms Harpreet Kaur Dhillon was invited to speak at the Regional Arbitral Institutes Forum (RAIF) 2015 on 9 May 2015 at the Kuala Lumpur Regional Centre for Arbitration in Kuala Lumpur, Malaysia. She was part of a 3-member panel on investor-state arbitration, together with Professor Chester Brown of University of Sydney and Mr. Hussein Haeri of Withers LLP (London). Harpreet presented on the “Clash of Bilateralism and Regionalism in International Investment Agreements of ASEAN Member States: What Have We Overlooked?”, examining the overlap in investment treaty protection in existing agreements and why an investor may approach strategically the question of which amongst multiple investment agreements between the same State parties it may proceed in investor-state arbitration. The keynote address was delivered by Singapore’s Attorney-General, Mr. V K Rajah SC, and the conference was hosted by the Malaysian Institute of Arbitrators. The British Institute of International and Comparative Law invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, to be one of the panellists in the 24th Investment Treaty Forum Public Conference, which was held on 8 May 2015 in London, United Kingdom. The theme of this year’s forum was “The European Union’s Investment Treaties in Global Context”. On the panel, “Comparing the Texts-Substantive Protections”, Michael discussed the most-favoured nation (MFN) clause, which has been a subject of controversy in international investment law. He noted that the Investment Chapter of the EU-Singapore Free Trade Agreement does not have an MFN clause, whereas the Investment Chapter of the Canada-EU Free Trade Agreement (CETA) has one that carves out dispute settlement and limits MFN application only to treatment. He then proposed that the necessity of an MFN clause should be re-evaluated in light of States’ attempts to refine their new International Investment Agreements (IIAs), and that National Treatment (NT) and Fair and Equitable Treatment (FET) clauses may be sufficient to address investors’ concerns regarding abuse.

The United Nations Conference on Trade and Development (UNCTAD) invited A/P Michael Ewing-Chow, CIL Head of Trade/Investment Law and Policy, as one of a select group of international investment law experts to a Peer Review Meeting for the forthcoming UNCTAD World Investment Report (WIR) 2015. The Meeting was held on 29-30 April 2015 in Geneva, Switzerland. During the Meeting, the experts discussed the issue of International Investment Agreement (IIA) reform and how a holistic approach to IIA should be conceptualised. UNCTAD will include the result of the discussions in the forthcoming WIR 2015.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow was invited by the ASEAN Secretariat and the World Trade Institute (WTI) to speak at the ASEAN Comprehensive Investment Agreement (ACIA) Forum on “Transforming Investment in ASEAN through ACIA”, which was held on 15 April 2015 in Jakarta, Indonesia. He shared his views about how ASEAN could be transformed into an investment hub by the ACIA and the potential benefits of ACIA to Indonesia. He also chaired a session on “The experience of the Indonesian and Third-Country Businesses in Investing in ASEAN”. The speakers of the session included Indonesian business leaders from Indofood, Semen Indonesia and XL Axiata, as well as Mr Rizar Indomo Nazaroedin, Director of Regional Cooperation of the Indonesian Investment Coordination Board (BKPM).

CIL Senior Research Fellow Dr Hao Duy Phan was invited to speak at the Workshop on Maritime Security and the Marine Environment on 30 March 2015 in Honolulu, Hawaii, USA. Hao Duy Phan delivered a presentation on ‘Global Regimes for Protection and Preservation of the Marine Environment: An Overview’. The Workshop was organised by the United States Council for Security Cooperation in the Asia Pacific (USCSCAP) in conjunction with the Inter-Sessional Meeting of the ASEAN Regional Forum (ARF) on Maritime Security. CIL Director Robert Beckman and CIL Senior Visiting Research Fellow Lynn Kuok participated in a two-day workshop co-organised by the National Institute for South China Sea Studies entitled “South China Sea: Duel Track Approach and Win-Win Cooperation” on 28-29 March 2015 in Hainan, China. Prof Beckman made a presentation in a panel on International Cooperation in Enclosed and Semi-Enclosed Seas. The Workshop was attended by Chinese Government officials and by scholars from China, Taiwan, Southeast Asia, Australia, Canada, the United States and Sweden. CIL Research Fellow Leonardo Bernard presented at the International Workshop on the Legal Aspects of the Establishment of the Outer Limits of the Continental Shelf, held in Tokyo, Japan on 26-27 March 2015. The workshop was organised by the Japan Hydrographic Association and the Nippon Foundation. Leo was part of the third session on the Legal Regime of the Continental Shelf – Regional Experience, where he presented an overview of the maritime claims in the South China Sea. The seminar was organised by the Centre for Strategic and International Studies, Jakarta. CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by IELPO LL.M Programme to teach the course of Regionalism in Asia. The course, which was held on 12-13 March 2015, engaged the students in interactive discussions on Asia’s experience in economic integration, particularly the Southeast Asian States within the ASEAN.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited by Universidad Sergio Arboleda in Colombia to teach in its Madrid campus. The course was attended by Colombian students as part of their course in Masters in International Commerce. The intensive course, which was held on 4-6 March 2015, discussed various aspects of ASEAN Integration and how it contributed to the improvement of the rule of law in the region.

CIL Head of Trade/Investment Law and Policy Associate Professor Michael Ewing-Chow and CIL Research Fellow Junianto James Losari were invited to the 2015 UNCTAD Expert Meeting on the Transformation of the IIA Regime, held from 25-27 February 2015. This Expert Meeting is the first-of-its-kind conference that brings together multi-stakeholders – treaty negotiators, academics, non-governmental organisations (NGOs) and relevant international organizations, e.g. the Organization for Economic Development (OECD) and the World Trade Organization (WTO) – to discuss and contribute to the transformation of the IIA regime which is currently under scrutiny by various States around the world. Associate Professor Michael Ewing-Chow was appointed as one of the Rapporteurs for the event. Various suggestions to improve the current IIA regime were put forward during the discussions, and the suggestions will be included in the 2015 World Investment Report.

Organised by the Indian Society of International Law, the programme covered a wide range of areas in international law and practice. CIL Research Fellow Ms Ranyta Yusran was invited to participate in the Second Conference on the ‘Historical Origin of International Criminal Law’ (HOICL) in New Delhi, India on 29-30 November 2014. Ms Yusran presented a paper that she was invited to contribute entitled ‘Transitional Justice Delayed or Denied? A Case Study of Southeast Asia and Indonesia’. The Conference was organised by the Centre for International Law Research and Policy (CILRAP), the European University Institute and Peking University. The Conference proceedings will be published in the last instalment of CILRAP’s trilogy on the HOICL. Other contributors consisted of judges and law practitioners from numerous international criminal tribunals as well as international criminal law scholars. CIL Director Professor Robert Beckman, CIL Global Associate Captain J Ashley Roach and CIL Senior Research Fellow Dr Hao Duy Phan were invited to participate in the 6th South China Sea International Conference on ‘Cooperation for Regional Security and Development’ on 17-18 November 2014 in Da Nang, Viet Nam. The Conference was jointly organised by the Diplomatic Academy of Viet Nam, the Viet Nam Lawyers Association and the East Sea Foundation. Professor Beckman and Dr Phan co-authored a paper on ‘Air Defence Identification Zones: Implications for Freedom of Overflight and Maritime Disputes’. Captain Roach presented a paper on ‘Conforming Maritime Claims to the Law of the Sea’. Professor Beckman also chaired a session at the Conference on ‘Confidence Building and Preventive Diplomacy’. CIL Director Robert Beckman gave a presentation at a Conference on ‘Energy Security in Southeast Asia: Implications and Concerns’. The conference was organised by the NUS Energy Studies Institute and held at the Carlton Hotel in Singapore. Professor Beckman participated in the panel on Maritime Disputes and Tensions in Southeast Asia. The title of his presentation was International Law and the South China Sea Disputes.

CIL Head of Trade and Investment Law and Policy Professor Michael Ewing-Chow was invited to the Global Georgetown Alumni Academic Program on 11 December 2014 in Singapore to share his views on the ongoing Trans-Pacific Partnership (TPP) negotiations. He suggested that the slow progress must be understood in the context of the differences between the negotiating states, including the rule of law and the economic and social issues within each state. Further, the negotiating states also have different offensive and defensive interests. For example, the United States has an offensive interest in ensuring a better Intellectual Property (IP) regime, while Australia has the opposite. Similarly, Australia, Canada and New Zealand have an offensive interest in agriculture, while Japan seeks to protect this sector. These differences alone pose challenges for the negotiating countries in striking an agreement that can accommodate all their interests. In addition, he shared his view that it is likely that Multinational Companies (MNCs) who operate Global Value Chains (GVCs) will play a greater role in driving the negotiations. Another interesting interplay to watch will be China’s role, as it has announced its interest in joining the TPP.

CIL Research Fellow Dr Zhen Sun was invited to speak at a conference organised by the Joint Institute for Maritime Law and History of International Shipping Law School at East China University of Political Science and Law entitled ‘Maritime Non-Traditional Security Challenges in Asia-Pacific: An Interdisciplinary and Transnational Dialogue on Reconstruction of Legal Order’ on 15 November 2014, in Shanghai, China. More than 50 academics and students attended the Conference. Dr Sun delivered a presentation on ‘Mechanism under the 1988 SUA Convention for Combating Maritime Security Threats’, in which she argued that SUA provides States Parties with quasi-universal criminal jurisdiction over specific offences that threaten the safety of navigation. This may be an effective tool to address non-traditional maritime security threats in Southeast Asia if all States ratify and implement SUA. To download her presentation, click here.

CIL Senior Research Fellow Youna Lyons was invited as a speaker to the pre-conference policy discussions on the implementation of the D-2 regulations on 5 November 2014 in Singapore. In her presentation titled ‘Ballast Water Management Convention: D-1 and D-2 regulations and related compliance issues’, she discussed the circumstances in which Port States may proceed to indicative and detailed samplings and the sanctions that may be imposed by the Port State should the samplings suggest non-compliance with the regulations. The discussion was based on the language of the Convention, as well as the new Port State Control Guidelines adopted at MEPC 67. To view her presentation, click here.
